Wood, Jr. 79-9 0.50 Acres to be rezoned from RA to C-1 Pursuant to Section 33.3 of the Albemarle County Zoning ordinance, the owner, or its duly authorized agent, hereby voluntarily proffers the conditions listed below which shall be applied to the property, if rezoned. These conditions are proffered as a part of the requested rezoning and it is agreed that (1) the rezoning itself gives rise to the need. for the conditions; and (2) such conditions have a reasonable relation to the rezoning request. . . 1. Only storm water management facilities and septic drainfields shall be located on the property, which is that portion of Tax Map 79 Parcel 9 that is south of Route 250. The stormwater management facilities and septic drainfields shall serve only the following uses that may be established on the portion of Tax Map 79 Parcel 9 that is north of Route 250: Section 22.2.1 (a)(6)(food and grocery stores including such specialty shops as bakery, candy, and milk dispensary and wine and cheese shops); Section 22.2.1 (b)(16)(automobile service stations); and Section 22.2.1 (b)(19) (temporary constructions uses). These three classes of uses are allowed by right under Section 22.2.1 of the Zoning Ordinance of Albemarle County, Virginia (Chapter 18 of the Albemarle County Code), as that section is in effect on November 6, 2002. A copy of Section 22.2.1 is attached hereto. 2. The property shall not be divided, and shall not be divided from the portion of Tax Map 79 Parcel 9 that is north of Route 250.
