Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or its duly authorized agent, hereby
voluntarily proffers the conditions listed below which shall be applied to the property, if rezonèd. These conditions are
proffered as a part of the requested rezoning and it is agreed that: (1) the rezoning itself gives rise to the need for the
conditions; and (2) such conditions have a reasonable relation to the rezoning request.

Future development of the property shall be restricted by the Hickory Ridge Fann
Covenants and Bylaws included in the "Statement of Subdivision Hickory Ridge
Fann Section One and Section Two'"duly recorded in the Albemarle County Deed
Book 554, pages 43-58, dated June 10, 1974, and "Amendment to Statement of
Subdivision of Section One and Section Two" Hickory Ridge Fann duly
recorded in Albemarle County Deed Book 572, pages 95-105, dated April 22,
1975. The owner shall record said restrictions against the property within thirty
days of the date of Board approval of ZMAO 1-17, with the Clerk of the Circuit
Court of the County of Albemarle. The owner shall provide written evidence to
The Director of Planning of the recording within seven days following the
recording. The County of Albemarle shall not be responsible for enforcing any of
the aforementioned Covenants and Bylaws.

(2) No more than one residential dwelling shall be pennitted on the property. The
Property shall not be further divided.
