Do you want to get into this a bit further with Robbie or should I provide him the following section of the ordinance and explain my position a bit further. 32.4.3.6 REVIEW AND ACTION ON FINAL SITE PLAN BY AGENT The agent shall review and act on a final site plan as follows: a. Review. The agent shall review the final site plan for compliance with all requirements, and shall make a good faith effort to identify all deficiencies, if any, during review of the plan. The agent shall consider the recommendation of the site review committee as to whether the plan complies with all applicable requirements and any statement by the developer. The agent also may consider any other evidence pertaining to the plan's compliance with the requirements of this chapter as deemed necessary for a proper review of the plan. c. Action to approve and notice of approval. if the agent determines that the final site plan complies with all applicable requirements, he shall approve and sign the plan, and may issue a letter to the developer informing the developer of the approval. The agent shall mail the letter by first class mail, personally deliver it to the developer, or, if consented to by the developer in writing, deliver it by fax or email. After receiving such an email from staff I am inclined not to respond further. Did you make sure the final plans hadn't changed based on my last review? I've had two sets of plans that when it came time for signatures had changed so I make sure I always do a quick review before signing any plans. I get it was a trying situation but that doesn't give you the right to forge someone's signature even if your boss says it's ok. I'm not pleased with the way this was handled and I'll be talking to my chiefs about this situation. Mark, SDP2017-16 Timberland Park Apt- Final Site Plan I'm in a bit of a soft bind here w/the WPO plan being approved today. I'm looking for you to help make this decision on the final site plan approval. The final site plan is ready to be approved pending the approval and recordation of the Easement Plat associated with the site plan (right-of-way dedication, ACSA easements, and SWM easements) &deed of dedication being signed by Doug Walker. The item was just approved to form by the County Attorney's office and is being routed to Doug for signature. Once Doug signs the above legal doc the plat can be signed. Once the plat is signed the applicant needs to record all those items in the clerks office. Once that happens the final site plan can be approved. Notably, it typically takes 10 days for all reviewers to sign the plans. In anticipation of this I sent the notice to all reviewers two days ago. But I still don't have all signatures on the plan. What are your thoughts? David will have me the signed Plat on Thursday 5/18 via UPS. 2. On 5/18 we will sign the Plat seal and deliver it to the County for the County Attorney's signature. I do not need the County Attorney to sign the plat; rather, the Subdivision Agent (in this case me) signs the plat. I'm ready to sign the plat once I have notarized signatures on the plat. Send it over asap. 3. The County Attorney already has the Deed to sign, so once he has the Plat both can be signed. We received the deed yesterday but it will not be sent to the County Attorney for signatures till the signed plat is provided as that's the plat that the deed references. Once we have the plat I'll sign it/approve it and Emily will distribute it and the deed to the County Attorney's office for"approval to form"then off to Doug Walker for signature. Chris had previously told me this can take up to a week 5/25. It can take longer than a week. I would advise/stress to Emily to put a rush notice to the County Attorney's office on this approval once the plat comes in and request a 1 quick turnover due to financing issues.John will talk to the County Attorney and see if there is any way we can expedite that once the Plat is delivered.Yes, I'd advise you to do this. 4. Our client has a past due deadline from a bank with a credit violation of upwards of$1 million since this project is VHDA. I know I would not like to lose $1 million and I am sure you would not either. The bank has really waited as long as they can past this deadline. Our client says all she needs is a letter from the County saying that plans are approved contingent on any Agreements, Easements, or any *ther non-plan related items needing to be addressed. Since I got comments in April I have very quickly addressed all comments with ACSA,VDOT, Engineering, and Planning as follows: • Engineering comments were identical to the WPO comments which have been addressed and the WPO plans are approved with these changes reflected on them barring Easement Deeds. • ACSA had some minor changes like pipe material, additional hydrants, and relocation of some building connections. All of these have been made and approved my ACSA via email as attached. There will be a Deed and Plat approval pending. • VDOT had no plan changes. Attached is the email that plans are adequate barring a Maintenance Agreement for the retaining walls which has been sent to them. There will also be a Deed and Plat approval pending. • Planning had some landscaping and setback note changes. Those have been addressed and approved via email. With these departments changes to the plans the physical hard copy of the plans are approvable. We understand that you have a process to get signatures and you want Deeds and agreements and etc. taken care of first before you might sign the plans. But our client just needs a letter stating that the plans are approvable as is with a contingency that certain agreements and deeds are taken care of. The client needs to get the bank an approval letter by today with a condition of these items needing to be addressed. They basically need to know the physical plans themselves are good with everyone,they are not concerned about the deeds and everything. She will try to delay the bank a day or two to get this letter but she really needs it or it can cost her a significant amount of money. Is this something you can provide for her once I get you hard copies approved by ACSA(we previously had VDOT approval and your approval based on prior plan coordination via email and we already had other department approvals)? I do apologize for this rushed request but since it is a VHDA project they have very strict timeline requirements and if they are not met then they impose very harsh penalties. The shrubs are 10'O.C.diagonally, but horizontally they are 12'. The code was not clear eaxactly where that 10' spacing occurs. Which this staggered configuration you end up with a 16' shrub buffer with the ARB trees 4' behind that. Retaining walls that are over 6 foot tall which face an abutting residential development are considered to cause negative visual impacts and require screening. On the final site plan please call out any segments of the many retaining walls onsite which meet the above criteria and provide the required screening. The agent shall act on the landscape plan prior to final site plan approval. A complete review of the landscape plan submitted with the initial site plan was not conducted because of required changed to the site that may impact proposed plantings and/or require additional plantings. Final: Landscaping Within the Parking Area: An area of at least five (5) percent of the paved parking and vehicular circulation area shall be landscaped with trees or shrubs.
