Mr.Collins:
The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced preliminary
subdivision plat.
This approval shall be valid for a period of five(5)years from the date of this letter,provided that the developer
submits a final plat for all or a portion of the site within one(1)year after the date of this letter as provided in the
Section 14-226 of the Code of the County of Albemarle,and thereafter diligently pursues approval of the final plat.
The final plat will not be considered to have been officially submitted until the following items are received:
1. A final plat that satisfies all of the requirements of section 14-303 and sections 14-304 through 14-318 of
the Code,and the conditions attached to this letter.
2. Applicable fee outlined in the application.
Please submit 9 copies of the final plat to the Community Development Department. The assigned Lead Reviewer
will then distribute the plat to all reviewing agencies(for ACSA,please submit 3 copies of construction plans
directly to them,as stated in their comments).Once you receive the first set of comments on the final plat,please
work with each reviewer individually to satisfy their requirements.
The Department of Community Development shall not accept submittal of the fmal plat for signature until tentative
approvals for the attached conditions from the following agencies/reviewers have been obtained:

The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [ZMA2004-14 Application plan,Proffer 4,and Proffer 1]The primary recreation area south of Camelot shall
be built or bonded prior to final plat approval of Phase 4.The recreational area shall consist of a
baseball/multipurpose field,two half basketball courts,playground equipment,and picnic facilities.Prior to fmal
plat approval an approved site plan and WPO plan shall be required for the primary recreational area and the off
street parking,access aisles,and commercial entrance serving this area.
2. [ZMA2004-14 Application plan,Proffer 1,and 4.12.6]On the site plan provide the required parking.
Baseball field-20 spaces per field
Basketball courts-2 spaces per basket
Playground equipment- 1 space per one hundred twenty-five(125)square feet of useable recreation area
3. [ZMA2004-14 Application plan,Proffer 1 &4,and ZMA95-20 Proffer 19]The final plat shall depict and
dedicate to the HOA the primary recreational area and its access.The alignment of the access road is required to
go through TMP 32E-2 within the area reserved for access as approved on ZMA95-20,which is an amendment to
ZMA79-32.Provide the owner signature of TMP 32E-2 on the final plat.
4. [ZMA2004-14 Application plan,Proffer 4]The open space in Phase 4 shall contain a walking/jogging trail.On
the final plat depict,label("Passive Recreational Area consisting of walking/jogging trails"),and dimension the
trail.At a minimum the trail shall be platted from behind Lot 28 on through to Lot 42 and connect to the existing
trail in phase 4. Also,provide a trail connection to either the St.Ives cul-de-sac or Sunset Drive at either the
proposed SWM facility(pond 4)or in the open space area between Lots 32 and 33.
5. [ZMA2004-14 Application plan,Proffer 4]Prior to fmal plat approval the trail shall be built.Provide a trail plan
exhibit which shall be used by the County to approve the design of the trail.The exhibit shall contain a cross-
section of the trail,topography(elevation contours 50' on either side of the trail),and a plan view of the trail.Once
the trail plan has been approved provide the above mentioned information on the amended WPO201600001
currently under review.Once approved please construct the trail and then request an inspection of the trail.
6. [14-392(B)(10)]Stream buffers.Provide the following note: "The stream buffer(s)shall be managed in
accordance with the Albemarle County Water Protection Ordinance".
7. [14-428]Dedication of streets. Provide the following note: "51'Public R/W is hereby dedicated for public use."
8. [14-428]Dedication of open space.Provide the following note: "Open Space is hereby dedicated to the HOA."

9. [14-302(A)(8)]Proposed Lots. Provide the area of each proposed lot.
10. [14-303(A)]Statement of consent to division. Provide the following note:"The platting or dedication of the
following described land[insert correct description of the land subdivided]is with free consent and in accordance
with the desire of the undersigned owners,proprietors and trustees, if any."
11. (14-302(A)(15)]Identification of all owners and certain interest holders. Provide the address for each owner of
record,to include the owner of IMP 32E-2.
12. [14-303(0)&(P)]Signature panels.Provide owner signature lines and notary statements for each owner of record.
Under the owner signature lines provide a signature panel for the"Agent for the Board of Supervisors".This will
be used by the Subdivision Agent to approve the plat.
13. [14-303(Q)] Water Supply. Provide the following note: "Under current county policy,public water and/or sewer
will be available to this property."
14. [14-302(B)81 Yards. Under setbacks include "12'building separation". Also,provide the following note: "No
minimum lot area is specified".
15. [14-311]Infrastructure improvement plans. Road Plan and WPO Plan must be approved,all required
improvements must be built or bonded,and all required Deeds and Declarations must be reviewed and approved
prior to final plat approval.
16. [14-317]Instrument evidencing maintenance of certain improvements. With the fmal plat submit an instrument
assuring the perpetual maintenance of the stormwater management facilities,open space area and the trails,
primary recreational area,and any other improvements that are to be maintained by the HOA in perpetuity. County
Attorney approval is required prior to fmal plat approval.
17. [14-302(A)4&5]Easements. Provide the deed book and page reference information for all existing easements.
Include the 10' walking/jogging trail easement previously platted in Phases 4 and 5,and the existing 20' drainage
easement.
18. 114-302(B)71 Agricultural-Forestal District.Provide the following note: "This site does not lie within an
agricultural forestal district."
19. 114-302(A)4&51 Drainage Easements. On the plat label all drainage easements as either public or private.
20. [14-302(A)3]Existing or platted streets. Provide the State Route Number 1511 for St.Ives Road.
21. [Comment]Under general notes revise the retaining wall note as follows: "Retaining walls are proposed."
22. [Comment] For tracking purposes it is suggested that the numbering of Lots 24A and 25A be revised to Lots 51
and 52.
23. [14-303F]Identification of sections, blocks, and lots. On the final plat provide a current phasing plan.
24. [Recommendation] Staff has received citizen feedback concerning the proposed layout of Lot 49 in consideration
of the existing walking/jogging which is located within an easement that crosses the rear yard of this lot.Residents
are concerned that the HOA will have trouble with any future property owner of this lot not wanting the access to
remain on their property,especially so close to their home.It is suggested that either the boundaries of Lot 49 be
revised to not include the existing trail easement on the property or to vacate this easement and relocate it within
open space.
25. [Comment]Prior to final plat approval the phasing variation request shall be approved by the Board of
Supervisors.Planning's comments on the variation are provided below.

Phasing Variation Request
1. [Comment] Provide a visual with the current phasing plan that was approved by the Board of Supervisors on
September 4,2013 alongside the proposed phasing plan.This visual will be utilized as an attachment in the staff
report.
2. [Comment]The land being platted as Lot 50 and a portion of open space adjacent to Lot 49 are part of Phase 5 on
the current phasing plan.Revise the variation request to modify the phase lines to include these portions of land in
phase 4.Also,as part of the variation request include the two lots next to Lot 4 in the request to shift lots from
phase 4 to phase 6."
3. [Comment]Engineering had no objection to the variation request.
4. [Additional Comment Post SRC Meeting]At the SRC meeting the applicant proposed to modify the phasing
variation request and pull out a couple proposed lots in phase 4 and reclassify them to phase 6.To make up the
difference in phase 4 he plans to reduce the lot size and plat additional lots,while remaining at 52 lots in phase 4:
Submit the revised variation request for consideration.

Preliminary Plat
Dear Mr. Perez,
We have reviewed the preliminary plat for Briarwood Phase 4 and a portion of Phase 6 dated
12"28./15 as submitted by Collins Engineering and offer the following comments:
1. This project will need to be coordinated with RWSA to ensure access to their water
treatment plant at the end of St. Ives Drive during construction. Furthermore,an entrance
off of the cul-de-sac needs to be provided for the treatment plant.
2. The stormwater management facility at the intersection of St. Ives Road and Sunset Drive
is located relatively close to the right-of-way. It would be preferred if the facility could
be moved further from the right-of-way.
3. Generally,VDOT has no objection to the proposed preliminary plat.
