Dear Mr. Cushman:
This is to advise you t.hat the Albemarle County Board of SuperJ"isors at its
meeting June 20, J.979, approved your request to rezone 157.41 acres from A-I
ton RPN/A-l ( Cotmty Tax Map 58, portions of parcels 81 and 8lV ) sFbj~ct to
the following conditions:

1.
Approval is for a maximum of 60 lots. Location and acreages of land uses
shall comply with the approw:d plan. In the final subdivision process, open
space shall be dedicated in accordance with the number of lots approved;
No grading shall occur w1til final subdivision approval;
Compliance with Soil Erosion and Runoff Control Ordinances;
County Attorney approval of HomeO'.·;ners I Agreements prior to final appro~7al to
include the use of open space for septic field, if necessary, and for private
road maintenance agreements;
Health Department approval of two septic field locations on each lot. No septic
field shall be sited on any slopes of 25% or greater;
Fire Official approval of hydrant locations, prior to final subdivision approval;
Only Lot 7.5 shall have access on the old road shown on the plan and Lot 25 shall have
access on said old road only until such time as the new road as shown on the plan,
is constructed to serve Lot 25. Upon completion of the new road fronting on Lot 25,
use of the old road is to be discontinued and its right-of-way shall be extingui~hed
and abandoned of record. This condition shall be enforceab18 by 1:h0 County of
Albemarle or by the o'rJner or owners of any lot or lots over whL.:h t.he right-of-Vl2Y

Only those areas where a structure, utilities, road or other fe'tture approvéà in
a final ];:lan are to be located, shall be disturbed; all other land shall remain
in its natural state;
All units shall be served by a public water su~ply system and approved by appro?riate
agencies prior to final subdivision plat appr()val¡
County Engineer and Virginia Department of Higr.ways and Transportation approval of
road plans;
Lot #1 to enter onto interior road.
