(The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] Comments not addressed from Preliminary Plat: 1. The preserved slopes shown on the plat do not match the County GIS preserved slopes. As shown on the plat, there is a gap between preserved slopes in the open space, however the County GIS does not show a gap in the slopes in this location. If the field run topo is different than that of the County GIS, the information should be clearly provided to the County Engineer to determine if the field run topo is more accurate than County GIS. Rev: The County Engineer will make this determination at final plat. Submit the topo information with the final so that can be done. 2. [Section 2.2.3 Open Space; 4.7 Open Space Requirements] Cluster developments (Lots less than 30,000sf) require a minimum of 25% open space. Not more than eighty percent of the open space can be located within the flood plain. Provide an exhibit that shows how much of the open space is outside of the areas defined in the ordinance. Rev: Not addressed. Exhibit needs to be provided with final, not just a tabulation. Limitation on ceptain elements. If open space is required by this chapter, not more than eighty (80) percent of the mininnun required open space shall consist of the followni 1g: (i) land located within the ane -hundred year flood plain: (ii) land subject to occasloml, common or fi-equent flooding as defined in Table 16 Soil and Water Features of the hated States Department of Agriculture Soil Conservation Service, Soil Survey of Albemarle County, Virginia, August, 1985; (iii) critical or preserved slopes; and (iv) land devoted to stonmuater management facilities or flood control devices, except where the facility or feature is incorporated into a permanent pond, lake or other water feature deemed by the agent to constitute a desirable open space anieluty. 3. [14-302(A)(3)] Show the deed book and page number under which the existing streets were recorded on the plat. Rev: Needs to be shown on final. 4. [14-302(A)(4)] A temporary turn -around was provided on this parcel for Phase One of the development. This turn around should be shown, and noted to be abandoned/removed. Rev: Needs to be shown on final. Final Plat Comments: 1. [14-303(G)] The zoning ordinance does not have a definition for "conserved open space". Revise to state "open space" only or "common open space", both with definitions in the zoning ordinance. Also, stated on the plat is this open space will be "public". Are you dedicating this to the County? If so, this will require Board of Supervisors approval. Deeds are required for the maintenance of all private open space. Common open space: An open tract or parcel of land not devoted to residential uses or structures but directly related and adjunct to a cluster development or planned development, as herein provided, and owned and, --or controlled by the residents of such development. See "Open Space"_ Open space: Land or voter left in undisturbed natural condition and unoccupied b -Y building lots, structures, streets, or parking lots except as otherwise specifically provided in section 4.7. 2. [14-317] Deeds are required for the maintenance of all easements outside of the right of way. Provide a deed for the open space, sidewalk and landscape easement, drainage easement, and any others outside of the right of way. 3. [14-303(D)] The Area summary chart on the cover sheet should subtract out the "residue" acreage so that the total is 17.699 acres and not 32.738 acres for TMP56-36.
