The visual and the written request matching up and are ready to move forward. I've spoken to David Benish about the request and am awaiting a final review from Zoning. I should have Zoning's review complete by Wednesday of next week. At this time staff is recommending denial of the request because it utilizes land that is part of phase 4 without fulfilling proffer 4 (the primary rec area being built/bonded prior to 1st final plat for phase 4). I'll have my final decision once I get Zoning's review If staff is recommending denial of the variation we'll have to pull the item from the June 8th BOS consent agenda and take this item to the Planning Commission 1st, then schedule it for the BOS. I'll keep you posted. The labels which need to be revised are as follows: - "Phase 4: 52 SFD (and/or SFA)" is incorrect and it truly should read"Phase 4: 52 SFD"as SFA units are not permitted in the lot mix for this phase per Proffer 9. Revise. - "Phase 5: 18 SFD (and/or SFA)" is incorrect and it truly should read "Phase 5: 18 SFD" as SFA units are not permitted in the lot mix for this phase per Proffer 9. Revise. - "Phase 1A: 50 SFD (and/or SFA units)" is incorrect and it truly should read"Phase 1 A 28 SFD and 22 Townhomes", as written it appears the developer is permitted 50 SFD units in this phase which is not permitted in the lot mix for this phase per Proffer 9. (Original request attached) 3)Also,because you are attempting to take such a large portion of land out of phase 4 (approximately 1/) through a phasing variation and reclassify it as phase 6, I need to get Zoning staff and the Director of Planning to review this to assure they are good with it with regard to Proffer 4 which requires the primary recreation area to be built/bonded prior to any final plats in phase 4. As I understand it from our brief discussion at SRC your reasoning for this is because the 52 lots in phase 4 are to be reduced in size due to market demand and you will be able to get all 52 lots in the remaining land that is phase 4. Will you be able to get all 52 lots in the remaining space or will you be coming back in for a variation to put a second block of phase 4 somewhere else in the development? The recreational area shall consist of a baseball/multipurpose field, two half basketball courts, playground equipment, and picnic facilities.
