The Declaration should reference the Feb plat date and the revision date of June 20th, 2017...the same way it
was done on the private street maintenance agreement. "...dated February 16, 2017, last revised June 20,
2017"

however, prior to my approving it I need the legal docs updated and then have them signed/notarized by all
owners. Attached is the County Attorney approval of the legal docs. Please assure you or your legal advisor
edits the approved docs by omitting the lined through items, change the font color of all the text to
black. Additionally, the date on the documents references the "last revised date as May 4th"; however, that is
not the last date on the plat, it is truly June 20,2017,this also needs to be corrected.
Please assure the above edits are made and then signed/notarized by all. Then submit these documents to me for
approval of the plat.

The revised plat addresses all my platting comments including VDOT and Health Dept approval. With the
resubmittal you also provided two legal docs which need County Attorney review/approval. I'm sending them
to him today for review. Typically it takes 2 weeks to get a response/approval from that office. The plat cannot
be approved till those legal docs are review/approved by the County Attorney. So now we wait.

The County of Albemarle Division of Current Development will grant or recommend approval of the
Family Subdivision plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances
unless otherwise specified.]
[14-403] Frontage. Frontage is required for all lots. Currently the residue of TMP 110-15A is left
without frontage. The existing 20' and 30' ingress and egress easements does not constitute a
private street approved by the County, which would have provided frontage. In order to rectify
this situation and provide the required frontage please dimension, label, and depict a new "private
street easement" to serve the lot(s) from State Route 631. Also, the easement holder(s) shall be
identified on the plat. This new easement may be platted over the existing ingress and egress
easements. Revise.
2. [14-317] Instrument evidencing maintenance of certain improvements. Provide a new/updated
private street maintenance agreement for the proposed private street. A template for this
agreement is attached. County Attorney approval is required prior to final plat approval.
3. [14-303(N), 14-412(A)(4)] Statement pertaining to private streets. Provide the following notes
on the plat: "The streets in this subdivision may not meet the standards for acceptance into the
secondary system of state highways and will not be maintained by the Virginia Department of
Transportation or the County of Albemarle. " and "The existing and/or proposed right-of-way is
of adequate width and horizontal and vertical alignment to accommodate a travelway passable
by ordinary passenger vehicles in all but temporary extreme weather conditions, together with
area adequate for maintenance of the travelway, as required by section 14-412 of the Albemarle
County Code. "
4. [14-212(B)] Family subdivisions; conditions of approval. The subdivider shall place a restrictive
covenant on the lots created by the family subdivision. A template for this covenant is attached.
Please submit a draft of the restrictive covenant to me and I will review it and forward it to the
County Attorney for his review/ approval.
[14-302(B)8, 18-10.4] Setbacks. The front setback depicted on sheet 2 is slightly incorrect and
shall be revised to also provide a 75' setback from State Route 631. Additionally, the rear setback
listed on the plat is truly a side setback. Based on the shape of this lot it does not appear to have a
rear; rather, it will have two sides. Rural Area (RA) setbacks applicable to this division are as
follows:
Front (existing public roads (State Route 631)) 75'
Front (internal private roads) — 25'
Side — 25'
Rear — 35'
6. [14-302(A)(9)] Building sites on proposed lots. Edit and provide the following note on the plat:
"Parcel [letter or number] and the residue of Tax Map/Parcel [numbers] each contain a
building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. "
