SUB2016-004 Briarwood-fees
While reviewing the fees for the project it appears you overpaid for the Variation to the phasing plan for the PRD.You
paid the appropriate subdivision fee;however,you also paid an$892 fee listed on the subdivision application for a
Variation or Exception under section 14-203.1 before approval of final plat.This is not the correct fee for this type of
Variation,as it is authorized under section 8.5.5.3 and not section 14-203.1.The appropriate fee for this type of Variation
is$457 which is listed under Section 35.1(i)(2) Special Exceptions.
Please work with intake to process a refund for the difference in the Variation fee($435). As discussed below you still
owe the public notification fees of$255.

I wish I could give you a better answer. The simple fact is that we have talked to the Board before about notices
for by-right subdivisions and they have not amended the ordinance to reduce notice for these types of
subdivisions. I can't give you any answer other than that. We can bring it up again when discussions occur
about processes or fees.

of$455 for mailings on a simple subdivision plat for Briarwood. This is crazy. I can understand if it was a rezoning, but
for a simple subdivision,for the client to have to pay$455 for notification fees is just not right. It's all because it abutted
an open space that carries through the property. Something needs to be done so that property owners do not have
such a financial burden for this notification fee amount when the county is notifying people that clearly have no
attachments to what is being subdivided.

Assuming that Ryan Homes points it out to they buyers when looking over possible lots (and before the paperwork has
been signed). Having purchased a lot/home from Ryan, the sales reps don't always point out things like that. It's only
later,when you want to put up a fence, that you figure out where you can/cannot build:`

Great. IMHO,they could also shift the trail so that they are not cutting the corner. I'll make the recommendation;
however, I do not think they will relocate the built trail. But they might.

If you were to pass along a recommendation/resident concern, how soon would you get some feedback? The
recommendation would be in the conditional approval letter and we would not receive any feedback until the final plat
is submitted. Once the final plat is submitted we'd know if he took the recommendation or not. The prelim plat is valid
for 5 years provided they submit a final plat within 1 yr of the approval.
Also, I would think they'd take your recommendations a bit stronger than one call from an existing resident. But, if you
think it's wise, I'd have no issue with making a followup call to Scott Collins. Recommendations are recommendations,
I've found it does not matter who they come from, if the developer thinks it's a good idea that will not hurt them nor
cost them additional money they may do it. I could see this being a financial benefit to the seller of that lot to move the
easement over.
Q?would your conditional approval recommendation be part of the "public" record ... and something that those making
the final approval would see?Yes, the conditional approval letter goes hand in hand with the approved preliminary plat.
We use it as an additional checklist when reviewing the final subdivision plat. I'll send you a copy once it's finalized.

The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [Comment] Pay the$255 public notification fee prior to any further review/action of the plan.
2. [ZMA2004-14 Application plan,Proffer 4,and Proffer 1] The primary recreation area south of Camelot shall
be built or bonded prior to fmal plat approval of Phase 4.The recreational area shall consist of a
baseball/multipurpose field,two half basketball courts,playground equipment,and picnic facilities.Prior to fmal
plat approval an approved site plan and WPO plan shall be required for the primary recreational area and the off
street parking,access aisles,and commercial entrance serving this area.
3. [ZMA2004-14 Application plan,Proffer 1,and 4.12.6] On the site plan provide the required parking.
Baseball field-20 spaces per field
Basketball courts-2 spaces per basket
Playground equipment- 1 space per one hundred twenty-five(125)square feet of useable recreation area

trail.At a minimum the trail shall be platted from behinLot 18 on through to Lot 42 and connect to the existing
trail in phase 4.Also,provide a trail connection to either Ives cul-de-sac or Sunset Drive at either the
proposed SWM facility(pond 4)or in the open space area between Lots 32 and 33.
6. [ZMA2004-14 Application plan,Proffer 4] Prior to fmal plat approval the trail shall be built.Provide a trail plan
exhibit which shall be used by the County to approve the design of the trail.The exhibit shall contain a cross-

the trail plan has been approved provide the above mentioned information on the amended WPO201600001
currently under review.Once approved please construct the trail and then request an inspection of the trail.

accordance with the Albemarle County Water Protection Ordinance".

September 4,2013 alongside the proposed phasing plan.This visual will be utilized as an attachment in the staff
report.
2. [Comment] The land being platted as Lot 50 and a portion of open space adjacent to Lot 49 are part of Phase 5 on
the current phasing plan.Revise the variation request to modify the phase lines to include these portions of land in
phase 4.Also,as part of the variation request include the two lots next to Lot 4 in the request to shift lots from
