The following is a list of actions taken by the Board of Supervisors at its
meeting on September 13, 1995:

Mr. John Horneff came forward to speak about the request from the
Batesville Ruritan Club. He noted the many problems which have occurred at the
site of the stony Point Ruritan Club which is adjacent to his property. He
suggested that the Board ask many questions about this organization before giving
approval to the request.
Mr. Bob Watson from the Blue Ridge Homebuilders Association came forward
to note that the Planning Commission has almost completed its work on the land
use portion of the Comprehensive Plan. He handed to the Board a statement from
the Homebuilders giving their opinion of the plan prior to its coming to the
Board.
Several people came forward to speak about Route 614 (Sugar Hollow Road)
and to request that the road be paved while the Highway Department is working in
the area. (I did not get the petition mentioned by Buzz Smith. ) About 40
people were present in support of this idea. After discussion, Mrs. Thomas
offered a motion, to-wit:
MOVE that the Board give the following directions: work on Route 614 up
to the Sugar Hollow Dam on the Moormans River will proceed only with full
respect for the scenic designation of the river; practically this will
involve getting prior approval for earth, bank, waterway and water-
disturbing activities now and in the future; approval shall be given by
Albemarle County's Water Resources Manager after consultation with anyone
he deems necessary to consult with (basically, it could be with the

Moormans River Scenic Advisory Board or its designee, the Soil and Water
Conservation, Game and inland Fisheries, Department of Conservation and
Recreation) .
Mrs. Thomas said this process is not new. It is in essence what any
private firm would have to do, and it is a good deal less than what VDOT, if it
were not acting under the heading of an emergency, had promised it would do in
a 1991 Memorandum of Agreement for the review of highway projects. This motion
does not say whether the road will be paved. That should follow the process that
VDOT has established which is essentially that the road will be paved, but there
are questions about the tree canopy. This would require that there be a plan so
that people know what is happening and will not be taken by surprise by, for
instance, a backhoe found in the middle of the stream. Also, it establishes for
the future that VDOT does not own the river and cannot act unilaterally in that
river. There will be other high water events and the channels will lead the
river to wipe out parts of the road in all likelihood. VDOT should have a
process and know what that process is in order to proceed to make those repairs.
This motion sets up a process.
After quite a lengthy discussion, the motion passed 6-0.
The second part of this conversation concerned whether the road could, and
would, be paved (hard-surfaced).
Angela Tucker stated her understanding of what is to be done: VDOT will
proceed with paving the road from Route 674 to the dam and will do so giving
every due consideration to the scenic river, and will work with every agency that
is willing to offer an opinion as to how best to do that, and it will be done in
coordination with David Hirschman (Water Resources Manager). Ms. Tucker will
contact him tomorrow and meet on site to make plans to do some more road work
because there are places where a wider pavement must be fit in. If for whatever
reason, these agencies advise that it is harmful to the river to get this width
of pavement, then that may put a stop to the paving of this section of road. She
does not anticipate that happening, but there is some grading that needs to
occur, particularly in the area of Puppy Run Farm where there is a need to get
18 feet of pavement in order to provide two lane widths, and there is consider-
ation of the tree canopy there that has to occur, and if the professional opinion
is that that does harm to the scenic river, then that can put a stop to paving
this piece of roadway.
This part of the discussion was left with this statement as the Board's
consensus.

Approved with the seven conditions recommended by the Planning Commission, adding
word "outdoor" to Condition #7.
1) Use shall not commence until such time as approval has been obtained
from the Health Department and the Building Official;
2) Use shall not commence until such time as the parking area has been
improved in accord with the provisions of Section 4.12.6.3 of the
Zoning Ordinance;
3) Use shall not commence until such time as the zoning Administrator
has determined that adequate parking exists;
4) Use is limited to a twenty-five (25) seat restaurant and four (4)
rooms for overnight travellers;
5) Structure is to be restored and maintained in the architectural
character of the period, in accordance with the guidelines estab-
lished by the National Register of Historic Places;
6) All signage is to be of a design appropriate to the architecture of
the building;
7) Outdoor wedding receptions or similar functions may be allowed
subject to approval and conditions established by the Zoning
Administrator. No amplified sound will be allowed.

resolution ratifying the filing of an application to the Virginia Public School
Authority for a loan in an approximate amount of $7,850,000. Originals will be

Some Albemarle County residents favor a no-growth policy. Some mvor moderate
expansion. and others plea for a no-holds-barred approach. All of these views are understandable
but somewhat irrelevant Albemarle County has many attractive quality-of.life factors that
influence in-migration.
GROWTH AREA EXPANSION
The current staff report projects a population increase of about 20,000 people over the
next 20 years Ol"'arate of 1.3% annually. Many publications rate the Charlottesville area very high-
in surveys indiC3!ing desirable places to live.
The recent (1992) Albemarle County Housing Advisory Committee Report stated.
"Virginia and the Albemarle Community anticipate considerable population growth in the coming
years. Heightened demand will make housing increasingly important to the County's growth
mlmRgt'!"'ent policy and as a quality of life factor for all households and bmrinesses. The County
must aggressively plan for directing the projected growth. Bv law and custom. a localitv can
neither control nor stan l!I'owth. ..
Residential development, in and of itself: does not generate growth. That is a product of
desirability, economic activity, and in-migration. AddinlZ acres to the l!I'owth areas does not cause
IlI'Owth.
It is the County's current policy, one supported by a vast majority ofre.<ri~, to' channel
growth into the growth areas and protect the rural areas from urban sprawl.
The issue thus becomes one of proper plannlng by elected and appointed officials for the
projected growth that will occur and providing the necessary nwnber of acres for residential and
commercial expansion contiguous to existing growth areas and infrastructure. Planning for

The Housing Report also states in Strategy 0-1, "Increase the amount of available land
area within the growth areas to 8CC-^"'""'odate future growth. Calculations of thc carrying capacity
of growth areas should include a trend analysis of the amount of vacant land for sale and den!lli1'ies
within existing development. and consideration of the fact that limited buildable land area often
leads to higher prices.. ..
About 70% of the total aaeage in Albemarle County, and. 42% of the laud in the p1'CSal1
growth areas, is in the land use taxation program. If the supply of land in the growth areas is
inadequate, then pressures on rural landowners will create an incentive to sell their land and
contribute to development in the rural areas.
The Pfannmg COmm1~on. thus far, has rejected a tbree-time df!mlmn s1:IIff
recommendation to address the lack of land reasonably available for devclopmem. This would
have established a higher iIIYentmy and created a less constrained mmket where developmeol
options are not limited. to a re.lativc1y small number of sites. Adequate acreage for growth will.
help keep prices down and COD1:r:ibutc to more affordable housing at all levels.

Why change? Why not support the very factors that caused this positive trend? We urge
you to consider adding acreage to the residential growth areas that is cnn!ri~eDt wi1h the original

Dear Walter,
The Moormans Scenic River Advisory Board is grateful for the careful attention the Board
of Supervisors has given to the current highway construction activities in Sugar Hollow,
since the VDOT project affects the Moormans River. We are heartened that the
Supervisors value as we do one of the County's unique places, important to both county
and city residents as a scenic and recreational area as well as a source of public drinking
water.
In particular, we applaud the Supervisors' decision to demand a pause in VDOT's road
building, during which the impact of the recently completed and proposed construction can
be assessed and guidelines proposed for VDOT's completion of the work in Sugar Hollow.
As you know, our Advisory Board is constituted under Virginia's Scenic Rivers Act to assist
and advise the Department of Conservation and "the administering agency" regarding the
protection of the Moormans River. For the Moormans, the statute (Code of Virginia 10.1-
413.1) designates Albemarle County as that administering agency. The administering
agency is empowered (Va. Code 10.1-405.) to "administer the scenic river or section thereof
to preserve and protect its natural beauty and to assure its use and enjoyment for its scenic,
recreational... [ and other]... uses. "
The Advisory Board is particularly empowered (Va. Code 10.1-406) to comment on any
federal, state, or local governmental plans which would alter the natural or scenic character
of the river. In short, one of our main aims is to assist the Supervisors in protecting the
Moormans.

In this regard, if the county wishes, the Moormans Scenic River Advisory Board would be
prepared -- during the current pause in VDOT's Sugar Hollow activities -- to convene a
meeting (or series of meetings) to examine the situation, or to help you do so.
Among the possible questions to be raised during this pause in VDOT's work, two sets of
issues are of special priority for our Advisory Board:
What will be the effect of recently completed stream channelization, which changes
the size and shape of the riverbed? If there are likely to be deleterious effects, how
can the problem areas be corrected at a reasonable cost?
In the design and re-construction of the road, how can a balance can be found
between, on the one hand, specifications that meet necessary standards for safety
and future maintenance, and, on the other, specifications that sustain the magic
atmosphere that makes Sugar Hollow unique and preserves the river's ecology?
Optimal width, the need for paving, additional trees to be cut down, raising or
lowering the grade, type of guard rails, selection of grasses for re-seeding banks -- all
should be discussed.
Attached is a list of some of the persons whose advise on these issues would be usefuL
Let me conclude by emphasizing our gratitude for the Highway Department's prompt
restoration of the public road after the flood in Sugar Hollow, and Angela Tucker's
acceptance of requests to meet and talk with this Board and local residents. This, and
VDOT's immediate willingness to pause in its work schedule, fosters a spirit of compromise
between sometimes competing values of highway safety and protection of scenic and natural
resources.
Please let me know if our Advisory Board can be of any help in organizing the proposed
meeting( s).

Please receive this communication and either read it or enter it into the record of the
meeting of September 13th. I regret I am not able to be present since I am chairing another
important meeting at the same hour.
Since the devastating flood of June 1995 my concern has been the safety of the
residents of Sugar Hollow and the thoughtful preservation of a rural scenic treasure of a
place. I spoke out against paving but always felt if the majority of the residents wanted it,
then it should be done and done well.... i. e., kept to its original character and size. All
concerned know that this has not been done. Undoubtedly the highway that has been
constructed must probably be stabilized now by being paved. A road the size of "250" is
ludicrous and a shameful expenditure of tax dollars.
I implore the Board, residents and all concerned citizens to clean up the debris,
refrain from cutting more live trees, replant and restore.
Healing also needs to take place between neighbors and in our community. Always,
we have helped and supported one another in times of trouble and trial. The situation with
the reservoir and dam has not been resolved. Important issues face us, and we need to be
able to talk to one another, to think together, to plan.
The magnificent sycamore at the end of Buxton's driveway is a perfect metaphor for
Sugar Hollow today.
I pray we can all come together and work for the greatest good.

I am wri~;ng to express my concerns about the work being done
on Sugar Hollow Road. My husband and I have been res1dent~ of
Sugar Hollow since January of 1980.
As you know, Sugar Hollow is a special area of the County,
c.:umbining natural, undeveloped beauty with recreational resources
such as hiking and trout fishing enjoyed by many county residents.
It is also a fragile ecosystem, and the Moormans River is desig-
nated a It scenic II river to protect both its sceI1l~ value and its
ecology. Last June's flood was devastating, but the river remained
beautiful despite th~ devaatation.
The Departmp.n~ of Transportation and Parham Construction did
an amazinq job of constructing a passable road that allowed all u!
the trapped residents to get out after the flood, and, had they
stopped work after repairiny the road to itg condition pri or to the
flood I have no doubt that the area would be well on its way to
l:'ecovery.
However, instead of stopping work when the road was repaired,
they have continued work, widening the l.oad, building up ugly
protective rock barriers, digging rock out of the river, building
area~ (or parking their heavy equipmAnt out into the river for the
purpose of removing rock, and turning a natural disaster into
something much worse. By doing so r they have changed a scenic
river into something that strongly resembles a seWi:iye drainage
ditch. I have heard that it is doubtful that the river can now be
stocked with trout bec~u~e of the damage, ther@forp. eliminating a
source of recreation and pleasure for many people who visit the
area..
I understand that the Board of supervisors had requested that

however, tnA~ the Richmond VDOT office has directed that all roads
damaged by the June floods be paved, and that VDOT is going ahead
with that goal despite what the Board of Supervisors has requested.
I have also heard that tne county ~ngineering oepartmf:mL. h...s met
w1th VDOT a.nd L.h,= \.,;U1Ufl.", u.~t.;.ion r;;;:I.-CW'" deveral t.imcc Qnd given them
dircctiong regarding what could or could nnr. be done to the river,
and that vnOT has agreed with those directions, then immediately
disregarded them. Finally, I have heard that VDOT intends to pave
the road whether or not it obtains the 50' rights-of-way that they
requested every landowner to donate in order to pave the LUdd.
I freely ~dmit that much of the above i~ np.~rAay, as rumors
have been ram!l"nr. and no one seems to have a complete story.
However, if any of the above is true, I ca.nnot help but. be
concerned. First, what say, ir any, doee local government have in
ma.king decisions concerning its roadways? Can Lhe State disregard
a local governllll~uL' s requeet? Second, under what authority dop.s
VDOT have to get around the scenic river d~Rignation and make such
a mess? C~n vno~ be made to clean it up? Third, if VOOT does not
need the 50' rights-of -way to pave the road, did it dupe the
landowners who want the road paved into giving up control over a.
portion of their propert.y unnecessarily?
In addition to t.he aboV'e questions, tnA,..p. are other issues,
such as saf~~y, development, etc. If the road is paved, will there
be increased traffic, higher speeds and the possibility of more
accidents? (During my residency in the Hollow, there have been tw~
fatal accidents, both occuring on the pav~u section of the ro~d.)
On the other hi;WU, would paving the rotld m3.ke it more safe? Tf the
road ie paved, will that lead to rQsidp.nt;~l developments in the
Hollow? How wr'llllrl that impact the environment?
It would be nice to have a car that is not dusty, but not QL
the price of decreased safety, a damaged euvlLonment and incrc~oed
cievelopm~uL L;ha.nging the face of the Hollow irreparably ~nd making
it an ~natt.ractive place for re8inp.nts and visitors. I feel that
VDOT i~ forging ahead with this project without any concern for
these issues, and I ask that, before the road is paved studies be
prepared addressing safety, the environment, and proj ectiny llow the
road will attect future deve1opmenL. I have no moral position
again~L ~~vlng the road, but I do have one against m~k;ng decisions
without having all of the np.r.~Asary information.

BACKGROUND:
The subcommittee fonned by the Board of Supervisors and the School Board to manage the pay, classification, and performance
evaluation review has developed their "short list" to begin negotiations to engage a consultant to perform the necessary evaluation.
The firm of Hendricks and Associates has been ranked as the number one proposer at this stage of the negotiations and will be
meeting with county staff to negotiate a [mal price for the work to be done. The staff's earlier estimate of $50,000 to complete
this study seems adequate at this point in the negotiations and in order to engage the services of the consultant, an appropriation
needs to be in place and the funds available.
DISCUSSION:
Once the consultant is engaged, the next step will be for the consultant to meet with members of the Board of Supervisors as well
as the School Board to determine their concerns and to assure clarity of the scope of this project. Further, focus groups will be
fonned from various employee groups to identify issues that need to be addressed and to make sure that the employees are a part
of the process of revamping for simplicity our entire compensation and reward system. The subcommittee intends to provide
regular updates to both Boards as they work through this project and would be happy to answer any questions should they arise.
RECOMMENDATION:
Staff recommends that the Board approve Appropriation #95024 to place the funds in the Human Resources budget for consulting

adversely affected by the salary scale revision.
DISCTTSSION:
During the School Board's annual retreat, the Board agreed to pay teachers who were adversely affected by the salary scale revision (step
3, 9, and 12) a one-time payment of 33% of the difference between the FY 94-95 and the FY 95-96 scale. The payment for a full time
teacher on step 3 is $197 in salary, on step 9 is $231 in salary, am on step 12 is $367 in salary. The total cost of implementing this payment
is $26,469.54 including FICA. The paymed will be made to the affected teachers in the December 1995 payroll. This transfer will be made
from the School Board Reserve Account.

Several months ago I had the pleasure of meeting with Mr.
Olinger and Mr. Jenkins at the Forestry Office to discuss our
club's interest in using a portion of the old State shed property
ln Batesville as a public recreation site. I explained our
commitment to building tennis courts, a picnic area and a
childrens' play area, all hopefully on the western half of the
Forestry property in Batesville. I also mentioned how the Forestry
Dept. ' s use of the property as a parking lot for old surplus
vehicles really did not blend in with the residential nature of our
area. Both gentlemen were extremely pleasant and explained how the
Forestry Department acts as an agent for the Federal Government to
channel surplus vehicles to volunteer rescue squads and fire
departments. throughout the State. I also learned that the
Batesville storage lot is the only one the Forestry Dept. has and
that if an area closer to Charlottesville could be found, they
would certainly be receptive to vacating a portion of the lot for
use as a public recreation area.
My purpose in writing is to hopefully speed up the process
by sending you the attached resolution from our Club stating our
seriousness about the project and our desire to bring it to
fruition. A major hurdle will be to free up the Forestry property.
Our club is asking for yours and others help in this process.
If I can answer any questions about our project please feel
free to call me at 823-7330. Perhaps a meeting at the site would be
beneficial. I look forward to hearing from you.

WHEREAS, the Batesville Ruritan Club is a service organization
dedicated to the well being of the Batesville Community, and
WHEREAS, public recreational facilities for the Batesville
Community are limited, and
WHEREAS, the Batesville Ruritan Club perceives the need for a
public family recreation area In Batesville, and
WHEREAS, such an area should include tennis courts, a plcnlC area,
and a childrens' play area, and
WHEREAS, the Batesville Ruritan Club has the financial and human
resources to undertake such a project, and
WHEREAS, the most suitable site for such a recreational site is the
"old State shed" on the Miller School Road [St. RT. 635], and
WHEREAS, the State Forestry Office currently uses this site as an
equipment and Federal surplus vehicle storage site, and
WHEREAS, such usage is incompatible with the residential nature of
the area in Batesville adjacent to the site, and
WHEREAS, such a recreation site would occupy only the western half
of the State shed property, then
BE IT RESOLVED that the Batesville Ruritan Club respectfully
request the V~rginia State Department of Forestry to lease part of
the old State shed property to the Batesville Ruritans for use as
a public recreation facility open to all, and
BE IT FURTHER RESOLVED that copies of this resolution be sent to
the Albemarle County Board of Supervisors and to Governor Allen to
