Board Actions of January 13, 1999
At its meeting on January 13, 1999, the Board of Supervisors took the following actions:
Agenda Item No. 1. The meeting was called to order at 7:00 p.m., by the Chairman, Mr.
Martin.
Agenda Item No. 4. Other Matters Not Listed on the Agenda from the Public.
Mr. Kurt Gloeckner was present representing St. Annes Belfield. He asked the Board to allow
them to continue with the construction of the baseball field until he can receive a waiver from the
Planning Commission on the type of lighting fixtures to be used. Consensus of Board that the
applicant provide staff with whatever information is necessary to resolve outstanding issues, staff to
ma]ce a recommendation and then forward the request to the Planning Commission at the earliest
possible date.
Agenda Item No. 6. SP-98-47. Limited Service Hotel (Sign #30). PUBLIC HEARING on a
request for 100-room limited service hotel [22.2.2.7] on portion of 37 + ac pcl, znd C-1, EC, & AIA.
TM32,P41D. Loc W of Rt 29 N (Seminole Trail) & the Forest Lakes N commercial area, & S of SR
649 (Airport Road). (Site designated for Regional Service in the Community of Hollymead.) Rivanna
Dist.
APPROVED SP-98-47 subject to the following conditions:
The use authorized by this special use permit shall be developed as a limited service hotel, not
to exceed 100 rooms in size, in general accord with the applicant's justification dated 8/21/98
and initialed "SET" (copy attached);
The use authorized by this special use permit shall be limited to approximately 4.5 acres in
size; and
The final site plan for the limited service hotel shall not be approved until after approval of a
development plan for the entirety of Tax Map 32, Parcel 41D.
Agenda Item No. 7. SP-98-56. Scottsville Volunteer Rescue Squad (Sign #50). PUBLIC
HEARING on a request to allow fundraising events in the existing Scottsville Volunteer Rescue Squad
building [ 10.2.2.5]. This is an amendment of an existing SUP (SP-96~50). The site is approx 9.738
acs znd RA. TMi30,P7B. Loc on Rt 6 (Irish Rd) at intersec of Rt 6 & Rt 737 (Mountain Vista Rd).

APPROVED SP-98-56 subject to the following conditions:
Any fundraising activity shall be conducted in an enclosed building only;
Approval is limited to no more than one event per week either for fundraising purposes or
rental for events not associated with the rescue squad;
Any use of this building shall comply with any applicable requirements of Chapter 12, Article
2, Division 1, of the County Code regarding dance halls;
Approval of expansion to the septic system to accommodate an event with 200 people for
which food and drinks can be served. No event will be held until the expansion is complete;
The applicant shall pave the parking area. No event will be held until the paving is complete;
No such activity shall be conducted between 11:00 p.m. and 8:00 a.m., except Friday and
Saturday, for which no such activity shall be conducted between i 2:00 midnight and 8:00
a.m.;
Development shall be in general accord with the attached plan titled Scottsville Rescue Squad,
prepared by Robert Lum, revised 12/16/96 and initialed WDF I/9/97; and
Special use permit shall expire one year from its approval date unless extended prior to its
expiration by the Board of Supervisors.
(NOTE: The action letter needs to include a reference of when the applicant needs to
reapply to extend the special permit).
Agenda Item No. 8. SP-98-58. John Buscarino (Sign #58). PUBLIC HEARING on a request
for a Home Occupation Class B permit to allow construction of 2,000 sq ft accessory structure which
will be used for the manufacture of guitars [ 10.2.2.31 ]. TM i 14,P65A1. Site consist of 2.28 acs znd
RA. Loc on SW sd of Rt 708 (Secretarys Rd) approx 1,500 ft E of Rt 795 (Presidents Rd). (Site is not
located in designated growth area.) Scottsville Dist.
APPROVED SP-98-58 subject to the following conditions:
Home occupation shall be limited to 2,000 square feet total, for homemade guitar
manufacturing;
Fire official approval of materials storage; and
Any structure to be utilized in conjunction with this home occupation shall meet all applicable
setback regulations.
Agenda Item No. 9. CPA 98-04. Chapter Two, The Natural Environment. PUBLIC
HEARING on an amendment to Chapter 2 of the Comp Plan, "The Natural Environment," as part of
the state-mandated 5-year review, to revise the language of the chapter as it currently exists in the
1989 Comp Plan.
DEFERRED until February 3, 1999.
Agenda Item No. 10. PUBLIC HEARING on an ordinance to amend and reenact Chapter 3,
Agricultural and Forestal Districts, of The Code of The County of Albemarle, Virginia:
a) §3-209, Buck Mountain Agricultural/Forestal District, to continue the District of approx
660.243 acs for 10 years. Loc on St Rts 664 & 671. White Hall Dist.
b) §3-228, Yellow Buck Mountain Agricultural/Forestal District, to continue the District of

BACKGROUND:
Albemarle County Personnel Policy P-63 provides for voluntary early retirement for county employees who have been
employed by the county for ten of the last thirteen years and who are at least 50 years of age and currently employed. Staff
has received four requests from employees who has been employed with the county for the prerequisite minimum number of
years and have indicated their intentions to retire within the next fiscal year. Policy dictates that applications to enter the
program be submitted by December 1 of the preceding year so that budgets can be adjusted to accommodate the requests.
The associated employee costs will be built into the FY 1999-2000 budget since notification has been received.
RECOMMENDATION:
'County policy requires the Board of Supervisors to approve all early retirement applications upon recommendation of the
County Executive. Staff recommends that these four requests be so approved with the budgetary implications absorbed within
the appropriate departmental FY 1999-2000 budgets.

Attached is an application for the County's Voluntary Early Retirement Incentive Program for
FY 1999-2000 received from James Heilman. He is anticipating retirement during the next
fiscal year. I have also included the VERIP budget projection in the amount of $62,716.88.
This includes those persons currently in the program as well as the addition of Mr. Heilman.

The 1999 biennial real estate reassessment has been completed. Attached is a summary of the reassessment values. The
1999 fair market value is estimated to be $6.403 billion, a $582.4 million, 10.01%, 'ncrease over the 1997 reassessment. The
increase is attributed to $365.6 million in new construction, additions, and property divisions, and $216.8 million in market value
appreciation. The market value appreciation is estimated to be 3.51%, which is an increase from the 1997 2.26%
reassessment increase. This additional 1% over the preliminary 2.5% reassessment estimate increase used in the October
revenue projections should result in an additional $400,000 for FY00.
The values reported are for taxable real estate only and do not include government or other tax exempt properties. Tax
collections will be less than fair market value after adjustments for land use, tax relief, and uncc lectible taxes are taken into
account. These reductions are estimated during the budget process.
The large increase for the Town of Scottsville results primarily from market value appreciation. The Rivanna and Scottsville
magisterial district increase primarily results from substantial new construction. The increase in land use deferment is due to
an overall reduction in all land use values. A report analyzing land use values will be sent under a separate executive
summary.
The 1999 reassessment cycle began in August 1997. It is based on sale transactions prior to that time. Transactions after
August 1997 are used as guides and are generally not utilized unless significantly different. The principal of uniformity requires
that a county wide cutoff date be established using the same data for all reassessments.
RECOMMENDATION:
Staff recommends acceptance of the 1999 Reassessment Report.

Dear Mr. Roell:
The Albemarle County Planning Commission, at its meeting on December 1, 1998, unanimously
recommended approval of the above-noted petition to the Board of Supervisors. Please note that this
approval is subject to the following conditions:
The use authorized by this special use permit shall be developed as a limited service
hotel, not to exceed 100 rooms in size, in general accord with the applicant's justification
dated 8/21/98 and initialed "SET;"
The use authorized by this special use permit shall be limited to approximately 4.5 acres
in size;
The final site plan for the limited service hotel shall not be approved until after approval of a
development plan for the entirety of Tax Map 32, parcel 41D.

Aoolicant's Proposal
The applicant is requesting approval for a 100 room limited service hotel on approximately 4.5
acres located west of the Forest Lakes commercial area, with access from Route 29 North via the
[proposed] Timberwood Boulevard "Extended."
Hotels, motels and inns are allowed by special use permit in the C-1 zoning district.
Petition
Special use permit request for a 100 room limited service hotel [22.2.2.7] on a portion of a 37+
acre parcel, zoned C-1, Commercial, EC, Entrance Corridor, and A.IA, Airport Impact Area, and
described as Tax Map 32 Parcel 41D. The property is located west of Route 29 North (Seminole
Trail) and the Forest Lakes North commercial area, and south of State Route 649 (Airport Road),
in the Rivanna Magisterial District. This site is designated for Regional Service in the
Community of Hollymead. (See Attachment A, location map; Attachment B, plat; Attachment C,
applicant's justification)
Character of the Area: The east and west sides of Route 29 North are a developing commercial
area presently characterized by business establishments primarily oriented to serving
Neighborhood and Community Service needs. With the construction of the United States Postal
Service distribution facility to the northwest of this site, it is anticipated that the Route 29
commercial corridor will become more closely linked with Airport Road and the area in between
(including this site) will developed as a continuation of the Forest Lakes North commercial
center.
RECOMMENDATION:
Staff has reviewed the proposal for conformity with the Comprehensive Plan, and the criteria
listed in Section 31.2.4.1 of the Zoning Ordinance, and recommends denial.
Planning and Zoning History
ZMA 84-02 - Approval by BOS March 21, 1984, to rezone 2.44 acres, from RA, Rural Areas, to
HC, Highway Commercial [subject property located on Ai.'rport Road, previously described as a
portion of Parcel 41D, now Parcel 41H].
ZMA 86-02 - Approval by B.OS September 15, 1986, to rezone 6.65 acres from RA, Rural
Areas, to CO, Commercial Office; approval to rezone 48.13 acres from RA, Rural Areas, to LI,
Light Industry. Proffers include:

Access to U.S. Route 29 will be limited to one point, at a proposed cross-over [intersection of
Timberwood Blvd and Route 29]... This connection will not be made until the proposed
cross-over has been constructed.
Sanitary sewer will be extended to this tract prior to such time that the cUmulative total need
for wastewater disposal exceeds the quantity of waste water that would have been generated
by the total development of this tract into 2 acre residential lots (i.e., 27 lots at 300 gpd, or
8,000 gallons per day). The Planning Commission may require the extension.of sanitary
sewer to this property at any time they deem access to public sewer to be reasonably
available.
ZMA 89-08 - Approval by BOS September 20, 1989, to rezone 11.4 acres of the 48.13 acre
parcel from LI, Light Industry, to C-1, Commercial with proffered plan of development as to
uses within the area proposed for C-l, Commercial, and a more general plan for development of
acreage to remain LI, Light Industrial (subject to prior proffers). The 11.4 acres rezoned C-l,
fronting on Route 29 North, were subject to the special use permits filed concurrently and
approved with conditions (see below). Proffers include:
1) acceptance of applicants proffer [proffered plan of development as to uses within the area
proposed for C-1, Commercial and a more general plan of development for acreage to remain
LI, Light Industrial] in addition to proffers accepted under ZMA 86-02, subject to site review
and parking provisions of the Zoning Ordinance;
2) Acceptance of the applicant's proffer of a 35-foot setback from Route 29 with landscaping;
3) Acceptance of the applicant's proffer to work with staff in developing a landscaping plan.
SP 89-71 - Approved by BOS September 20, 1989, for the location of a skating rink in
accordance with Section 22.2.2.1 of the Zoning Ordinance. The Board approved this request
with the condition that location and size are subject to ZMA 89-08. The Special Use Permit
approval has expired.
SP 89-72 - Approved by BOS September 20, 1989, for the location of a motel in accordance
with Section 22.2.2.7 of the Zoning Ordinance. The Board approved this request with the
condition of a maximum of 144 units in a location consistent with ZMA 89-08. The Special Use
Permit approval has expired.
SP 89-73 - Approved by BOS September 20, 1989, for the location ora drive-through bank in
accordance with Section 22.2.2.10 of the Zoning Ordinance. The Board approved this request
with the condition that location and size are subject to ZMA 89-08. The Special Use Permit
approval has expired.
ZMA 94-21 - Approval by BOS March 15, 1995, to amend the previous proffers of ZMA 89-08
to allow all uses permitted by-right in the C-1 Commercial District, subject to the following
proffers:

Proffer to maintain Route 29 entrance at present Forest Lakes crossover;
Proffer that a minimum 50 foot right-of-way shall be reserved for dedication upon request of
Albemarle County. Such right-of-way shall allow for connection of Route 29 and route 649.
Access to adjoining parcels may be required at time of site plan or subdivision review.
Comprehensive Plan: This area is recommended for Regional Service in the Land Use Plan,
and lies within the Community of Hollymead. In Table I: Non Residential Land Use Guidelines
on page 31 of the Plan, the Purpose/Intent of the Regional Service designation is described as,
"Comparison shopping and specialized goods and services." Table I describes Typical Primary
Uses as, "Community service uses, plus: Major department store - Auto dealer - Mobile home
sales - Motel/hotel - Hospital."
The Land Use Plan contains a number of specific recommendations related to the Route 29
Corridor in the Community of Hollymead Profile (pp. 78-81), in the area designated Regional
Service located to the south of the Airport Road intersection and across from Forest Lakes North:
* Hollymead is intended to be a mixed use community that allows people to live in close
proximity to their workplace, shopping and service areas. A wide variety of housing types,
service and jobs are anticipated. Community-wide automobile dependence should be reduced by
encouraging transit-oriented development and providing a full range of pedestrian and bi cycle
facilities suchas walkways and bike paths that connect the residential and transit nodes to the
employment/shopping and service areas.
*Provide linkage between neighborhoods within the Hollymead Community (including non-
residential areas) through the use of pedestrian and bicycle facilities, greenways/linear parks,
roads, and transit alternatives. The emphasis is on linkage between development areas, not just
within each development.
*Development plans along Route 29 North are to be sensitive to its status as an Entrance
Corridor Roadway.
, The Regional Service area on the West side of Route 29, South of Airport Road (opposite
Forest Lakes North and cemetery), shall be limited to three entrance locations on Route 29.
*Development along Route 29 North is to have controlled access to the roadway. This can be
accomplished through joint entrances, collector roads parallel to 29, and roads internal to the
development.
* Develop alternative modes of transportation to serve the Hollymead Community, particularly
large employment generating areas. This may be accomplished through the partnership between
developers of large employment generating areas and the Metropolitan Planning Organization
STAFF COMMENT:
In making its recommendation for all Special Use permits, staff addresses the provisions of
Section 31.2.4.1 of the Zoning Ordinance.
The Board of Supervisors hereby reserves unto itself the right to issue all special use
permits permitted hereunder. Special use permits for uses as provided in this ordinance
may be issued upon a finding by the Board of Supervisors that such use will not be of
substantial detriment to adiacent property,
This site lies within a designated development area, and in fact already is zoned for commercial
development. It is surrounded by property that either is similarly zoned C-1 or designated for
Regional Service, Office Service, or Industrial Service, respectively, pending future rezoning.
Depending upon the specific types of development that occur adjacent to the site and/or within
the larger Community, the proposed hotel may constitute a supporting or primary use. In either
case, no detriment to adjacent property is anticipated from the hotel use itself.
However, a Comprehensive Plan Amendment (CPA) request to change the designation of the
residue of this parcel (located immediately to the west of this site) has been submitted by the
same applicant, and in the opinion of staff approval of this special use permit should be deferred
until the CPA has been acted upon by the Commission. The Commission will first decide
whether the CPA request should be scheduled for public hearing, after which the CPA itself will
be considered. If the CPA moves forward, staff may suggest an increase in the area requested
for amendment to include adjacent acreage that in the opinion of staff should incorporated in the
review. The CPA first comes before the Commission December 8, in the form of a Resolution of
Intent.
Approval of this special use permit, which is anticipated to be followed by site development [by-
right], could inadvertently constrain master planning of the larger commercial area. This site,
along with the neighboring property to the south designated for Regional and Office Service, and
to the west designated for Industrial Service (that area requesting amendment to Regional
Service), constitute one of the largest undeveloped commercial areas currently designated within
the Community of Hollymead and Albemarle County. Therefore, staff urges the Commission to
fully utilize this opportUnity to plan ina comprehensive manner.

Until recommendations are developed for the area as a whole, it is difficult to accurately analyze
the impact of a hotel in this location on the character of the district. It is clear that demand exists
for additional commercial acreage, converting it from industrial usage, but because this request
has not yet undergone public review, staff has no information regarding design standards, site
planning, road network, drainage and water detention, orientation of the development (e.g., to
Route 29 versus an internal orientation) or other issues that would determine the appropriateness
ora hotel on this site. (Although the applicant's consultant has prepared a traffic study and
submitted it to VDOT for review, no comments have been received to date and thus
transportation requirements are still largely unknown.) Staff does not find that the hotel use
would negatively affect the character of the district, but cannot make a recommendation for
approval on this site without more information on the commerci al area as a whole. For example,
a full service hotel providing meeting facilities for the neighborhood, one or more restaurants,
and larger capacity might better meet the needs of the Community as described in a [future] Plan
Amendment than this request, which contemplates a limited servi ce facility.

Staffhas reviewed the purpose and intent of the ordinance as stated in Sections 1.4, 1.$, and 1.6.
Staff finds that the proposal meets the purpose and intent expressed in the following provisions:

and the Urban Area ... and development is not to be encouraged in the
Rural Areas..."
However, without the benefit of a plan for the area as a whole, staff finds that the proposal does
not demonstrate that it meets the intent of the following provisions:

relation to the community facilities existing or available,

area. Similarly, it is difficult to ascertain if the hotel use as conceived by this application best fits
the area as a whole.

Staff cannot identify any adverse effects to the public health, safety, and general welfare that will
occur if the limited service hotel use is approved. Staff notes that the applicant must comply
with the Site Development Plan requirements set forth in Section 32.0 of the Zoning Ordinance,
and that little or no information is available on the siting of this facility due to the timing of this
request relative to review of the area as a whole under the submitted CPA.
SUMMARY:
The hotel use does not appear to create negative impacts to the Community of Hollymead,
although it presently is not clear whether a limited service concept is appropriate for a
commercial area as large and significant as this one. Staff s objection to approval of this request
centers on questions of process: with questions about the land use designation of the
surrounding, larger parcels coming before the County in the very near future, it would be unwise
to impose limitations on future development by prematurely approving a use of substantial size
like this one.
RECOMMENDED ACTION:
Staff recommends denial of the special use permit request, based on the premature timing of this
application relative to the CPA request. Should the Commission find in favor of this request,
staff recommends the following conditions of approval:

All of our fund raising is conducted in this building. If it were not for this hall, we could not survive as a
fire company.
Since we are lOcated in an area that is surrounded by private homes and subdivision, we monitor the
activity very closely. We control the noise and any other activity that would create a disturbance. There
has been no major problems or complaints from our neighbors. On any of the functions that we deem
necessary, we have an Albemarle County Deputy sheriff on premises.~The only complaint that we know
of was the actiVating the vehicle sirens coming out of the building. After the complaint, this action was
stopped until the vehicle reaches Rt. 250. No complaints have been received since this corrective action
was taken.

Applicant's Proposal:
The applicant is proposing to amend SP 96-50 to allow for fundraising events, such as,
raffles, auctions, community functions, dances, etc., in the existing Scottsville Volunteer
Rescue Squad building.
Petition:
Proposal to amend an existing Special Use Permk (SP 96-50) to allow fundraising
events in the existing Scottsville Volunteer Rescue Squad building (Attachment A) The
site is 9.738 acres Zoned RA, Rural Areas. This property, described as Tax Map 130
Parcel 7B, is located on Route 6 (Irish Road) at the intersection of Route 6 and 737
(Mountain Vista Road) in the Scottsville Magisterial District (Attachments B & C). The
property is not in a designated Development Area of the Comprehensive Plan.
Character of the Area:
This site fronts on Route 6 and Route 737, which is a gravel road. Several dwellings are
located on the east side °fRoute 737 near this site. The predominant land use in the area
is agriculture/pasture and 'rural residential.
RECOMMENDATIION: Staff recommends approval with conditions of the requested
amendment to SP 96-50.
Planning and Zoning History:
SP 96-50 for Scottsville Volunteer Rescue Squad was approved by the Board of
Supervisors on February 19, 1997 for construction of a rescue squad station. The
approval, however, was subject to the condition that "subordinate uses and fund raising
activities such as, but not limited to, bingo, raffles and auctions shall require amendment
of this special use permit." (Attachment D)

This area is located in the Rural Areas of the Comprehensive Plan. The Comprehensive
Plan does not contain any comment regarding this type of activity (fund raising events in
community facilities).
STAFF COMMENT:
Staffwill address each provision of Section 31.2.4.1 of the Zoning Ordinance.
The Board of Supervisors hereby reserves unto itself the right to issue all special
use permits permitted hereunder. Special use permits for uses as provided in this
ordinance may be issued upon a finding by the Board of Supervisors that such use
will not be of substantial detriment to adjacent property.
Staff has visited the site and is of the opinion that impact on the surrounding uses will
primarily be from increased traffic during these events. Staff estimates that during a
worst case scenario week the site will generate approximately 400 vehicles trips per
week. This includes the one major event each week, the general membership meeting, the
board of directors meeting, and the daily day and night shift staff. Access to the site is
from Route 6 with no entrance onto Route 737. The request will increase the number of
vehicle trips to over 350 vehicle trips per week. The County Zoning Ordinance requires
the parking area to be paved if the vehicle trips per week exceeds 350. Staff has not
viewed this impact as a substantial detriment as the impact is infrequent.

out this facility to other than a recognized non-profit organization, it would have to apply
for a special use permit to carry out such events.

Initially the Health department has limited the number of people per event to 100 with no
food or beverage served due to existing sewer capacity. Staff's primary concerns with
this request has been the ability of the septic system to sustain special events with
attendance over 100. Staff met with the applicant and an official from the Health
Department. The applicant agreed to upgrade the septic system to accommodate a 200
person event where food and drinks can be served. This can be done without expanding
the drain field. Staff feels this addresses there concerns regarding the capacity noted in
the Health Department comments (see attachment F).VDOT's comments can be found
on Attachment G.
SUMMARY:
Staff has identified the following factor(s) which is favorable to this request:
i. This request will allow the Scottsville Voluntary Rescue Squad an additional means to
raise money to repay construction loans and for other operational purposes.
Staff has identified the following factor(s) which is unfavorable to this request:
1. This request has the potential to generate increased traffic volume during events,
however, Route 6 is a primary road adequate to accommodate the increased traffic.
RECOMMENDED ACTION:
Staff recommends approval of this request subject to the following conditions:
1. Any fund raising activity shall be conducted in an enclosed building only.
2. Noise generated from such activity shall not exceed forty (40) decibels at the nearest
agricultural or residential property line.
3. Approval is limited to no more than four major events per mOnth, with no more than
two of those permitted to be events not sponsored by the rescue squad.
4. Tb.e Scottsville Volunteer Rescue Squad cannot rent the facility to any organization that
is not exempted from Article 2 Division 1 of the County Code for fundraising purposes.
5. Expand the septic system to accommodate an event with 200 people and food and
drinks can be served. No fundraising event will be held until the upgrade is complete.
6. The applicant will be r&quired to pave the parking area.
7. No such activity shall be conducted between 11:00 p.m. and 8:00a. m.
8. Development shall be in general accord with the attached plan titled Scottsville Rescue

Special Use Permit application for SVFD, Inc.
The sewage disposal system is the limiting factor in determining what
applications can be allowed for the facility under the new proposed uses. The
maximum design capacity of the system is 750 GPD with an average daily-
anticipated flow of 500 GPD. Speaking with Kay Harden, the faciiity has three
bedrooms with three beds per room. On any given .week, the maximum use of
the facility would involve use of the aundry facilities (one machine), a fundraising
event, a squad meeting and a soci~.l~vent.
The laundry facilities would only be utilized for linen service with no personal use
from volunteers or othersl The squad meeting, would hold a maximum of 80
persons on a Tuesday with no meals served. Fundraising events would have a
potential of 200 persons with meals and beverages being served. Social events
such as weddings, conferences or banquets would again be used for 200
persons with food and beverages being prepared on-site. Fundraising and social
events would last no more than four hoUrs.
Design flows for an event where food and beverage is served is 10 to 50 gallons
per person. Design flows for events with no food and beverage being served
would be three gallons per person. Thus, the design flow for the staff meeting on
Tuesdays would be 240 gallons (80 persons X 3 gallons per person) while the
fundraising and social events would be a minimum of 2,000 GPD (200 persons X
10 gallons per person). A design flow of 75 gallons per person or 150'gallons

per bedroom is normally considered. Thus, a total of 450 gallons per day for
three bedrooms with two persons occupying each bedroom can be considered
for the facility. The design of the bedrooms would increase to 675 gallons/day if
three persons occupied each bedroom."
All of these numbers indicaTM that the sewage disPosal system is not
designed sufficiently for the new anticipated uses 'of the rescue squad. In
order to allow fundraising and social events On the weekends, additions to the
existing sewage disposal system are necessary.

Tuesday has a higher design flow considering the squad meeting of 80 persons.
Friday takes into account a fundraising event of 200 persons where food and
beverage is served and use of the three bedroom living quarters. Similarly,
Saturday considers a social event where food and beverage is served. All other
days show design flows for three bedroom (six persons) living quarters at the
rescue squad with laundry facilities.
Under the current permit capacity, a maximum of 100 persons per
fundraising or social event could be allowed with no food or beverage
service. Any enhanced usage beyond.this capacity would requi~e upgrades to
the sewage disposal system.
Please keep in mind that there is significant difference between design flows
from any facility and the actual flows associated with it. The use of safety factors
is common place in all aspects of en. gineering and it would be unwise to design a
system for the actual wastewater flows. A safety factor of 1.5 is being used for
the design flows cited above. Safety factors' take into account increased
wastewater strength (i.e. from preparing food on-site), potential variability in
wastewater characteristics and daily flow differences. The design flows listed in
this Memorandum do not consider actual flows, rather they depict design flows
based on the Commonwealth of Virginia Sewaqe Handlinq and Disposal
Requlations.
If Iow flush showerheads and toilets are installed, a conditional permit could be
issued to increase the design flow of the facility from 750 gallons per day to 865
gallons per day. This allows for a 15 per-cent increase in design capacity. The
Scottsville Fire Department may want to consult with a Professional Engineer to
determine if other ideas, such as flow equalization, can be implemented to allow
its proposed new use without requinng major upgrades to the existing sewage
disposal system.

Applicant's Proposal:
The applicant is proposing to construct a 2,000 square foot structure next to his new
home to accommodate his home-based business. The structure will be used for the
manufacturing of guitars.
Petition:
Proposal for a Home Occupation Class B Special Use Permit to allow the construction of
a 2,000 square foot accessory structure which will be used for the manufacture of guitars
(Attachment A). This use requires a special use permit in accord with the provisions of
Section 32.2.4.1 of the Zoning Ordinance. The property is described as Tax Map 114,
Parcel 65A1 and consists of 2.28 acres zoned RA, Rural Areas. This site is located on the
southwest side of Route 708 (Secretarys Road) approximately 1,500 feet east of Route
795 (Presidents Road) in the Scottsville Magisterial District Attachment B & C). This
area is not located in a designated Development Area of the Comprehensive Plan.
Character of the Area:
The character of the area can be described as rural. The side of the road on which the
applicant is proposing to construct his home and the garage(site of his proposed home
occupation) is mainly vacant. There are several homes on the opposite side on the road.
This section of Secretarys Road is unpaved.
RECOMMENDATION:
Staff has reviewed this request for compliance with the provisions of Section 31.2.4.1 of

to grant a waiver. The applicant needs this size of building to store his wood. He buys
wood in bulk and it cannot be stacked. The wood has to be stacked on special drying
racks and different types of wood cannot be stacked or' stored together. The restroom is
needed for convenience and the applicant's hands must be washed frequently as to not
damage the wood. '

public health, safety and general welfare. Most of the tools used in the production process
will be hand tools. VDOT is requesting the applicant's entrance meet commercial

and deliveries that this request is not necessary. Other than material Used to finished the
wood, no hazardous material will be stored on site. The amount of thinners and varnishes
stored on site will be consistent with residential use. The Health Department has given
approval for the septic system.

unanimously recommended continuance of each of the above-noted districts for ten (10)
years.

REVIEW OF BUCK MOUNTAIN AND YELLOW MOUNTAIN AGRICULTURAL/FORESTAI,
DISTRICTS
Procedure: In conducting a review, the Board of Supervisors shall ask for the recommendations
of the local Advisory Committee and the Planning Commission in order to determine whether to
terminate, modify, or continue the district.
The Board may stipulate conditions to continue the district and may establish a period before the
next review of the di strict, which may be different from the conditions or period established
when the district was created. Any such different conditions or period must be described in a
notice.sent to landowners in the district, and published in a newspaper at least two weeks prior to
adoption of the ordinance continuing the district.
Unless the district is modified or terminated by the Board of Supervisors, the district shall
continue as originally constituted, with the same conditions and period before the next review
(10 years) as were established when the district was created.
When each district is reviewed, land within the district may be withdrawn at the owner's
discretion by filing a written notice with the Board of Supervisors at any time before the Board
acts to continue, modify, or terminate the district.
Purpose: The purpose of an agricultural/forestal district is "to conserve and protect and to
encourage the development and improvement of the Commonwealth's agriculmral/forestal lands
for the production of food and other agricultural and forestal products..." and "to conserve and
protect agricultural and forestal lands as valued natural and ecological resources which provide
essential open space for clean air sheds, watershed protection, wildlife habitat, as well as for
aesthetic purposes."
Factors to Consider:
The following factors must be considered by the Advisory Committee and at any public heating
when a proposed district is being considered:
The agricultural and forestal significance of land within the district and in areas adjacent
thereto;
The presence of any significant agricultural lands or significant forestal lands within the
district and in areas adjacent thereto that are not now in active agricultural of forestal
production;
o
The nature and extent of land uses other than active farming or forestry within the district
and in areas adjacent thereto;
4. Local development patterns and needs;
5. The Comprehensive Plan and, if applicable, the zoning regulations;
o
The environmental benefits of retaining the'lands in the district for agricultural and
forestal uses; and
7. Any other matter which may be relevant.
Effects of a District:
1. The proposed district provides a community benefit by conserving and protecting
farmlands and forest; environmental resources such as watersheds, air quality, open
space, and wildlife habitat; and scenic and historic resources.
The State Code stipulates that the landowner receive certain tax benefits*, and restrictions
on public utilities and government action (such as land acquisition and local nuisance
laws) to protect the agricultural/forestal use of the land. In exchange, the landowner
agrees not to develop the property to a "more intensive use" during the specified number
of years the district is in effect.
*Since Albemarle County currently permits all four categories of use value assessment, a district
designation may not provide any additional real estate tax deductions. Land in a district is
protected from special utility assessments or taxes.
o
The State Code stipulates that, "Local ordinances, comprehensive plans, land use
planning decisions, administrative decisions and procedures affecting parcels of land
adjacent to any district shall take into account the existence of such district and the
purposes of this chapter." The district may have no effect on adjacent development by
right, but could restrict proposed rezonings or uses by special use permit which are
determined to be in conflict with the adjacent agricultural/forestal uses. Districts must
now be shown on the official Comprehensive Plan map each time it is updated.
In general, a district may have a stabilizing effect on land use. The property owners in
the district are making a statement that they do not intend to develop their property in the
near furore, and that they would like the area to remain in the agricultural and forestal
uses. Adjacent property owners may be encouraged to continue agricultural uses if they
do not anticipate development of adjacent lands.
BUCK MOUNTAIN DISTRICT
Buck Mountain District was created on January 4, 1989 for a time period often years. One
addition has occurred in the district during the ten year period, in 1995.
Location: Buck Mountain District is located on both sides of Route 671 (Davis Shop Road), and
on the southwest side of Route 664 (Markwood Road).
Acreage: The Buck Mountain District contains 649.942 acres in 8 parcels.
Time Period: The time period for Buck Mountain District is 10 years.
Agricultural and Forestal Significance' Land in the district is being used primarily for pas. ture,
forestry, grasslands, and hay crops.
..Significant Land Not in Agricultural/Forestal Production' The use value taxation program is a
good indication of the actual use of the properties. Approximately 295 acres are being used for
agriculture, 142 acres are being used for forestry, 12 acres are non-qualifying because of
dwellings or other reasons, and 211 acres are not enrolled.
Land Use other than Agriculture and Forestry: There are 4 dwellings in the Buck Mountain
District.
Local Development Patterns and Need,q: The Buck Mountain area has scattered residences and
larger acreages. Free Union Agricultural/Forestal District lies ½ mile to the west and south.
Comprehensive Plan and Zoning Regulations: The Buck Mountain District is located within the
Rural Area of the Comprehensive Plan and is zoned RA, Rural Areas. The nearest development
area is the Hollymead Community, a distance of about six miles.
A Comprehensive Plan objective is "All decisions concerning the Rural Areas shall be made in
the interest of the four major elements of the Rural Areas, with highest priority given to
preserving agricultural and forestal activities rather than encouraging residential development."
(p.203). A strategy is to "Actively promote and support voluntary techniques such as
agricultural/forestal districts .... "(p. 53)
The Open Space Plan shows this area designated as important 'farmlands and forests. A major
stream valley traverses through several properties in the district. Buck Mountain is
recommended for protection as a mountain resource above the 900 foot contour.
Environmental Benefits: The district lies within the South Fork Rivanna River reservoir
watershed. Conservation of the wooded areas also protects groundwater quality, wildlife habitat
and critical slopes.
Staff Recommendation: Staff recommends continuation of the district for a ten year time period.
As of December 2, 1998 one request for withdrawal from the Buck Mountain District (Gibson)
had been submitted.
Advisory Committee Recommendation: The Advisory Committee unanimously recommended

the continuation of the district for a ten year time period. The committee further recommended
that the Gibsons be allowed to rejoin the district before the review gOes before the Board of
Supervisors, if they desire to.
YELLOW MOUNTAIN DISTRICT
Yellow Mountain District was created on March 8, 1989 for a time period often years. A by-
right withdrawal occurred in 1996 following the death of a property owner.
Location: Yellow Mountain District is located near the intersection of Interstate 64 and 'Route
250 West and along .State Routes 637 (Dick Woods Road), 692 (Plank Road), and 691 (Ortman
Road) in western Albemarle.
Acreage: The Yellow Mountain District contains 704.253 acres in 17 parcels.
Time Period: The time period for Yellow Mountain District is 10 years.
Agricultural and Forestal Significance: Land in the district is being used primarily for forestry
and livestock.
Significant Land Not in Agricultural/Forestal Production: The use value taxation program is a
good indication of the actual use of the properties. Approximately 374 acres are being used for
agriculture, 306 acres are being used for forestry, and 24 acres are non-qualifying because of
dwellings and other reasons.
Land Use other than Agriculture and Forestry: There are 22 dwellings in the Yellow Mountain
District. A private campground facility lies adjacent to the district on Route 250, Wavertree
Hall PUD lies adjacent on the south side of Route 692 and the Castleberry Court subdivision lies
adjacent on the south side of Route 250.
Local Development Patterns and Needs: The Yellow Mountain area has scattered residences on
farms and large acreages.

area is the Crozet Community, a distance of about two miles east.

Oaks, which is on both the National Register of Historic Places and the Virginia Landmark
Register, is in the district. Yellow Mountain is recommended for protection as a Mountain

watershed. Environmental benefits provided by the conservation of wooded areas include
protection of ground and surface water quality, wildlife habitat and cr/ticaI slopes. Route 250

As of November 20, 1998 no requests for withdrawal fi.om the Yellow Mountain District had
been submitted.
Advisory Committee Recommendation' The Advisory Committee unanimously recommended
the continuation of the district for a ten year time period.

Agricultural/Forestal Advisory Committee Meeting Minutes
November 30, 1998
Stephen Murray, Chair, called the meeting to order at 7:35 p.m. Other members present
Were Joseph Jones, Vice-Chair, Walter Perkins, David vanRoijen, Rosemary Dent,
Robert Bloch, Sherry Buttrick, and Jacquelyne Huclde. Staff member present was Mary
Joy Scala,. Sen/or Planner. Members absent were Bruce Hogue, and Bruce Woodzell.
Addition to Carter's Bridge District
staff presented the staff report recommending the Addition to Carter's Bridge District.
Staff noted that the property owner requesting the addition currently has property in the
district and that he is engaged in active forestry.
Mr. vanRoijen asked why the owner was adding the parcel at this time. He also asked
why there were several additions proposed at the same time. He was interested since the
Committee had previously talked about incentives to encourage property owners to join a
district.
Staff replied that the property owners had probably received notices during the recent
reviews of the Carter's Bridge, Lanark and Panorama Districts and had then decided to
add on. Staff explained that the review process for Additions to Districts and new
Districts, is longer than for Reviews of Districts, meaning they cannot be done
simultaneously.
The Chair 'asked for the soils report and staff noted it had not been received.
Ms. Huckle moved to recommend approval of the Addition to Caixer's Bridge District as
proposed.
Mr. vanRoijen made a second to the motion.
The committee voted unanimously to recommend approval of the Addition to Carter's
Bridge District.
Addition to Lanark District
Staff presented the staff report recommending the Addition to Lanark District.
Mr. vanRoijen asked a question about the land use of the property. Staff replied that it is
enrolled under the forestry category, and that there is one dwelling on the property.
Mr. Jones made a motion to recommend approval of the Addition to Lanark District.
Mr. Bloch made a second to the motion.
The committee voted unanimously to recommend approval of the Addition to Lanark
District.
Addition to Panorama District
Mr. Murray remained Chair during the discussion, but stated that he did not intend to
vote on the proposed Addition, which is adjacent to his farm.
Staff presented the staff report recommending approval of the Addition to Panorama
District. Staff noted that Panorama Farm had been withdrawn from the District during
the last review. Now, the Pdviere Farm forms the core of the 'District, with proPerty in
Ardwood (which is held under conservation easement) also in the District.
There was discussion about the property in Ardwood.
Mr. vanRoijen asked if there is a minimum acreage requirement to join an agricultural
district. Staff said there is not; the County has a policy of not accepting subdivision lots.
Staff noted that the proposed Addition to Panorama consists of a seven- acre parcel,
within a mile of the core, not in a subdivision, not enrolled in land use, and with no
development fights. The property is wooded.
Mr. Perkins asked if the parcel could qualif7 for land use by joining the district. Staff
replied that it could not because it did not meet the acreage requirements. Both open
space and forestry require 20 acres.
There was discussion about the intent of the property owner. Staff said the applicant
wanted the area to remain rural, and was concerned about the future of Panorama Farm.
Staffnoted that it was hoped that Panorama Farm would rejoin the district at some point.
Ms. Huckle and Mr. Jones agreed that if the proposed addition meets the criteria, it
should be allowed to join.
Mr. vanRoijen made a motion to recommend approval of the Addition to Panorama as
proposed.
Ms. Dent made a second to the motion.
The committee voted 7-0-1 to recommend approval of the Addition to Panorama.
Mr. Murray abstained.
..Review of Buck Mountain District
Staff presented the staff report recommending the continuation of the Buck Mountain
District for ten years. Staffnoted that the Gibsons requested withdrawal.
Mr. Jones asked Ms. Buttrick if she knew the Gibsons. She did, and said she would try to
find out why they want to withdraw.
Ms. Buttrick said if they are older, and may be lapsing on the agricultural use, it would be
good to be in the district so that they could continue to receive land use.
Mr. vanRoijen said there needs to be a simple explanation available to people so they
could understand the rules; the current explanation is complicated.
Ms. Buttrick said she would call about the Gibsons.
There was discussion whether the Gibsons could add back in. Staff said they could add
back in until the Board hearing date. The Committee's motion could reflect this.
Ms. Buttrick made a motion to continue the district for ten years, with the provision that
if Tommy [Mr. Gibson] wants to come back in before the Board meeting he can.
Mr. vanRoijen made a second to the motion.
The committee unanimously voted to recommend continuing the Buck Mountain District
for ten years, with the provision about Mr. Gibson coming back in as stated in the
motion.
Review of Yellow Mountain District
Staff presented the staff report recommending the continuation of the Yellow Mountain
District for ten years. Staff noted that the heirs of Greenwood Farm had withdrawn upon
the death of the property owner, and it left a large gap in the district.
Ms. Buttrick noted that Seven Oaks Farm had been sold, and that the new property, owner
should be contacted.
There was discussion about who are the owners of certain properties.
Mr. vanRoijen asked if realtors have to disclose that a property, is enrolled in an
agricultural and forestal district. It was believed that they do not.
Staff noted that there has been interest from adjacent property owners in joining this
district.
Ms. Buttrick made a motion to recommend that the Yellow Mountain District be
continued for ten years.
Mr. Bloch made a second to the motion.
The committee unanimously voted to recommend continuing the Yellow Mountain
District for ten years. -
Discussion on how to encoura,~e landowners to 'oin/remain in a district
Ms. Scala told the committee that she had no prepared report, but asked if the Committee
wanted to continue the discussion from its previous meeting.
Mr. vanRoijen talked about more strict enforcement of land use. He wondered why we
don't make use of the open space easement (located in the land use tax handbook) for
property owners who needed more flexibility than an agriculturalfforestal district. He
suggested that property owners should be able to show that they have made a certain
incom.e from ,f,~a~ning, o..~e .r?se they could not qualify for land use tax unless they joined
an agnculturavtorestal d~stnct or s~gned an open space agreement. He said that o~her
counties have to show tax records, production records, etc. to get land use taxation.
Shenandoah County hired someone specifically to tighten the land use program.
Mr. Perkins said if land stays green for one more year then we get a benefit.
The consensus seemed to be against Mr. vanRoijen's suggestion; it was thought that it
· was not an incer~tive~
Ms. Bu/trick asked if the County has any latitude in its policies to provide greater
protection from adjacent properties? beef it up a little. She also suggested that the
brochure be updated and beautified. Say how you can get in and get out of a district - the
brochure is convoluted fight now. She also suggested inviting Jim Riddell from Louisa
County to speak to the group.
Mr. Jones said that the tax base should be taken offreaI estate and put on income.
Mr. Perkins agreed. He said the farmer gets taxed on his land, then gets taxed on his
income.
The meeting adjourned at 8:40 pm.

One of our five legislative priorities, requesting state funding for Purchase of
Development Rights programs, has found a champion in the full Moss Commission on
the Environment! Yesterday the commission made several recommendations that will
further our PDR program. I think we should move quickly to commend the Commission
and request that our local delegation support the recommendations. Do you agree?
Recommendations include:
(1) Appropriate $40 million to the Virginia Conservation and Recreation Foundation
(which G.A. established several years ago but never funded), and extend the
Foundation's powers "to provide matching grants to local governments for local
farmland and open space programs."
(2) Waive capitol gains tax income for the sale of development rights in a PDR program
which dedicates the land or easement to an open-space use.
(3) Provide an income tax credit for a portion of value of conservation easement
donations - a program used in North Carolina and estimated there to out-weigh any
lost tax revenue at a 12:1 ratio.
(4) Clarify that the powers of Recreational Facilities Authorities include those related to
conservation easements and open space. [VVe Planned to make use of our Rec
Facilities AuthOrity in our PDR program.]
(5) Clarify in the code that tax increment financing may be used for open space.
(6) Provide executors with discretionary authority to put land in conservation easement
status in order to obtain benefit of an estate tax exclusion now allowed under the
Internal Revenue Code..
The stated purpose of these steps is to: "(a) provide substantial incentives for private
land conservation efforts; (b) provide additional mechanisms for local funding of open
space activities; and (c) provide funding for immediate needs for land preservation and
acquisition."
As many of these recommendations seem almost custom-desiqned to fit our legislative
request, a quickly adopted resolution would be appropriate and may help with their
acceptance in Richmond. If you agree, we should move on it at tomorrow's meeting.

unakimously supported the recommendations of the Moss Commission on the Future of
Virginia's Environment. For your information, Albemarle County has appointed a citizen's
committee which is developing a program for the Acquisition of Conservation Easements
("ACE" program) within the County of Albemarle. Our Albemarle County program is designed
to be a model for other counties throughout the Commonwealth.
The need for such a program in Albemarle County stems from a clear trend of our losing
rural land, with existing regulatory and voluntary programs not being sufficient to counter the
trend. Examples of our loss include the fact that, at present, 31.7 percent, or 89,208 of
Albemarle County's 283,652 acres of forest land is considered too densely populated for long-
term timber production. "
In addition, in Albemarle County, 25,000 acres of farmland were lost from 1974-1992,
and 12,898 acres in the decade from 1982-1992. The number of farrns in the county fell by 58
percent, although they still brought in more than $15.0 million to the County's economy. During
that time, 18,000 acres have been voluntarily placed in'conservation easements.
Based on the above facts, the Albemarle County Board of Supervisors supports the draft'
legislation identified by the Moss Commission. We specifically applaud the following drafted
legislation mad urge that you join in its sponsorship.

and Recreation Foundation budget, especially as it may be used for matching grants to localities.
This last-mentioned budget amendment is of particular importance to our County, since we have
committed approximately $1.0 million per year, almost one percent of our budget, for acquiring
conservation easements. A matching grant would involve the Commonwealth as a partner in this
crucial program.

Traffic, Article 3. Traffic Signs, Lights and Markings; Section 46.2-833.01. Liabili~ for failure
to-comply with traffic light signals; sign pilot program in certain localities to install and
operate traffic light signal photo-monitoring systems.
This section is scheduled to expire on July 1, 2000, therefore, it is likely that legislation will be
introduced in 1999 or 2000 to extend this expiration date. Our Chief of Police has recently
requested the Virginia Department of Transportation to explore the possibility of adding these photo
monitoring systems at certain intersections in Albemarle County. We would like to have the
enabling legislation in place so that we can implement this traffic safety program as soon as
possible. A copy of Section 46.2-833.01 is attached for your information.

46.2-833.01. Liability for failure to
comply with traffic light signals; sign
pilot program in certain localities

2000 >
A. The governing body of any city having a
population of more than 390,000, any city
having a population of at least 200,000 but less
than 225,000, any county having the urban
county executive form of government, any
county adjacent to such county, and any city or
town adjacent to or surrounded by such county
except any county having the county executive
form of government and the cities surrounded
by such county may provide by ordinance for
the establishment of a demonstration program
imposing monetary liability on the operator of a
motor vehicle for failure to comply with traffic
light signals in such locality in accordance with
the provisions of this section. Each such
locality may install and operate traffic light
signal photo-monitoring systems at no more
than twenty-five intersections within each
locality at any one time.
B. The operator of a vehicle shall be liable for
a monetary penalty imposed pursuant to this
section if such vehicle is found, as evidenced by
information obtained from a traffic light signal
violation monitoring system, to have failed to
C. Proof of a violation of this section shall be
evidenced by information obtained from a
traffic light signal violation monitoring system
authorized pursuant to this section. A
certificate, sworn to or affirmed by a technician
employed by a locality authorized to impose
penalties pursuant t° this section, or a facsimile
thereof, based upon inspection of photographs,
microphotographs, videotape, or other recorded
images produced by a traffic light signal
violation monitoring system, shall be prima
facie evidence of the facts contained therein.
Any photographs, microphotographs, videotape,
or other recorded images evidencing such a
violation shall be available for inspection in any
proceeding to adjudicate the liability for such
violation pursuant to an ordinance adopted
pursuant to this section.
D. In the prosecution of an offense established
under this section, prima facie evidence that the
vehicle described in the summons issued
pursuant to this section was operated in
violation of this section, together with proof that
the defendant was at the time of such violation
the registered owner of the vehicle, shall
constitute in evidence a rebuttable presumption
that such registered owner of the vehicle was the
person who committed the violation. Such
presumption shall be rebutted if the registered
owner of the vehicle (i) files an affidavit by
regular mail with the clerk of the general district
court that he or she was not the operator of the
vehicle at the time of the alleged violation or (ii)
testifies in open court under oath that he or she
was not the operator of the vehicle at the time of
the alleged violation. Such presumption shall
also be rebutted if a certified copy of a police
report, showing that the vehicle had been
reported to the police as stolen prior to the time
of the alleged violation of this section, is
presented, prior to the return date established on
the summons issued pursuant to this section, to
the court adjudicating the alleged violation.

does not mean a vehicle rental or vehicle leasing
company. For purposes of,this section, "traffic
light signal violation-monitoring system" means
a vehicle sensor installed to work in conjUnction
with a traffic light that automatically produces
two or more photographs, two or more
microphotographs, a videotape, or other
recorded images of each vehicle at the time it is
used or operated in violation of this section.
F. Imposition of a penalty pursuant to this
section shall not be deemed a conviction as an
operator and shall not be made part of the
operating record of the person upon whom such
liability is imposed nor shall it be used for
insurance purposes in the provision of motor
vehicle insurance coverage. No monetary
pen~alty imposed under this section shall exceed
fifty dollars nor shall it include court costs.
H. In any action at law brought by any person
or entity as the result of personal injury or death
or damage to property, such evidence derived
from a photo-monitoring system shall be
admissible in the same method prescribed as
required in the prosecution of an offense
established under this section without the
requirements of authentication as otherwise
required by law.
I. On behalf of a locality, a private entity may
not obtain records regarding the registered
owners of vehicles which fail to comply with
traffic light signals. A private entity may enter
into an agreement with a locality to be
compensated for providing the traffic light
signal violation monitor system or equipment,
and all related support services, to include
consulting, operations and administration.
However, only an employee of the locality may
swear to or affirm the certificate required by
subsection C.
G. A summons for a violation of this section
may be executed pursuant to § 19.2-76.2.
Notwithstanding the provisions of § 19.2-76, a
summons for a violation of this section may be
executed by mailing by first-class mail a copy
thereof to the address of the owner of the
vehicle as shown on the records of the
Department 'of Motor Vehicles. If the
summoned person fails to appear on the date of
return set out in the summons mailed pursuant
to this section, the summons shall be executed
in the manner set out in § 19.2-76.3. No
proceedings for contempt or arrest of a person
summoned by mailing shall be instituted for
failure to appear on the return date of the
summons.

Dear Ms. Tucker,
As we discussed on January 6,1999, I would like to recommend a pilot program for your consideration to photograph
license plates and take pictures of motorists who run red lights. Similar programs across the country are proving effective
when drivers catch on that this technology exists.
According to the Insurance Institute for Highway Safety drivers who mn red lights are responsible for an estimated
260,000 crashes each year. About 750 of these are fatal, and the number is rising. Noncompliance with traffic signals in
Albemarle County is a substantial problem. Between January 1,1998 and September 30, 1998, we had a total of 45 motor
vehide crashes at the intersections of Route 29 & Rio Road; Route 29 & Greenbrier Drive; and Route 250E & Route 20.
Efforts to promote traffic law compliance at these intersections are constrained by limited resources, which have been
declining in relation to the number of vehicles on the road. Other factors associated with traditional enforcement methods
require police officers to follow a violating vehicle through a red light to stop it. This action, plus pursuit in areas of high
vehicle density, can endanger motorists, pedestrians, and our officers.
Red light cameras increasingly are being used to help communities enforce traffic laws by automatically photographing
vehicles whose drivers deliberately mn red lights. A red light camera system is connected to the traffic signal system and to
sensors buried in the pavement at the crosswalk or stop line. The camera system continuously monitors the traffic signal, and
the camera is triggered when any vehicle passes over the sensor faster than a preset minimum speed and at a specified elapsed
time after the signal has turned red. A second photograph is taken that shows the violator in the intersection. The camera
records the date, time of day, time elapsed since the beginning of the red signal, and speed of the vehicle. The use of a flash
produces clear images under a wide range of light and weather conditions. Upon review of photographi.'c evidence tickets are
issued by mail to the vehicle owner.
There are several Vkginia jurisdictions that are authorized by the state to use the red light system. The City of
Alexandria issued over 7,500 tickets in a six-month period targeting intersections throughout the city. Alexandria police have
rotated one camera weekly between three intersections. Faiffax City officials, the first in the region to install cameras after the
Virginia General Assembly passed special legislation, are now planning to add a third camera.
