The Albemarle County Board of Supervisors, at its meeting on September 21, 1994, approved
the above-noted request to rezone 12.08 acres from R-l, Residential and R-4, Residential to
R-IO, Residential. This approval is subject to the following proffers:
1.
Provide access from Tax Map 46, Parcel B3-01, to the west to align with access as shown
on the rezoning for Tax Map 32, Parcel29N (ZMA-91-08).
2.
Dedicate at the time of subdivision plat approval a thirty (30) foot strip across the State
Route 649 frontage for future road improvements by the Countý of Albemarle or Virginia
Department of Transportation.

Reserve for dedication up to nine (9) feet beyond the thirty foot dedication
aforementioned for construction of a bike path. The applicant will not be responsible for
the construction of the bike path.

4. Install a chain link fence approximatley four (4) feet in height along the applicants'
western boundary, or the eastern boundary of Tax Map 32, Parcel 29N2.

RE: Rezoning of Tax Map 46, Parcel B3-0 1, and Tax Map 32, Parcel 29F
Dear Mr. Cilimberg:
Forest Lakes Associates as the applicants proffers as part of the rezoning:
1) Provide access from Tax Map 46, Parcel B3-01, to the west to align with access
as shown on the rezoning for Tax Map 32, Parcel 29N.
2) Designate an area of a minimum of one (1) acre and a maximum of five (5)
acres for neighborhood service. The conditions and uses of the neighborhood service
will be as specified in Table 46, Page 161 of the Albemarle County Comprehensive
Plan. Access to the neighborhood service will be provided from Proffitt Road and
Timberwood Parkway, but no through access will be provided.
3) Dedicate a thirty (30) foot strip across the state Route 649 frontagè for future
road improvements, by the County of Albemarle or Virginia Department of
Transportation.
4) Reserve up to nine (9) feet beyond the thirty foot dedication aforementioned, for
construction of a bike path. The applicant will not be responsible for the construction
of the bike path. .
5) Number of residential units not to exceed 65.
