Dear Mr. Pace:
The Albemarle County Board of Supervisors, at its meeting on June 7,1995, unanimously approved, the
above-noted request to change zoning on property described under CPA-94-04 from R-2 to CO with
two proffers as follows:
1.
The subject property will be developed in accord with the preliminary site plan dated
March 27,1995 (with revisions through May 8,1995). Minor changes may be
required as a result of final engineering and technical review by the County.

2. The applicant will design and construct at its expense (possibly shared with other
roperty owners, the Albemarle County Service Authority (ACSA), and other utility
suppliers) all improvements and upgrades of utilities which are occasioned by the
development of the property.
NOTE: Mr. Tucker recommended that staff work with the language suggested by Mr.
Bowerman during site plan review, to wit: At the time the pedestrian access to Fifth Street is
necessary, the applicant agrees to construct sidewalks. Mr. Pace said that he would have no
problem with that language if it is eventually found that the sidewalk is necessary for Jefferson
National Bank's operation.

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or
its duly authorized agent, hereby voluntarily proffers the conditions listed below which shall
be applied to the property, if rezoned. These conditions are proffered as a part of the
requested rezoning and it is agreed that: (1) the rezoning itself gives rise to the need for
the conditions; and (2) such conditions have a reasonable relation to the rezoning
requested.
