THIS DEED OF EASEMENT dated as of this 2nd day of December, 2003, by and
between JA-ZAN, L.L.C., a Virginia limited liability company, the Grantor, and FERMIUM,
L.L.C., a Virginia limited liability company, its successors and assigns, hereinafter referred to as
Grantee whose address is 235 Terrell Road West, Charlottesville, Virginia 22901.
WITNESSETH:
That, for and in consideration of the sum of Ten Dollars cash in hand paid, and other
good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged,
the Grantor hereby GRANTS, BARGAINS, SELLS AND CONVEYS unto the Grantee, its
successors and assigns, a permanent non-exclusive storm drainage easement and a temporary
construction easement on that portion of Grantor's property designated as "Additional Proposed
Storm Drainage Easement" on a plat of B. Aubrey Huffman &Associates, Ltd., dated December
3, 2003, entitled "Proposed Drainage Easement and Temporary Construction Easement Situated
on Parcels 3 and 9 to Serve Parcel 10 Tax Map 46B4", a copy of which is attached hereto as
Exhibit A for reference purposes only.
The temporary construction easement is granted for the following purposes, at the
Grantee's expense: 1)replacing a section of the existing storm drainage pipe, located within the
within the existing 25' foot storm drainage easement, a portion of which is shown on the
attached plat, with a larger pipe to accommodate the additional volume of water that will be
drained from Grantee's property and 2) installing a new storm drainage pipe and connection
from the Grantee's property to the aforementioned replaced pipe.

Whenever it is necessary to excavate earth within any easement, the Grantee, as
evidenced by its signature, agrees to backfill such excavation in a proper and workmanlike
manner so as to restore surface conditions as nearly as practical to the same condition as prior to
the excavation, including the restoration of such paved surfaces along with any improvements
thereon as may be damaged or disturbed as a part of such excavation.
Ja-Zan Limited Partnership was converted, along with other entities, to Ja-Zan, L.L.C., as
noted in the Albemarle County, Virginia, Record or Partnership Book 15, page 322.

liability company, its successors and assigns, hereinafter referred to as Grantee whose address is
235 Terrell Road West, Charlottesville, Virginia 22901.
WITNESSETH:
That, for and in consideration of the sum of Ten Dollars cash in hand paid, and other
good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged,
the Grantor hereby GRANTS, BARGAINS, SELLS AND CONVEYS unto the Grantee, its
successors and assigns, a permanent storm drainage easement and a temporary construction
easement on Grantor's property as shown a plat of B. Aubrey Huffman& Associates, Ltd., dated
December 3, 2003, entitled"Proposed Drainage Easement and Temporary Construction
Easement Situated on Parcels 3 and 9 to Serve Parcel 10 Tax Map 46B4", a copy of which is
attached hereto as Exhibit A for reference purposes only.
The temporary construction easement is granted for the purpose of 1)constructing and
installing a paved parking lot and travelway that adjoins Grantor's parking lot and 2)installing a
new storm drainage pipe and connection from the Grantee's property to the existing 25' storm
drainage easement, both shown on Exhibit A.
Whenever it is necessary to excavate earth within any easement,the Grantee agrees, by
acceptance and recordation of this deed, to backfill such excavation in a proper and workmanlike
manner so as to restore surface conditions as nearly as practical to the same condition as prior to
the excavation, including the restoration of such paved surfaces along ' any improvements
thereon as may be damaged or disturbed as a part of such excavation
