On March 9, 2016 an exception was granted from the prohibition of double-frontage lots for lots 5, 6, and 7 in Dunlora V. This exception was granted with a condition that screening that meets 14-419 be provided along the rear of all three lots. The previously approved road plans and exception exhibit provided this screening along the rear of all three lots (see attached Exhibit 1). Now that the site in under construction, it has become clear that there is existing vegetation on the Dunlora V and Club Dunlora open space areas that provides good screening of large portions of lots 5 &6 (see attached photos), and that some of the plants proposed with the original exception would be better used to screen lots 7 and 8. Upon closer inspection, it has also come to light that there are only two very small areas of lots 5 and 7 that meet the definition of"double-frontage lot" (having less than 20' between the rear lot line and the right-of-way) (see attached Exhibit 2). While the majority of lot 7 and all of lot 8 do not meet the definition of a double-frontage lot, the larger open space between the rear lot lines and the Rio Road right-of-way is not vegetated, leaving these lots very exposed to the traffic along Rio. We request to reconfigure the planting to reduce the number of trees proposed along lots 5 and 6 and redistribute those plants behind lots 7 and 8 (see attached Exhibit 3). Our new plan still provides the required double-staggered row of evergreens in both small areas that meet the definition of"double-frontage" lot, but moves some of the plantings to areas more in need of screening. Our plan also revises the plants specified to provide more appropriate species and additional variety. The same number of plants is proposed as originally approved, they are just in different locations to make use of existing vegetation and screen areas not currently proposed to be screened. All plantings are still within landscape easements, if on an individual lot, and outside of utility easements. Section 14-419 states, "The screening requirements may be varied or excepted by the agent as provided in section 14-203.1. In reviewing a request for a variation or exception, the agent shall consider whether adequate screening by topography and vegetation exists so that the rear of the dwelling units will not be visible from a public street or a street intended to provide rear access to lots."; we make this request in keeping with this provision.
