recommend for or against the spacing exception required for the entrance
of the proposed development. These intersections include Rio Road and
Dunlora Drive, and Rio Road and John Warner Parkway. I recommend
submittal of a traffic analysis of impacts at these locations to insure the
spacing exception required to access Dunlora Drive will not further degrade
safety or operations at these intersections.

You were correct about the notification fee being paid. It was entered into CV incorrectly as $1,681 + an
additional $215, for a total of$1,896. I pulled the application and am unsure how this happened, especially
when you clearly wrote it out. We have had a bunch of new folks in intake who may have been learning on this
one. Regardless, it has been corrected in CV and will be corrected on the action letter.
Additionally, I will be looking into Engineering's comment#3 to assure it is correct before taking action on the
plan. Per additional research this comment was not correct based on the requirements in the ordinance, thus I
omitted it in consultation with Emily/Frank.

I spoke to Bill about Engineering's SRC comment: "Per County Code 14-410 F and 14-412.3, the alley must meet public
road standards since it is the principal meals of access to the subdivision and it serves more than 6 lots. It is a roadway
not an alley."

Bill's reading of 14-410(F), which makes good sense and matches how we have always interpreted this section, is that this
section of county code is talking about is the roads to the subdivision: "The principle means of access . ".
The street to a subdivision is Dunlora Drive(Public Road),thus this requirement is met. If it said: "The principle means of
.. "then we would require the alley to be upgraded but instead the code reads "to a subdivision".
Thus, I think this comment needs to be omitted as I agree with Bill. Do you agree with this reading or have concerns?
Additionally, I think the only standards that should apply to the alley are listed in Section 14-410(D).
Sec. 14-410 Standards for all streets and alleys. The following minimum design standards shall apply to all streets and
alleys within a subdivision:
F. Principal means of access to subdivision. The principal means of access to a subdivision shall be either a public street
or a private street. The principal means of access shall conform, in the case of a public street, to Virginia Department of
"Transportation standards, or, in the case of a private street, to the standards of the county as set forth in section 14-412,
throughout the street's length, including any distance between the boundary of the subdivision and any existing public
street.
Sec. 14-412 Standards for private streets only.
3. Streets serving six lots or more. Each private street serving six(6)or more lots shall satisfy Virginia Department of
Transportation standards, provided:

One of the gentleman who attended the SRC meeting today asked a question about Affordable Housing. To
follow-up on his question, I am providing the County regulations on affordable housing as it relates to this
development. Not sure who is the lead representative for the neighbors (if anyone)but I wanted to provide the
ordinance language for that citizens consideration. Attached I have provided Chapter 18 Section 15 (R-4 Zoning
regs). Affordable Housing is provided for in section 15.4.3 and breaks down the pricing structure and holding

15.4.3 AFFORDABLE HOUSING
For providing affordable housing units, a density increase of thirty (30) percent shall be granted,
subject to the following:
a. At least one-half of the additional housing units allowed by this density bonus shall be
developed as affordable housing units,(Amended 10-3-07)
b. The initial sale price for sale units or the rental rate for a period of at least ten (10) years for
rental units shall qualify as affordable housing under either the Virginia Housing
Development Authority, Farmers Home Administration or Housing and Urban Development
housing choice voucher program.(Amended 10-3-07)
c. If rental units, the developer shall enter into an agreement with the County of Albemarle
restricting the rental rates of the affordable units for a period of at least ten(10)years or until
the units are sold as affordable units,whichever comes first. (Amended 10-3-07)
d. If sale units, the developer shall provide the chief of housing with confirmation of the initial
sale price for the affordable units prior to the issuance of building permits for the bonus units_
(Amended 8-14-85; 10-3-07)
e. Manufactured homes for rent in an approved manufactured home park shall be considered
rental units under this section provided they qualify as affordable housing under the Housing
and.Urban Development housing choice voucher program. (Added 3-5-86;Amended 10-3-07)
f. Manufactured home lots for rent in an approved manufactured home park shall qualify for this
bonus provided the developer enters into an agreement with the County of Albemarle that the
lots shall be available for rent to manufactured home owners for a period of at least ten (10)
years. (Added 3-5-86;Amended 10-3-07)
g. Manufactured home lots for sale in an approved manufactured home subdivision shall qualify
for this bonus provided the developer restricts the use of the lots to manufactured homes or
other affordable housing for a period of at least ten(10)years. (Added 3-5-86; Amended 10-
3-07)
h_ The decision to extend the periods beyond the ten(10)year minimum provided in subsections
(b),(c),(f)and(g)shall be in the sole discretion of the developer. (Added 10-3-07)
The occupancy of the affordable units shall be restricted to those households with incomes at
or below eighty(80)percent of the area median income for for-sale units and at or below sixty
(60)percent of the area median income for rental units. The chief of housing or his designee
must approve all purchasers of for-sale units based on household income. Prior to issuance of
the first certificate of occupancy for a building providing affordable rental units,the developer
shall enter into a rental rate agreement with the county,approved by the county attorney,that
delineates the terms and conditions pertaining to rental rates,occupancy and reporting during
the minimum ten(10)year period. (Added 10-3-07)

We had about 15 citizens attend the site review meeting today for the above ref project. As expected, the
citizens' concerns had heavy focus on the entrance and the existing/future traffic conditions at this intersection.
Many of the citizens were frustrated with the by-right nature of the project and expected the County or VDOT
to have more control over approvals based on traffic conditions. VDOT discussed the spacing exception
requirement and who would review it once it is submitted (currently the developer has not submitted the
request). Many in attendance were also frustrated by the lack of public review or ability to challenge the
pending decision for the spacing exception.
As discussed at the meeting,based on the review comments I plan to approve w/ conditions the initial site plan
within the next 14 days to meet the 60 day time for action as specified in the ordinance. It will be on the
applicant to address all the conditions prior to final site plan approval, with the biggest hurdle being that of the
spacing exception for the entrance (VDOT comment#1).

As discussed over the phone attached are VDOT's comments on the initial site plan for phase II. Adam Moore of VDOT
is out this week but will be back next week. In the meantime,I talked to Willis (his staff reviewer)briefly about comment
#1 -the access management exception requirement for the second entrance; he said it would have to go to the District
Administrator at VDOT to make the decision on either approval of the exception or the denial.He also said that the
County's wishes to either approve or deny this request would be a factor in the consideration, amongst other things. I do
not believe such a request has been submitted by the applicant to VDOT yet, nor have these VDOT comments made it to
the applicant yet—SRC is on the 6'of July and the comments are not due yet. Prior to sending these comments to the
applicant, I plan to touch base with Adam on his comments once he returns next week.
Also, as discussed County staff never guided the applicant to submit a phase II w/a second entrance.Nor was the
guidance provided by staff intended to back the developer into a corner to submit a proposal with a second entrance.The
guidance I provided below was a response to a question from Scott Collins on how to bring a road segment through the
preserved slopes. My response was merely to inform the developer about the process to bring such a road segment
through the preserved slopes. The development was initially intended to only be a single phase(with a few lots in what is
now being proposed as phase II). Only after the applicant received VDOT's comments on not allowing access/shared
driveways off Rio Road during"phase I"review did Scott come up with the idea to do a second phase and access the lots
with an alley off the main road.Notably, once I received the submittal my biggest concern was the entrance.
Hope this helps lock down in writing what we spoke about over the phone.Additionally, I have also been contacted by
Bruce Dotson on this issue, see my attached email response to him which also discussed my concern and confusion with
VDOT comment#2, as the proposed public road in phase I were already approved by VDOT. I plan to touch base with
Adam on his comments once he returns next week.

Can you give me an understanding of why staff provided the following feedback that essentially backed the developer
into a corner that would cause them to create a second curb-cut in an already dangerous intersection? I am trying to
understand how we got here.The residents are aware of the possibility of two entrances, and are not happy.

Thank you again for meeting with me on the proposed change. Looking at the ordinance, what we are proposing might
be allowed as a by-right use under section 30.7.4.b.1.c—Necessary public facilities. Per VDOT's requirements and
recommendations,they are requesting that we access this portion of the project from Varick Drive (Which I think would
meet part iii under this code). If that were the case,then I would think that we would just need to go through SRC
meeting for the proposed change, but not a SP for the modification. Attached is the VDOT comment letter
I have been working on my review for Dunlora Overlook road plan and hope to have my comments on that plan to you by
3-28-17. In the meantime, while doing research on your question above and discussing it with Bill,Megan, and Emily.
Such a proposal would not be pei twitted under this section of the ordinance because this Public facility is not necessary to
allow the use of the lot.This property is being divided into 30 some lots,you are being permitted to use your land. This
portion of the public road cannot cross these preserved slopes. The ordinance provides for a special use permit option
under Section 30.7.4(b)(2)for private facilities. But this too has its own problems with regard to your proposal. If you
switch your proposed road segment to a private street then you are going to be required to make a private street request in
the development area...(look at the criteria in that section of the ordinance(Secton 14-233(A)(1)), I believe you are going
to have a hard time getting such a street approved). Also,then you would have to go through the Special Use Permit
process too. I don't think this will be approved either. Your only true option is to go through a rezoning under Section 33
to have the slopes changes from Preserved to Managed but you are going to have a hard time getting that approved as it'll
have to go to the PC and the BOS and you will be up against the Characteristics of Steep Slopes as provided for in Section
30.7.3.
So all in all, I am not seeing a way for you to go through the process without considerable time and effort spent with most
avenues not being approvable once you get into the requirements. Hope this helps.

I have received the following comment from one of our Planning Commissioners on the spacing exception,
please add this to the record:
"Chris,
Please enter my comments into the site committee meeting regarding Dunlora Park phase II. I write both as a
Dunlora resident and Rio District Planning Commissioner.
Were this to come before the Commission as a private street, I would find it difficult to find that the proposed
private alley serves the public interest rather than the developers private interests. While I am a supporter of

affordable housing and while affordable housing is in the public interest, the provision of six affordable units
occurring at this location, does not offset the public detriment that would result from the proposed alley given
the unusual traffic conditions already in existence and which will degrade as more development occurs in the
area. I very strongly encourage VDOT to be strict in the application of established standards and not to bend
over backwards to shoehorn phase II as proposed.

the unusual traffic conditions already in existence and which will degrade as more development occurs in the

Thank you for the email. The modification to the sewer alignment that you mention below was done to avoid the
retaining wall and platform area that you have built behind your home within the common area (HOA property)of
Dunlora, and over the existing sanitary sewer easement. We have modified the alignment to avoid this retaining wall
structure and tie-into the sanitary sewer line in a location that is within the Dunlora HOA property. In addition,this
location of the tie-in connection is behind the adjacent lot and does not impact your lot.

I had asked the county planner, Christopher Perez, if there had been any decision made regarding the sewer tie-
in from Dunlora Park. I have had discussions with surveyors and engineers here on-site and there seems to be
several ideas floated. I have already moved a large quantity of native vegetation in anticipation of a dig only to
find out that another path is now desired. This will affect me directly, and while I understand there is a narrow
realm of possible solutions, I would like to ensure that the most direct, least destructive option is considered.

The citizen concern is about the alignment of the sewer and where it connects to the sewer offsite. Have either
of you contacted/via email David James & Seve Panos who had the questions. I have expressed to them that
there Is nothing I/the County dictate on the location for this one. Not even sure you can dictate it if it meets the
requirements of your ordinance. Literally just passing along the citizen interest/concern about the sewer
alignment onto you so that ACSA can hear their concerns and explain to them why it is there, and why it should
be there vs somewhere else. That's all.

and your client have to weigh but is really independent of VDOT's comments. We can discuss the exception request

Chris forwarded me your comments on Dunlora Park. I wanted to touch base with you before the meeting, and also
share Chris's previous email about the inter-connection between Phase I and Phase II with Dunlora. We tried to work
with the county to make this connection, but were ultimately told that this was a rezoning, and that the rezoning would
more than likely not be supported. Based on this,we will have to go through the access management request for this
connection, as discussed awhile back.

My exact guidance was "...Your only true option is to go through a rezoning under Section 33 to have the
slopes changes from Preserved to Managed but you are going to have a hard time getting that approved as it'll
have to go to the PC and the BOS and you will be up against the Characteristics of Steep Slopes as provided for
in Section 30.7.3. So all in all, I am not seeing a way for you to go through the process without considerable
time and effort spent with most avenues not being approvable once you get into the requirements. "
But without an actual application to rezone being submitted or the applicant having went to a work session w/
the PC or BOS, it's all just preliminary guidance. They would need to make an application and go through the
process of a rezoning to have a definitive answer. Also, I understand the predicament; however, utilizing every

under Section 30.7.4(b)(2)for private facilities. But this too has its own problems with regard to your proposal. If you
switch your proposed road segment to a private street then you are going to be required to make a private street request in
the development area...(look at the criteria in that section of the ordinance(Secton 14-233(A)(1)), I believe you are going
to have a hard time getting such a street approved). Also,then you would have to go through the Special Use Permit
process too, I don't think this will be approved either. Your only true option is to go through a rezoning under Section 33

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Collins Engineering, dated May
22, 2017, and offer the following comments:
1. The proposed entrance on Dunlora Drive does not meet the 225 ft. corner clearance
� standard. An approved Access Management exception would be required.
c.)1'he Department recommends providing access to these residences via proposed Varick
St. as noted in the review letter for Phase I dated November 30, 2016. Additionally
Phase I is not currently eligible for acceptance into the secondary street system as it does
not meet SSAR connectivity requirements. If access is provided to Phase II via Varick
St. Phase I will meet these requirements and become eligible.
3. Current design doesn't meet connectivity requirements; please see Road Design Manual
appendices B (I), SSAR, page 14, section 30-92-60 for reference. The regulation requires
that new developments provide connectivity between adjacent developments and
undeveloped parcels. If the proposed lots are served by a connection to Varick St. this
requirement will be satisfied as there is not enough property frontage to provide an
additional entrance that meets the Access Management regulations.
4. Please show mill and overlay on plans in accordance with the WP-2 standard and place
the standard on the plans.
5. The mill and overlay will require work to centerline, so flagging operation will be
necessary. Please provide an MOT plan in accordance with the Virginia Work Area
Protection Manual.
6. Commercial entrance design to serve a Private Subdivision Road/Street. Please see Road
Design Manual appendix F-Access Management design standards for entrances and
Intersections, figure 4-8 and F-123, for an Entrance for a Private Subdivision Street. The
minimum entrance radius is 25 ft. and the shoulder should be extended to the right of way
line.

the development area...(look at the criteria in that section of the ordinance(Secton 14-233(A)(1)),I believe you are going
to have a hard time getting such a street approved).Also,then you would have to go through the Special Use Permit
process too, I don't think this will be approved either. Your only true option is to go through a rezoning under Section 33
to have the slopes changes from Preserved to Managed but you are going to have a hard time getting that approved as it'll
have to go to the PC and the BOS and you will be up against the Characteristics of Steep Slopes as provided for in Section

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Collins Engineering, dated May
22, 2017, and offer the following comments:
1. The proposed entrance on Dunlora Drive does not meet the 225 ft. corner clearance
standard. An approved Access Management exception would be required.
2. The Department recommends providing access to these residences via proposed Varick
St. as noted in the review letter for Phase I dated November 30, 2016. Additionally
Phase I is not currently eligible for acceptance into the secondary street system as it does
not meet SSAR connectivity requirements. If access is provided to Phase II via Varick
St. Phase I will meet these requirements and become eligible.
3. Current design doesn't meet connectivity requirements; please see Road Design Manual
appendices B (1), SSAR, page 14, section 30-92-60 for reference. The regulation requires
that new developments provide connectivity between adjacent developments and
undeveloped parcels. If the proposed lots are served by a connection to Varick St. this
requirement will be satisfied as there is not enough property frontage to provide an
additional entrance that meets the Access Management regulations.
4. Please show mill and overlay on plans in accordance with the WP -2 standard and place
the standard on the plans.
5. The mill and overlay will require work to centerline, so flagging operation will be
necessary. Please provide an MOT plan in accordance with the Virginia Work Area
Protection Manual.
6. Commercial entrance design to serve a Private Subdivision Road/Street. Please see Road
Design Manual appendix F -Access Management design standards for entrances and
Intersections, figure 4-8 and F-123, for an Entrance for a Private Subdivision Street. The
minimum entrance radius is 25 ft. and the shoulder should be extended to the right of way
line.

Appendices B (1) and F, as well as any other applicable standards, regulations, or other

I just received a call from a concerned citizen, who is also Dunlora's HOA president, Judy Schlussel. Her&the
community have some concerns with the above ref project, which revolve around traffic and the number of cars
that are being dumped onto this public roadway.
I explained that this is a by right development and that I don't believe that type of consideration would deny the
proposal. I told her that the spacing of the entrance is my biggest concern with this proposal,but that is a VDOT
review requirement and once you all conduct your review we'll know where it stands. She plans to contact you
to discuss their concerns. Additionally, her and some of the residents plan to attend the July 6th SRC meeting
and request that VDOT attend.

I did have the previously approved plan, SUB2016-97, after all. It's on the COUNTYWIDE site. However, it
appears that the site work that's underway doesn't conform to it because a retaining wall has already been built

conditions back on 7-5-16 (conditions attached). The applicant has submitted finals for both of these plans as

you should not that lot 30 and 31 on the prelim and initial has been omitted as the applicant submitted phase 2

I was about to send Virginia Roy and David Wayland a note to say they should contact the lead planner on the project
when I clicked over to this memo and saw that no "lead reviewer" is listed for any of these projects. I know that was an
oversight, but I also wanted to offer that adding the email and/or phone number for the lead reviewer on the memo
would give folks reading these memos all the info they need to get right to the correct person.
I'm going to hold off sending that message, since in this case,they really didn't know where to go for more information.

I am the planner who will be reviewing the above ref proposal. I was forwarded some of your questions and concerns
about the proposal. I believe some of your concerns may have been driven by the legal advertisement in the SRC memo
you received, in which the density listed in the"proposal"section may have not been very clear. The legal ad has been
revised to avoid confusion(provided below).Additionally, I have answered your specific questions from that email
below:
1)The request is not a rezoning;rather,the request is a byright development.
2)The property is not zoned R-6, it is truly zoned R-4.
3)The project appears to be well within its allowable density for the amount of acreage being developed. Of course, I'll
be conducting a full review once we get further into the review period but on the face of it I offer the following breakout
of the density:
TMP 61-165 is 8.55 acres
Phase I contains 29 units as seen on SUB2017-67 and SDP2017-33.
Phase II contains 11 units(6 of which are affordable units)
Total Unit Count: 40
The proposed density is 4.67 units per acre.
The proposed density is permitted in the R-4 zoning district through bonus cluster provisions by providing Affordable
Units and a min of 25%Open Space(see Sec 15.3 of the Zoning Ordinance).

I worked w Megan to modify the legal ad per citizen/CAC concerns about the density not being accurately
reflected. I have updated the legal ad in Countyview, the only portion that changed was the"proposal"portion.

emergency vehicles stopping on Rio Rd could cause a safety issue as it is a main road with lots of

"It is intended by this article that all roads within the county which serve or are designed
