Dear Mr. Tahboub:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned C-1, Commercial ("C-1 "). The Property is subject to the Airport
Impact Area Overlay District, and the Steep Slopes Overlay District as described in
Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance").
• Per Section 22.2.2.6 and 18.2.2.9, assisted living facilities are allowed in the C-1 District
by Special Use Permit. On October 21, 1998 the use was approved by Special Use
Permit, SP199800043, by the Albemarle County Board of Supervisors.
• On July 3, 2002, SP200200018 was approved, to amend the conditions of
SP199800043 to increase the allowable number of beds from 60 to 90.
• On October 1, 2008, SP200800018 was approved, to amend the conditions of
SP200200018 to allow nonresidents to use the rehabilitation facility for physical therapy.
• The Property was originally developed as a 60 bed assisted living facility, with approval
of a site development plan, SDP200000012, approved May 19, 2000, revised
September 25, 2001 and November 19, 2003. The plan was amended by
SDP200100002, approved February 20, 2001, by SDP201500041, approved January 6,
2016, and by SDP201600027, approved May 1, 2017.
• This office has no record of an open violation for the Property.
• Copies of any applicable records may be obtained from this office with a request through
the department's Records Manager, Paul Bjornsen, at pbjornsen(aD-albemarle.org once
they have been approved or issued.
