The Albemarle County Board of Supervisors, at its meeting on April 3, 1996, approved the
above-noted request to rezone approximately 19 acres from C-I, Commercial to HI, Heavy
Industry, with proffers. Please note that this approval is subject to revised proffers signed
February 12, 1996 (copy attached).

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or
its duly authorized agent, hereby voluntarily proffers the conditions listed below which shall
be applied to the property, if rezoned. These conditions are proffered as a part of the
requested rezoning and it is agreed that: (1) the rezoning itself gives rise to the need for
the conditions; and (2) such conditions have a reasonable relation to the rezoning
requested.
(1) Uses allowed shall be limited to the following, as shown in the
Albemarle County Zoning Ordinance in effect on 1/25/96:

Fire and rescue squad stations.

include chemical treatment of "softwoods," as defined by the
National dwood Lumber Association.
