The Board is not supportive of deferring the request indefinitely and requested that the applicant be notified that he should withdraw the application and refile it when he is ready to proceed with the request. Phillip Ryder. Public Hearing on a request to construct an above grade parking structure on 2.04 ac zoned C-1 & EC on E sd of Rt 29 approx 500 ft S of Woodbrook Rd. TM45,P104A. Charlottesville Dist. APPROVED SP-94-38 subject to the following conditions recommended by the Planning Commission: 1. The parking structure shall be limited in area and to two levels, ground and upper, as shown on a plan titled Floor Fashions/Grand Piano, as amended by Sheeran Architects, and initialled WDF, 1/11/95. All landscaping shall be retained or replaced should it die; 2. A solid opaque wall not less than 3.5 feet in height shall be provided around the northern and eastern sides of the parking structure, upper and lower levels. Such wall shall be designed to block headlights from the adjacent residential uses; 3. Structure shall be signed to prevent unauthorized use. Agenda Item No. 13. Economic Development Policy. Public Hearing to take comments from the public on goals, objectives and strategies for economic development which will replace the existing economic development section of the County's Comprehensive Plan. The Board asked Mr. Cilimberg to look into a couple of wording changes. Some one from the public thought the Planning Commission had made changes in the final version of the Economic Development Policy that they did not see reflected in the version that was sent to the Board. Both of those changes were under Objective 4; one was in the wording of the objective and the other was in the wording of Strategy 1. Mr. Cilimberg is to incorporate any changes in the language that might not have been picked up and bring back to the March 1 meeting. Public Hearing to take comments on a Public-Private Regional Economic Development Partnership. No action; to be discussed further on March 1. Agenda Item No. 15. Other Matters Not Listed on the Agenda from the BOARD. Mr. Tucker referred to the Board meeting of January 18 where a County employee had asked that the Board consider subsidizing a day care center for County employees. Mr. Tucker said it is his opinion that this is not something the County should get involved in or should subsidize. The liability, cost and other issues involved, not only regarding the children, but in trying to limit use to County employees and their children only, would be difficult. Memo To: Robert W. Huff, II Roxanne White Jo Higgins Amelia McCulley Bruce Woodzell Larry Davis File ALBEMARLE COUNTY Project 1666-002-250, M501 Industrial Access North Fork Business Park TIllS AGREEMENT, made the J~'IÍI day of February, 1995, by and between UNIVERSITY REAL ESTATE FOUNDATION, hereinafter referred to as the DEVELOPER, party of the fIrst, and the COUNTY OF ALBEMARLE, a political subdivision of the Commonwealth of Virginia, hereinafter referred to as the COUNTY, party of the second; and THAT WHEREAS, the COUNTY, by appropriate resolution requested Industrial Access Funds to assist in providing suitable ,access to the North Fork Business Park, located off Route 606 in Albemarle County; and WHEREAS, the Commonwealth Transportation Board has, subject to certain contingencies, allocated an amount not to exceed $200,000 from the Industrial Access Fund to assist in providing access to the previously mentioned facility, such being designated as Project 1666-002-250, M501; and WHEREAS, the COUNTY acknowledged and agreed to the contingencies of this allocation, the DEVELOPER acknowledges and agrees to the contingencies of this allocation, as set forth in the February 16, 1995 resolution of the Commonwealth Transportation Board, which is made a part of this agreement by reference. WHEREAS, the parties hereto mutually desire to contribute towards the construction of the access road; and 1 WHEREAS, the DEVELOPER desires to administer the project's construction through its capabilities and/or those of its agents. NOW, THEREFORE, Witness, that for and in consideration of the premises and mutual covenants and agreements contained herein, the parties hereto agree as follows: A. The DEVELOPER will: 1. Acquire the necessary right of way and any required slope or drainage easements for this project at no cost to the COUNTY. Perform, or have performed, all environmental assessments, and, should these assessments require any form of mitigation as a condition of the project's construction on the proposed right of way, provide said mitigation at no cost to the COUNTY. 2. Prepare any required environmental documents and secure all necessary local, state, and federal permits required for the proposed construction at no cost to the COUNTY. 3. Cause any utilities in conflict with the construction of this project to be adjusted, including the cost of any installations and related engineering, at no cost to the COUNTY. 4. Design and prepare plans for Project 1666-002-250, M501, described as the construction of a new road from Route 606 to 1500 feet east of Route 606, for the purpose of providing suitable access to development bays B8, B9, and F2 of the North Fork Business Park. This design shall be in accordance with the geometric standards of the VIRGINIA DEPARTMENT OF TRANSPORTATION, hereinafter referred to as the DEPARTMENT, and shall include a pavement width of not less than 24 feet within an unrestricted right of way width of not less than 60 feet. The plans shall specifically designate each contract item as either eligible or ineligible for Industrial Access Funds. 2 ~ I Design and plan preparation costs are not eligible for reimbursement. 5. Provide the COUNTY with an appropriate bond or other acceptable surety device, not to exceed $200,000, before February 15, 1995 and terrIÙnating on or after March 16, 1998. Such surety device shall provide for reimbursement to the COUNTY of any expenses incurred by the Industrial Access Fund in this project's construction not justified by eligible industrial capital outlay by eligible industry or industries served exclusively by the project as of February 16, 1998. Pursuant to contingency 2(d) of the Commonwealth Transportation Board's resolution of February 16, 1995, eligibility of the industry or industries, the amount of eligible industrial capital outlay, and the extent of the project's eligibility for Industrial Access Funds shall be as deterrIÙned by the DEPARTMENT. The. basis for this deterrIÙnation shall be the application of the DEPARTMENT's policy and its usual practices for adnúnistering the Industrial Access Fund, based on documentary evidence submitted by the DEVELOPER. The amount of the surety device shall be determined by the COUNTY. Reimbursement, if required, shall be made prior to termination of the surety device, upon demand. This surety device may be released at an earlier date subject to the COUNTY'S and DEPARTMENT'S receipt of suitable documentation that the location and eligible capital outlay, of qualified industrial development in operation along said project, warrants the industrial access funds expended on this project's construction. 6. The surety amount may be reduced to the actual amount recieved from the DEPARTMENT as reimbursement to the DEVELOPER. 7. Agree to construct or have its agents construct the project in accordance with the approved plans. 8. Assure that all items of work and materials used in construction comply with applicable DEPARTMENT specifications. 3 9. Provide necessary inspection/construction engineering services as required to assure that the project's construction is performed in accordance with the approved plans and specifications. 10. Administer the project by letting it to contract in accordance with the Public Procurement Act, provided however, that no contractor who is currently disqualified from bidding on contracts with the DEPARTMENT, for any reason, may participate as a prime contractor, subcontractor, or supplier in any portion of the project's construction. 11. Make this project available to inspection by COUNTY and DEPARTMENT personnel during its construction and obtain the COUNTY'S and DEPARTMENT's concurrence prior to project acceptance. 12. Maintain accurate records of all project costs in a form satisfactory to the COUNTY and DEPARTMENT and make such records available for audit by the COUNTY and DEPARTMENT upon request. 13. Request payment from the COUNTY for the actual cost of the project's eligible items, to the extent herein provided, upon project acceptance. 14. Bear all cost of this project, including cost in excess of $200,000, regardless of eligibility . 15. Ensure that the location, form, and character of all traffic control devices and markings installed or placed by any public authority or other agency shall be subjected to the approval of the DEPARTMENT. 16. Upon notification that asphalt paving is complete, DEVELOPER is to install guardrail and complete any other work necessary within 60 days. 4 B. The COUNTY will: 1. Review the plans, cost estimate, and specifications for Project 1666-002-250, M501, as presented by the DEVELOPER and approve them with whatever modifications, if any, it deems appropriate. 2. Authorize expenditure of the Industrial Access Fund allocation in accordance with and subject to the limitations and contingencies of the Commonwealth Transportation Board's resolution of February 16, 1995, for the cost of the project's eligible items and related construction engineering activities. 3. Make final inspection with the DEPARTMENT and DEVELOPER upon completion of the project's construction and, if appropriate, concur in its acceptance. 4. After acceptance and .receipt of appropriate billing from the DEVELOPER, the COUNTY will forward the documents to the DEPARTMENT to secure reimbursement for actual eligible costs incurred subsequent to the approval of the project's allocation by the Commonwealth Transportation Board. This reimbursement should occur within 30 days of the DEPARTMENT's receipt per the CountyNDOT Agreement. Such reimbursement shall be subject to the limitations prescribed by the Commonwealth Transportation Board's resolution of February 16, 1995, and in no case shall the total reimbursement by the DEVELOPER exceed $200,000. 5 IN WITNESS WHEREOF, the parties of this agreement have hereunto affixed their signatures, University Real Estate Foundation on the _ day of February, 1995, and the County of Albemarle on the ~ day of February, 1995. Please extend my thanks and the thanks of all of us who live south of you on 29 to the Supervisors for their action in support of this visitors' center. In these days when it is easy for some communities to be "territorial" in their actions, the forward-thinking action of the Albermarle County Board of Supervisors in this matter demonstrates the collective approach that we all must take in supporting our region. We believe that the visitors' center at Danville will do much to enhance the tourism potential for all along the 29 corridor, as well as the sights that lie in close proximity, east and west ofthe corridor. (' Dear Ms. Carey: Governor Allen asked me to thank you for sending a copy of the resolution adopted by your local governing body expressing concerns over his budget reduction proposal to the General Assembly. The Governor's budget proposal was anchored in two main goals in which he finnly believes. The first was to reduce the size and reach of state government. The second was to improve the ability of taxpaying Virginians to keep more oftheir money and to spend it as they, not the government, see fit. In developing his budget proposal, he met this challenge by prioritizing the services provided and recommending funding for only the most essential servIces. In doing so, he also challenged the General Assembly to make tough choices between tax relief and increased spending. We are about mid-way through the process of legislative review of his proposals. As I write this, a conference committee of the House and the Senate are considering amendments to his original proposals. The Governor has stated that he remains finn in his resolve to reduce the size and reach of government and to provide tax relief to Virginians. Governor Allen appreciates learning of the concerns expressed in the resolution. Please be assured that he gave careful consideration to the issues prior to submitting his budget amendments. Tucker, Carruth REVIEWED BY: BACKGROUND: Pursuant to a public hearing on the CDBG program held on December 21, 1994, the Board of Supervisors voted to submit an application for funding for a housing rehabilitation project. A second public hearing must be held to allow comment on the proposed project and past use of CDBG funds. After the second public hearing, the Board of Supervisors must indicate appproval of the proposed project and pass a resolution authorizing the County Executive to submit an application to the Virginia Department of Housing and Community Development. DISCUSSION: The attached project summary describes the proposed housing rehabilitation project. The County is seeking $915,323 in CDBG funds to rehabilitate thirty-seven single-family houses in the Esmont area. An additional $206,931 in County funds will serve as matching funds for the project. The County will sub-contract with the Albemarle Housing Improvement Program for project implementation and administration. Also attached is a resolution authorizing the County Executive to submit the application for CDBG funds to the state. '.'\ 4 ALBEMARLE COUNTY HOUSING REHABILITATION PROJECT 1995 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM PROJECT SUMMARY PROJECT DESCRIPTION Albemarle County, in conjunction with the Albemarle Housing Improvement Program (AHIP), proposes to rehabilitate thirty-seven (37) substandard, single-family homes. All rehabilitation work will bring the units up to, or will exceed, Section 8 minimum housing quality standards. All conditions that currently qualify the units as substandard will be addressed, including incomplete or lack of indoor plumbing and/or major exterior and interior deficiencies. At least three of the units will be rental units. The rent charged for these units after rehabilitation will not exceed more than 35% of the tenants' income for at least a seven year period. The County proposes to use Community Development Block Grant (CDBG) funds for the following activities: Construction - labor and materials Administration CDBG funds will be leveraged with other funds to implement the project. Overall grant administration will be the responsibility of the Albemarle County Housing Coordinator. The County will sub-contract with AHIP for project implementation and day-to-day administration. PROJECT BENEFICIARIES Thirty-seven low- and moderate-income families will benefit from the housing rehabilitation project. All of the housing units are located in the Esmont area of the County. Income eligibility will be verified by AHIP. PROJECT FUNDING Albemarle County will request $915,323 in CDBG funds from the Virginia Department of Housing and Community Development. CDBG funds will be matched by County contributions of $206,931 which is available through the County's annual appropriation to AHIP. Additional funds rrom family contributions will also be used. This would involve housing some of the equipment, which is also used in connection with his farming operation, and occasional transfer of equipment and materials from the base to job sites. Approximately 960 square feet of a large barn would be used to house the equipment when it is on site. The applicant envisions having two employees, who would primarily work at job sites. Petition: To grant a Special Use Permit for a Home Occupation, Class B fl 0.2.2.31] in order to operate a landscape contracting business on 42.37 acres zoned RA, Rural Areas. Property, described as Tax Map 9, Parcel 24, is located on the north side of Route 663, about 800 feet east of Route 603, in the White Hall Magisterial District. This property is not in a designated growth area [Rural Area 1]. Character of the Area: The area around this property is basically rural, with farms and wooded areas and some houses nearby. The subject parcel is one of five contiguous parcels under the same ownership comprising a farm operation of over 65 acres. RECOMMENDATION: Staff has reviewed this request for complianace with the provisions of Section 31.2.4.1 of the Zoning Ordianance and recommends approval. STAFF COMMENT: The applicant has operated his landscape contracting business at this location for 8 years. In the process of getting a permit for a new barn which would house the equipment used for both the farm and the landscape contracting business, the applicant realized the need to ensure conformance with the requirement of a Special Use Permit. Little would change about the level of activity except that two employees, working primarily off-site, may be added. Regarding the criteria for issuance of a special use permit, staff opinion is that: . The use will not be of substantial detriment to adjacent property; the activity associated with the business is mostly off-site and, except for occasional movement of equipment, should not be noticiable to neighboring properties. . the character of the district will not be changed; 1 e the use will be in h...._.nony with the purpose and intent of the ,,-,oning Ordinance and with the uses in the area; the equipment and materials used are consistent with those presently in the area and with the purposes of the Rural Areas. . the use will be consistent with public health and welfare. there is nothing unusually hazardous or objectionable about the proposed use. An issue regarding the sight distance available at the entrance onto Route 663 needs to be addressed by the Planning Commission and Board. The Virginia Department of Transportation (VDOT) notes that the commercial sight distance standard (550' in this case) is not met to the south (350' is available) and that the sight distance to the north is adequate at the present time, but may become inadequate due to growth of young trees within the line of sight. The question is whether commercial sight distance is necessary or if the residential standard of 250' is sufficient. Since the road is not posted for speed limit, 55 mph is assumed, although actual typical speeds along this segment are not known. In 1976, the Board of Supervisors requested that VDOT limit its review of proposals to the best technical transportation solution and not consider the particular circumstances of any applicant, that being a matter for deliberation by the Planning Commission and Board of Supervisors in the public hearing process. That discretion having been reserved to the Commission and Board, staff offers the following comments for consideration: 1. A purpose of zoning is "to reduce or prevent congestion in the public streets." The County Attorney has stated that requirement of upgrading entrances/sight distance is permissible under the authority to impose conditions upon a special use permit. Staff opinion is that special use permit conditions should address peculiar aspects of a use in such a manner as to allow the positive findings required by Section 31.2.4.1 and that such conditions should be applied equitably. 2. Since this use involves some movement of heavy equipment which takes longer to enter a road than normal residential traffic, additional sight distance could be warranted. Staff opinion is that, while the movement of heavy equipment on a flatbed to and from a farm site may be somewhat peculiar, depending on the frequency of such movements, the expected frequency at this site is low enough that the differences in character between traffic generated by this use and uses allowed "by-right" (including farm uses) are not so significant as to warrant upgrading the sight distance requirement. The applicant has indicated that, as much as possible, the heavy equipment would be moved from one job site to the next without having to transport it to and from this site during or between jobs. 3. VDOT requires a commercial entrance and sight distance to serve three dwelling units (i.e. - 30 vehicle trips per day). Staff has used this as benchmark in evaluating applications. The applicant indicates that his household and business vehicle trips are about 10 per day. With two employees, the number of trips would be about 15 per day, less than that typically generated by two dwelling units. Some of these trips may include 2 " heavy equipment. Route 663 has a relatively low traffic volume (1368 vehicles per day), so the trips to and from this site do not generally encounter much oncoming traffic. The prior comments are based on the applicant's representation of business activities. Certainly, the level of activity could change, but the applicant has indicated that if business increased substantially, he would want to provide for equipment storage in a contractor's yard in the Charlottesville area, where the majority of his jobs are. (Additional comments from the applicant are attached). Historically, conditions of approval have relied on good faith compliance by the applicant. The applicant has indicated a willingness to remove the pine trees that may interfere with the sight distance to the north, if necessary, and even to relocate the driveway to provide better sight distance if necessary (t~e property does have points along Route 663 where adequate sight distance could be obtained). Another option is to obtain a sight easement across the property to the south. However, since the level of activity may not warrant increasing the sight distance requirement beyond the normal residential standard of250', such measures may not be necessary. Staff opinion is that removal of the pine trees within the line of sight to the north would adequately address the sight distance needs for this use. The supplementary regulations of the Zoning Ordinance pertaining to Home Occupations (Section 5.2) would all be met (limits on space devoted to such use, no change to outside appearance, no on-premises sales, no unusual traffic volumes, etc.). RECOMMENDED ACTION: Staff recommends approval of this special use permit request, with the following condition: 1. A portion of the barn will also stable four horses. A letter has been provided by the applicant which outlines this request (see attachment B). No on site sales are expected. PETITION: Louise McConnell petitions the Board of Supervisors to establish a home occupation Class B ((10.2.2.31) on 52.2 acres Zoned RA, Rural Area. Property, described as Tax Map 44 Parcel 26A, is located on the end of a private road approximately 0.6 miles east of Route 601 in the Jack Jouett Magisterial District (see attachment A). CHARACTER OF AREA: The property is currently developed as a horse farm. This property is located in the Moorman's River Agricultural/Forestal District. PLANNING AND ZONING HISTORY: N/A SUMMARY AND RECOMMENDATION: Staff has received one letter of support for this application (see attachment C). This property is located in the Moorman's' River Agricultural/Forestal District. Prior to approval ofthis petition, the Board of Supervisors must determine that the use is compatible with the intent of the district. The applicant currently raises horses. A home occupation will allow the applicant better monitoring of the farm activities than an off-site location. The home occupation will be conducted completely indoors with no on-site sales, which should pose no adverse effect to the District. Therefore, staff opinion is that this use should be in accord with the agricultural/forestal district. This property is currently served by a private road. The applicant has indicated that she maintains this road totally at her expense. There will be no on-site sales involving additional traffic. There may be additional traffic due to the two employees requested. Given that the use of the road should not increase with this request and that the applicant maintains the entire road, this activity should not require further review of the private road. Staff has reviewed this request in accord with section 31.2.4.1. Given that the use will not be visible from any other adjacent properties, activities are indoors and that there are no on-site sales, and the applicant maintains the private road, this use should not be detrimental to adjacent properties and should be in harmony with public health, safety and welfare. FRITZ JANUARY 24, 1995 FEBRUARY 15, 1995 SP 94-38 PHILLIP RYDER Applicant's Proposal: The applicant proposes to construct a parking garage which will increase the available parking at the Floor Fashions building on Rt. 29N. The need to increase available parking is due to a proposed change in the use of the building. Currently the ~uilding is occupied primarily by a floor coverings business which has a low parking generation rate. A change in use to offices is proposed. Office use requires more parking than does the existing use and it is this proposed change in use which is resulting in this request. The parking structure would consist of a ground level and an upper level which would be constructed over top of the existing parking area located at the rear of the building. The ground level portion of the parking structure will involve grading to lower the existing elevation near the building. The grade of the ground level portion at the point farthest from the building will be at approximately the same elevation as the existing parking area. The finished floor level of the upper level is 10 feet above the finished floor of the ground level portion. The finished floor level of the upper portion of the parking structure will be at the same level as the finished floor level of the existing Floor Fashions building. The parking deck will increase the number of available parking spaces by 30. A sketch plan and profile which show the proposed improvements is included as Attachment C. Petition: Phillip Ryder petitions the Board of Supervisors to issue a special use pennit to allow the construction of an above grade parking structure on 2.04 acres zoned C-l, Commercial and EC, Entrance Corridor Overlay District [22.2.2(9)]. Property, described as Tax Map 45, Parcel 104A, is located on the east side of Route 29 approximately 500 feet south of Wood brook Road in the Charlottesville Magisterial District. This area is recommended for Community Service in Neighborhood 2. Character of the Area: This site is developed with the Floor Fashions building. The rear portion of the site includes a vegetative buffer of white pines. The Woodbrook subdivision is adjacent to the rear of this property. The closest residential unit is located 150 feet from the existing parking area and the proposed parking structure. A stream valley separates the commercial area from the residential areas of Woodbrook. RECOMMENDATIONS: Staff has reviewed this request for compliance with the provisions of Section 31.2.4.1 of the Zoning Ordinance and recommends approval. Plannin2 and Zonin2 History: November 25, 1986 - Site plan approved by the Planning Commission showing 39,985 square feet of building served by 115 parking spaces. This plan was amended on December 16, 1986 June 4, 1987 - Site plan administratively approved. 1 August 26, 1988 - Slw plan administratively approved. This J1...tn was a modification of the previously approved plan. Comprehensive Plan: This area is recommended for Community Service in Neighborhood 2. The Comprehensive Plan contains no comments regarding the use of parking structures. The stream valley between this site and Woodbrook is designated as a buffer area. This buffer area will remain undisturbed. STAFF COMMENT: Staff will address each provision of Section 31.2.4.1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to adjacent property. The site is bordered on the north and south by other commercial uses. This request will have no adverse impact on other commercial property. The property to the east is the Woodbrook Subdivision. The closest residential unit is located 150 feet distant. A stream valley effectively separates the residential property from the commercial property. The two uses are at approximately the same absolute elevation. A vegetative buffer of white pines is located on the perimeter of the parking area. These trees extend to a height of approximately 15 feet above the elevation of the existing parking area. The floor of the upper portion of the proposed parking structure at the point closest to the residential units will be approximately 10 feet higher than the existing parking. The existing trees will remain and will serve to screen the parking structure. The provision of a solid barrier (approximately 3.5 foot high wall) around the perimeter of the upper and lower sections will effectively block the headlights of vehicles. Lighting is proposed and is governed by the provisions of the Zoning Ordinance, reference Section 32.7.8.2 and 4.12.6.4 (Attachment D). Based on the existing screening of white pines, design of the structure to prevent headlights from shining into the residential area and the provisions of the ordinance as regards lighting this use should not result in substantial detriment to adjacent property. that the character of the district will not be changed thereby. This site and the property to the north and south are zoned for and currently developed in commercial use. The C-1 district allows above grade parking as a special use permit. Approval of this request will not change the commercial character of the C-1 district in this area or in general. This site is in the EC district. Due to the proposed location of the parking structure behind the building, visibility from the EC district and potential impact on the EC district is limited. The Architectural Review Board is scheduled to review this item prior to Planning Commission review. However, their comments were not available at the time of preparation of this report. The Design Planners information presented to the ARB is attached. and that such use will be in harmony with the purpose and intent of this ordinance. Staff has reviewed the purpose and intent of the ordinance as stated in Sections 1.4, 1.5 and 1.6. Section 1.4.6 states "To protect against one or more ofthe following: overcrowding ofland, 2 undue density of populatioh ..1 relation to the community facilities, e;......,ting or available, obstruction of light and air, danger and congestion in travel and transportation, or loss of life, health, or property from fire, flood, panic or other dangers". The potential of overcrowding of the land has been an issue in review of this site and other sites. During Planning Commission review of the previous site plans for this site, concern was stated that the proposed development was intense and that available parking was limited. Staff has reviewed the two other requests for parking structures in the county previously considered. Concern in other reviews has been stated as to the potential of overdevelopment of the site. Both of the other requests were approved. Staff has stated concerns in the past that developments which are approved making use of low parking generators, such as a furniture store, result in buildings larger than could otherwise be placed on the property. In cases were buildings are approved with low parking generator the buildings then have limited potential for other uses as the area for parking is limited. This is the situation in this request and the applicant is proposing to construct an above grade parking structure as no additional area is available for parking. The proposed design of the parking structure utilizes existing developed area, screening and access. In the opinion of staff this request, while intensifying the use of this site, does not conflict with the purpose and intent of the Zoning Ordinance and does not represent overcrowding of the land. with the uses pennitted by right in the district. This use will have no impact on pennitted uses in the district other than making available additional uses in the existing building due to the provision of additional parking. with additional regulations provided in Section 5.0 of this ordinance. Section 5.0 contains no additional regulations. and with the public health. safety and general welfare. This use will require review and approval of a site plan. The applicant has submitted a plan showing the layout of the proposed structure which has been reviewed by staff. The review of this plan has not identified any major obstacles to development. The Department of Transportation has provided comment on this request, stating: "The addition of a parking structure will add additional traffic to existing commercial entrance and Route 29. The impact to Route 29 should be very minimal and present entrance appears satisfactory." Staff does note that, due to sight distance constraints, the ramp to the upper level may require relocation. Based on this review staff opinion is that this use will be consistent with the public health, safety and general welfare. SUMMARY: Staff has identified the following factors which are favorable to this request: 1. Approval of this request will allow for additional commercial uses in the existing building which is in a area recommended for Community Service uses in the Comprehensive Plan and zoned C-1 ; 3 2. The proposed use, \\u.te proposing an additional structure, Wh. 110t increase the land area developed on-site; 3. The use will not result in an adverse impact to adjacent residential property due to the design of the structure and maintenance of the existing buffer of screening and vegetation. Staff has not identified any factors which are unfavorable to this request. The use of parking structures to provide required parking is uncommon in Albemarle. The use of parking structures which increase the total available parking can allow for a larger building than would normally be permitted or anticipated on a parcel. Parking structures could have the effect of intensifying land use to the point of changing the character of the district and increasing the impact on public improvements. This request is unique in that the building exists and the need to provide additional parking is generated by a change in the use. Each request for new construction which includes a parking structure is reviewed based on the merits of the application, including the suitability of the area to accommodate the parking structure and any associated buildings and uses. Staff believes this request satisfies this finding of suitability. RECOMMENDED ACTION: Staff recommends approval of this request subject to the following conditions: Recommended conditions of ADoroval: 1. Date: January 17, 1995 The applicant has submitted a section illustrating the relation of the improvement proposed with the elevation of Route 29N. The section indicates that the structure proposed wí1l not have a significant effect on the Entrance Corridor. The elevation of the proposed parking deck ranges from 3' above the existing grade in the area adjacent to the building, to approximately 9' above the existing grade at the point most distant from the building. This will cover the existing parking. The change in the visual effect will be minimal. The juxtaposition of the buildings, Floor Fashions and Grand Piano, further minimize the impact of this structure on the surrounding area. Staff does not expect comments from the ARB concerning the special use permit application.
