It was entered into CV incorrectly as $1,681 + an additional $215, for a total of$1,896. I pulled the application and am unsure how this happened, especially when you clearly wrote it out. We have had a bunch of new folks in intake who may have been learning on this one. Regardless, it has been corrected in CV and will be corrected on the action letter. Additionally, I will be looking into Engineering's comment#3 to assure it is correct before taking action on the plan. It is a roadway not an alley." 1 Bill's reading of 14-410(F), which makes good sense and matches how we have always interpreted this section, is that this section of county code is talking about is the roads to the subdivision: "The principle means of access . ". The street to a subdivision is Dunlora Drive(Public Road),thus this requirement is met. If it said: "The principle means of .. "then we would require the alley to be upgraded but instead the code reads "to a subdivision". Thus, I think this comment needs to be omitted as I agree with Bill. Do you agree with this reading or have concerns? Additionally, I think the only standards that should apply to the alley are listed in Section 14-410(D). Sec. 14-410 Standards for all streets and alleys. The following minimum design standards shall apply to all streets and alleys within a subdivision: F. Principal means of access to subdivision. The principal means of access to a subdivision shall be either a public street or a private street. The principal means of access shall conform, in the case of a public street, to Virginia Department of "Transportation standards, or, in the case of a private street, to the standards of the county as set forth in section 14-412, throughout the street's length, including any distance between the boundary of the subdivision and any existing public street. Sec. 14-412 Standards for private streets only. 3. Streets serving six lots or more. Each private street serving six(6)or more lots shall satisfy Virginia Department of Transportation standards, provided: (a)Private streets in the rural areas. To follow-up on his question, I am providing the County regulations on affordable housing as it relates to this development. Not sure who is the lead representative for the neighbors (if anyone)but I wanted to provide the ordinance language for that citizens consideration. Attached I have provided Chapter 18 Section 15 (R-4 Zoning regs). Affordable Housing is provided for in section 15.4.3 and breaks down the pricing structure and holding period. Thank you. 1,1 4orSe 1 'fir►' ` 15.4.3 AFFORDABLE HOUSING For providing affordable housing units, a density increase of thirty (30) percent shall be granted, subject to the following: a. At least one-half of the additional housing units allowed by this density bonus shall be developed as affordable housing units,(Amended 10-3-07) b. The initial sale price for sale units or the rental rate for a period of at least ten (10) years for rental units shall qualify as affordable housing under either the Virginia Housing Development Authority, Farmers Home Administration or Housing and Urban Development housing choice voucher program.(Amended 10-3-07) c. If rental units, the developer shall enter into an agreement with the County of Albemarle restricting the rental rates of the affordable units for a period of at least ten(10)years or until the units are sold as affordable units,whichever comes first. If sale units, the developer shall provide the chief of housing with confirmation of the initial sale price for the affordable units prior to the issuance of building permits for the bonus units_ (Amended 8-14-85; 10-3-07) e. (Added 10-3-07) The occupancy of the affordable units shall be restricted to those households with incomes at or below eighty(80)percent of the area median income for for-sale units and at or below sixty (60)percent of the area median income for rental units. The chief of housing or his designee must approve all purchasers of for-sale units based on household income. Prior to issuance of the first certificate of occupancy for a building providing affordable rental units,the developer shall enter into a rental rate agreement with the county,approved by the county attorney,that delineates the terms and conditions pertaining to rental rates,occupancy and reporting during the minimum ten(10)year period. As expected, the citizens' concerns had heavy focus on the entrance and the existing/future traffic conditions at this intersection. Many of the citizens were frustrated with the by-right nature of the project and expected the County or VDOT to have more control over approvals based on traffic conditions. VDOT discussed the spacing exception requirement and who would review it once it is submitted (currently the developer has not submitted the request). Many in attendance were also frustrated by the lack of public review or ability to challenge the pending decision for the spacing exception. As discussed at the meeting,based on the review comments I plan to approve w/ conditions the initial site plan within the next 14 days to meet the 60 day time for action as specified in the ordinance. It will be on the applicant to address all the conditions prior to final site plan approval, with the biggest hurdle being that of the spacing exception for the entrance (VDOT comment#1). Adam Moore of VDOT is out this week but will be back next week. In the meantime,I talked to Willis (his staff reviewer)briefly about comment #1 -the access management exception requirement for the second entrance; he said it would have to go to the District Administrator at VDOT to make the decision on either approval of the exception or the denial.He also said that the County's wishes to either approve or deny this request would be a factor in the consideration, amongst other things. I do not believe such a request has been submitted by the applicant to VDOT yet, nor have these VDOT comments made it to the applicant yet—SRC is on the 6'of July and the comments are not due yet. Prior to sending these comments to the applicant, I plan to touch base with Adam on his comments once he returns next week. Also, as discussed County staff never guided the applicant to submit a phase II w/a second entrance.Nor was the guidance provided by staff intended to back the developer into a corner to submit a proposal with a second entrance.The guidance I provided below was a response to a question from Scott Collins on how to bring a road segment through the preserved slopes. My response was merely to inform the developer about the process to bring such a road segment through the preserved slopes. The development was initially intended to only be a single phase(with a few lots in what is now being proposed as phase II). Only after the applicant received VDOT's comments on not allowing access/shared driveways off Rio Road during"phase I"review did Scott come up with the idea to do a second phase and access the lots with an alley off the main road.Notably, once I received the submittal my biggest concern was the entrance. Hope this helps lock down in writing what we spoke about over the phone.Additionally, I have also been contacted by Bruce Dotson on this issue, see my attached email response to him which also discussed my concern and confusion with VDOT comment#2, as the proposed public road in phase I were already approved by VDOT. I plan to touch base with Adam on his comments once he returns next week. If you have any other questions prior to SRC please ask. Looking at the ordinance, what we are proposing might be allowed as a by-right use under section 30.7.4.b.1.c—Necessary public facilities. Per VDOT's requirements and recommendations,they are requesting that we access this portion of the project from Varick Drive (Which I think would meet part iii under this code). If that were the case,then I would think that we would just need to go through SRC meeting for the proposed change, but not a SP for the modification. Attached is the VDOT comment letter I have been working on my review for Dunlora Overlook road plan and hope to have my comments on that plan to you by 3-28-17. In the meantime, while doing research on your question above and discussing it with Bill,Megan, and Emily. Such a proposal would not be pei twitted under this section of the ordinance because this Public facility is not necessary to allow the use of the lot.This property is being divided into 30 some lots,you are being permitted to use your land. This portion of the public road cannot cross these preserved slopes. The ordinance provides for a special use permit option under Section 30.7.4(b)(2)for private facilities. But this too has its own problems with regard to your proposal. If you switch your proposed road segment to a private street then you are going to be required to make a private street request in the development area...(look at the criteria in that section of the ordinance(Secton 14-233(A)(1)), I believe you are going to have a hard time getting such a street approved). Also,then you would have to go through the Special Use Permit process too. I don't think this will be approved either. Your only true option is to go through a rezoning under Section 33 to have the slopes changes from Preserved to Managed but you are going to have a hard time getting that approved as it'll have to go to the PC and the BOS and you will be up against the Characteristics of Steep Slopes as provided for in Section 30.7.3. So all in all, I am not seeing a way for you to go through the process without considerable time and effort spent with most avenues not being approvable once you get into the requirements. I write both as a Dunlora resident and Rio District Planning Commissioner. Were this to come before the Commission as a private street, I would find it difficult to find that the proposed private alley serves the public interest rather than the developers private interests. While I am a supporter of 1 law affordable housing and while affordable housing is in the public interest, the provision of six affordable units occurring at this location, does not offset the public detriment that would result from the proposed alley given the unusual traffic conditions already in existence and which will degrade as more development occurs in the area. I very strongly encourage VDOT to be strict in the application of established standards and not to bend over backwards to shoehorn phase II as proposed. So all in all, I am not seeing a way for you to go through the process without considerable time and effort spent with most avenues not being approvable once you get into the requirements. " But without an actual application to rezone being submitted or the applicant having went to a work session w/ the PC or BOS, it's all just preliminary guidance. They would need to make an application and go through the process of a rezoning to have a definitive answer.
