October 24, 1988 Tim Michel McLean, Faulconer 503 Faulconer Drive Charlottesville, VA 22901 RE: ZMA-88-14 Tim Michel Dear Mr. Michel: At their meeting on October 19, 1988, the Albemarle County Board of Supervisors approved your .request to rezone approximately two acres from VR to C-l. Property on-the north side of U. S. Route 250 a roximate1 500 feet west of its intersection with State Route 678 at Ivy. Tax Map 58, Parcel 84A. Samuel Miller A~~'I~';' Magisterial District with proffers of September 27, 1988 ~,j' (clarified to the end of the second sentence to read): "... ~;:.......~~, intersection of Route 250 West and the realigned Route 678, provided..."; and the letter of October 19, 1988,_ (clarified in the second sentence to read: "...proffer the deletion eft of the following uses by right ..." The two proffers (copies attached) now read: 1. Direct access to a public road to be limited to the realigned Route 678, with such access to be no closer than 125 feet from the proposed intersection of Route 250 West and the realigned Route 678, provided an entrance can be achieved at that location. 2. The C-1 uses by-right listed below are hereby deleted: a. I am prepared to donate area "C" to the County of Albemarle upon construction of the new Route 678 or at the demand of the County in anticipation of such near term construction. In addition to the proffers of~ered in my letter of September 27, 1988, Ivy Commons Partnership is also willing to proffer the deletion of the following uses by right and by special use permit. C-l uses by-right: 1. Funeral Home 2. Laundromat 3. Tailor/Seamstress 4. Clubs, Lodges, Civic, Fraternal and Patriotic 5. Clothing Apparel and Shoe Shops 6. Visual and Audio Appliances 7. Fire & Rescue Squad Stations 8. Photographic Goods 9. Sporting Goods C-l uses by special use permit ~. 1. Hospitals 2. Fast Food Restaurants 3. Electrical power substations, transmission lines and related towers; gas or oil transmission lines, pumping stations and appurtenances; unmanned telephone exchange centers; micro-wave and radio-wave transmission and relay towers, substations and appurtenances. 4. Commercial recreational establishments. Lastly, I further agree to restrict the maximum size of individual uses as follows: Individual commercial uses shall not exceed 3000 square feet per' individual use. Commercial recreational establishments The reason special permit uses were not addressed in the initial permit is because they would require separate permit approval.
