Dear Mr. Gale:
The Albemarle County Board of Supervisors, at its meeting on April 15, 1998, approved the
above-noted request to rezone approximately 0.82 acres from C-I, Commercial to HC, Highway
Commercial. Please note that this approval is subject to acceptance of the applicant's proffers as
set out on the attached proffer form dated 4/09/98 and signed by Anthony D. Valente and Mary
Katheryn Valente.

Purauant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or
its duly authorized agent, hereby voluntarily proffers the conditlo~s listed below which shall
be applied to the property, if rezoned. The$~ conditions are proffered os a part of the
requested rezoning and it Is agreed that: (1) the re20nlng Itself gives rise to lhe need for
the conditions; and (2) such conditions have a reasonable relation to the rezoning ~
requested.
1. Tax Map 32 Parcel37A (the "parcel") shall have one entrance on Route 29 North (the
"entrance"). The entrance shall provide only ingress onto the parcel. The entrance
shall be designed to allow ingress only, and to serve also as the sole entrance from
Route 29 North for Tax Map 32 Parcel 41A. The design and location of the entrance
shall be subject to review and approval by the Virginia Department of Transportation
and the County.

2. The parcel shall be designed and developed to provide travelways that will COIUlect to,
and provide access to and from, Tax Map 32 Parcel 37AI and Tax Map 32 Parcel
41A. TIle design and location of the travelways shall be subject to review and ap-
proval by the County.
3. These proffers shall not be construed to require the closure of the entrance from Tax
Map 32 Parcel 4lA onto Route 29 North existing on March 3, 1998, or a travelway
connection between Tax Map 32 Parcels 37A and 41A, wItH such time as a site de-
velopment plan or a zoning map amendment for Tax Map 32 Parcel41A is approved.
