RE: ZMA-94-14 Highlands West Land Trust
Dear Mr. Craig:
The Albemarle County Board of Supervisors, at its meeting on March 15, 1995, approved the
above-noted request to rezone approximately 116 acres as shown on January 23, 1995 General
Development Plan. Please note that this approval is subject to the following proffers:
1. Owner will reserve a 110 foot strip of land in the approximate location shown on the Plan
as "Proposed Crozet Route 240/250 Connector," (the "Reserved Area") and will dedicate
the Reserved Area to public use without compensation at such time as the County of
Albemarle or the Virginia Department of Transportation (VDoT) has acquired the balance
of the right-of-way required to build the proposed Crozet Route 240/250 connector road
utilizing the Reserved Area. Reservation of the Reserved Area shall not be deemed to
prohibit owner, successors, and assigns from constructing a vehicular access at grade
across the Reserved Area sufficient to permit the full development and use of the adjacent
parcel labeled "INDUSTRIAL SERVICE" on the Plan. ReserVation of the Reserved Area
shall not be deemed to prohibit owner from constructing a two-lane road in the Reserved
Area in a manner which would not interfere with future construction of the connector
road, or making other temporary use of the Reserved Area not inconsistent with such
construction, as determined by VDoT and then-existing County ordinances. No residen-
tial driveways will access directly onto the 110 foot right-of-way.

2. Owner will construct a soccer field in the approximate location shown on the
Plan. Owner may provide recreational facilities in lieu of soccer field at owner's
option, subject to administrative approval of the County of Albemarle Planning
Department.
3. Owner will clean and repaint (interior and exterior, excluding attic) the existing
two-story residence building on the property, place all heating, electrical and
plumbing systems therein in good working order, trim shrubbery and clean up the
yard, and convey such building to the Homeowners Association for use as a
clubhouse, to be operated and maintained by the Homeowners Association. The
two-story house may be used as a sales center/clubhouse until all lots are sold.
4. Owner will reserve an average of a 50-foot wide greenbelt along each side of the
stream in the area identified as "GREENBELT" on the Plan, to the extent that the
greenbelt would be within the boundaries of the property. No buildings shall be I
constructed or erected within the greenbelt without the consent of Albemarle
County and it shall be preserved in its natural state except for the building of
pedestrian trails and general beautification including, but not limited to, the
clearing of underbrush, removal of dead trees and shrubs, planting of trees and
shrubs, cleanup of the stream and use for utilization for stream crossing for
pedestrian or vehicular access in accordance with VDoT standards to adjacent
properties. Owner does not proffer to maintain the greenbelt, and may convey the
greenbelt to the Homeowners Association subject to the reservation set forth
herein. The proffer shall not be interpreted to prohibit the location of utilities and
easements therefore in the greenbelt. The reservation of the greenbelt will provide
that at such time as the County of Albemarle commits to establish and maintain a
public area, park or pathway, and assumes responsibility for maintenance thereof,
the greenbelt area, upon request of Albemarle County, will be dedicated by owner
or its successors to the County, subject to the right of use for pedestrian trails by
residents living on the property and subject to the right to cross the greenbelt for
vehicular access and underground utilities and easements by owner or its
successors.
5. Development will be limited to a maximum of277 single-family attached and
detached dwelling units on the property. The attached and detached units will be
located approximately in the areas shown on the Plan.
6. Internal roads on the property will be located approximately as shown on the Plan.
Additional internal roads will be located pursuant to nonnal subdivision review.

The area between the display area and the Branchlands Boulevard right-of-way shall be

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner(s), or its duly authorized
agent, hereby voluntarily proffers the conditions listed below which shall be applied to the property, if
rezoned. These conditions are proffered as a part of the requested rezoning and it is agreed that (1) the
rezoning itself gives rise to the need for the conditions; and (2) such conditions have a reasonable
relation to the rezoning request.
Development of the parcels shall be in general accord with the application plan entitled "Western Ridge
Section 5C, Preliminary Plat (ZMA 2001-002 Application Plan) dated February 8,2001 and last revised
June 4, 2001.
1. No grading or removal of trees greater than six inches in diameter at six inches above the ground,
except for dead or diseased trees, shall occur on the critical slopes areas shown on the
Application Plan, except for grading and tree removal necessary for the construction of Lake Tree
Lane including water and sanitary sewer lines. This proffer shall ålso be set forth in the
covenants recorded for this subdivision. . .

A 5-foot wide pedestrian path consisting of 4 inches of 21-B stone base material and 2 inches of
SMA-2 asphalt shall be installed in the right-of-way for Lake Tree Lane on both sides of the road
along the frontage of all lots in Western Ridge Phase 5C and completed before release of the
perfonnance bone!. The tran shall be conveyed to and maintained by the Westem Ridge
Homeowner's Association.

A Class A or Class B tra~, as described in the Albemarle County Comprehensive Plan (see
attached pages), shall be constructed for pedestrian access to the future Lickinghole Creek
Greenway. If a Class A tra~ is used, it shall be a maximum of 5 feet wide and consist of 4 inches
of 21 B stone base material and 2 inches of SMA-2 asphalt. ff a Class 8 tran is used, it shall have
a graded width of 4 - 5 feet and have a surface of stone dust or other material approved by the
Director of Planning and Community Development The owner shall have the discretion to
choose a Class A or Class 8 trail. Boardwalks, rolling dips, and other devices approved by the
Director of Planning and Community Development shall be used, where necessary, to cross
swales, ravines, or environmentally sensitive areas, such as wetlands¡ as determined by the
Director of Planning and Community Development.
The trail shall be installed in the open space that abuts Phase 58 and Lots 17 & 18 as shown on
the Application Plan. If necessary to achieve walkabJe grades and prevent erosion and :
sedimentation, as determined by the Director of Planning and Community Development, changes
to the ooundaries of Lots 17 and 18 and the open space shall be made. The trail shall be shown
on and oonded with the first fU1al plat for Western Ridge Phase SC. The tran shall be completed
before release of the performance bonct The transhall be conveyed to and maintained by the
Western Ridge Homeowner's Association.
4. Recreational amenities for the development shall include use of the clubhouse, pool, and tennis
courts in the existing Westem Ridge development.
5. By not later than December 31, 2001, Keyes Development Company, Inc. shall provide to the
County an off-site improvement contribution of $5,000.00 for a proposed stoplight located at the
entrance to Western Ridge or the construction of a Route 240-250 Connector Road (to be
determined by the County). Should the stoplight or connector road not be installed within the
next 10 calendar years from the approved proffer date, it shall be refunded to Keyes
Development Company, Inc.
