As you know, FERC granted permission for hydro generation at the dam, but interestingly FERC shows it as being unlicensed by them because it falls into their category of exempted projects. I too for many years thought it was "licensed" by FERC, but in-fact it is not—it is specifically exempted from federal licensure. My student did note that FERC does require some level of safety compliance in accordance with CFR Title 18 Part 12, but it seems to be far less rigorous than what an actual licensee is required to do and what is required by the Va. Dam Safety Act for similar structures that are not hydro producers. The specificity of South Fork Rivanna River Dam NOT BEING LICENSED BY THE FEDERAL GOVERNMENT(and several others in the state) would appear to at a minimum, cause them to fall into a gray zone, but in-fact may require compliance with VA Dam Safety Guidelines since the do not meet the exemption threshold of Code of Virginia 10.1—604 (b). To be very clear, I believe that Rivanna's operators are among the best I have encountered. But as you know the performance of the dam operator is but one element in delivering a comprehensive community dam safety program. My question relates more to community compliance. Can you or your regulatory folks provide me some understanding of, if the Rivanna structure does in-fact fail the exemption test under strict interpretation of the state code because it is not licensed and the Code only exempts those dams owned or LICENSED by the federal government, whether community-wide dam safety actions related to the structure must therefore be compliant with the Virginia Dam Safety Act? My understanding is that the Va Code defines DCR regulated structures as: § 10.1-604. Definitions. "Impounding structure"means a man-made structure, whether a dam across a watercourse or other structure outside a watercourse, used or to be used to retain or store waters or other materials. The term includes: (i) all dams that are twenty-five feet or greater in height and that create an impoundment capacity offifteen acre-feet or greater, and(ii) all dams that are six feet or greater in height and that create an impoundment capacity of fifty acre-feet or greater. A 1,550 residential development is proposed 1/2 mile from the South Fork dam and -1/3 of the property is situated in the inundation zone. If approved, this development will become the nearest neighborhood to the dam and in an emergency, the first to be impacted. By way of background, the dam (Project 6841) operates in an exempt from licensing status under the Federal Energy Regulatory Commission (FERC). Therefore it is understood that the dam does not meet the definition under Virginia or federal law as being FERC "licensed" entity. The operator-the Rivanna Water and Sewer Authority is both thoughtful and exceptional in their approach to dam safety, is to be commended for their performance and frankly sets an exceptionally high bar for their dam safety professionalism. This inquiry relates to what, if any, reviews are required by state and/or federal law and/or regulation as a part of a local government decision making process for new downstream development projects that are proposed in the inundation zones of high hazard dams. To reiterate, I am not seeking clarification or expressing any concern with the impounding structure itself or impounding pond, but simply what principles should guide local decision making for development projects in the inundation zone. I understand that the Code of Virginia § 10.1-604. define the general categories of structures that are subject to regulation under the Virginia Dam Safety Act. The Act also spells out the requirements that Virginia's local governments must follow when new development is proposed in a high hazard dam break inundation zone. The Virginia Dam Safety Act further indicates where the provisions of the Chapter do not apply to five specific categories of structures, including "(b) dams owned or licensed by the United States government." Despite conflicting statements from county staff it certainly appears that the South Fork Rivanna River dam is not"licensed" or owned by the United States government, instead operating under federal permission and specifically exempt from licensing. It also seems clear that the dam does not meet the exemption thresholds of the four other categories of structures under the Virginia Dam Safety Act. On the surface it would seem that Albemarle County's downstream land use decisions should be complying at minimum with the provisions of the Virginia Dam Safety Act. Reiterating the structure is not licensed or owned by the federal government and therefore does not appear to meet the legal exemption thresholds under Virginia law. Whether intended or not, it would seem that the Department of Conservation and Recreation would be similarly required to ensure compliance in-light of current state law and regulation. I welcome clarification if this understanding is incorrect. I also understand that FERC has a compliance role related to maintenance, planning and dam break inundation zone mapping related to non-licensed dam structures operating in a FERC exempt status, such as the South Fork Rivanna River dam. I am led to believe that FERC requires these facilities to comply with CFR Title 18 Part 12. While Part 12 regulations appear to delineate safety activities relating to the structure, they are less clear in-terms of what if any assessments must be made to inform local decisions about any new development in downstream dam break inundation zones. Obviously local land use decisions in high hazard dam inundation zones cause a resulting impact on the overall safety profile of a dam. A review of the Federal Power Act and FERC's Handbook for Hydroelectric Project Licensing and 5MW Exemptions from Licensing (2004)provide a range information concerning potential dam break inundation zone development regulatory requirements such as environmental and other impact statements etc., as part of applications for new licenses or exemptions. These seem to operate under multiple federal agency review and approval authorities. It was not clear what, if any specific regime FERC uses, or expects states/localities to use, in making decisions about new developments proposed in already delineated high hazard dam break inundation zones, where FERC has some level of compliance oversight involvement. I certainly welcome clarification on this issue as well. The proposed project has many positive attributes and has the potential to be a welcome addition to our community. Unfortunately, the developer has been limited by the county and state in their pursuit of the optimal ingress/egress point for the development. In reviewing traffic impacts it became clear that during a dam break emergency much of the traffic from this property would be inadvertently funneled directly into roadways that are in the 100 year floodplain or dam inundation zones, potentially subjecting evacuees to rapidly rising waters. It would appear that these types of issues might have been identified had reviews been conducted by agencies with cognizance for dam safety. Additionally, the developer proposes grading of the site that is likely to impact and potentially modify both the 100 year floodplain and current dam inundation zones. Again, as with accessibility it's not clear to what degree, if any, the ramifications of grading in and around the 100 year flood-plain and dam inundation zone have been given sufficient attention. The hearing will take place in the auditorium of the County Office Building on McIntire Road. An Agenda for the meeting is attached. This is a decision that will impact the safety and quality of life of everyone in our community and we believe that, absent strong opposition by residents, the BOS is likely to approve the rezoning and other variances the developers of Brookhill have requested at that meeting. Many of you have signed the petition that has been circulated. A small group of neighbors, from the Polo Grounds/Proffit Road area, Bentivar, Montgomery Ridge and Forest Lakes has been following this issue closely. We do not claim to speak for everyone, but based on the more than 350 signatures on the petition, we are moving forward to urge the BOS to deny the Brookhill application until a more considered transportation plan can be developed — one that does not dump more than 16,000 daily vehicle trips onto adjacent neighborhoods instead of directly onto Rt. 29N To recap, the subject area is the approximately 277 acres on the corner of Polo Grounds Road and Seminole Trail (Route 29). This area is in the County's designated growth area. Something's going to go there sooner or later. The developer is proposing to build a development over the next 10 to 20 years that includes up to 1,550 residences (a combination of single family homes, townhouses and/or condos and apartments - they do not have to be definitive at this point), a commercial area of up to 130,000 square feet(example: stores, restaurants, dry cleaner), trails, a possible elementary school, and so on. This would be the largest approved residential development in Albemarle County since 2004, and probably one of the largest ever in its history. In population, it would be comparable to Crozet or Earlysville and considerably larger than Scottsville, Madison, Ruckersville, or Lovingston. We have met with each Supervisor and we have 2 provided them with the list of issues, concerns and questions that we have. We believe that the Board of Supervisors must ask the questions that neither the Planning Commission or the County Staff has asked. Riverbend Development (the applicant) is a well-known developer in Albemarle County and Charlottesville. It has developed a number of successful projects-Whole Foods, Jefferson Theatre and the Coca-Cola Bottling Company building on Preston- among many others. That said, we still believe that the residential density is too high. Why? The main reason is because the residential and commercial traffic that it will generate is unsupportable going through other neighborhoods to get to Route 29. They propose two new roads onto rural Polo Grounds Road, a connection into the middle of Montgomery Ridge (and hence, another increase in traffic onto Polo Grounds Road), and a connector road into Forest Lakes. Of concern to us is that some of the key assumptions in the developer's traffic study are unrealistic. The study indicates that at least 16,000 vehicle trips a day would come and go from the residential neighborhood. Additionally, their study assumes that no significant volume of commercial traffic will come from outside the Brookhill boundaries, asserting that many of those businesses inside the development will be supported solely by the residents of Brookhill. This defies logic and common sense. The developer originally requested a central entrance on Seminole Trail (Route 29). Both the County and the local VDOT officials initially rejected the idea,yet VDOT's own correspondence does not state a direct "no" to this concept, and it establishes conditions whereby this could occur. At the end of the day, the County and VDOT are essentially pointing to each other as the obstacle to an entrance directly on Route 29. A simple joint decision by VDOT and the County allowing a primary entrance on Rt. 29 could eliminate most of the serious traffic concerns, including delays on Route 29 itself. We believe that if the County is going to approve such a large development it should be done right. The addition of an appropriate access to Route 29 would effectively mitigate the principal objections of the neighbors and would support the original intent of the developer. Doing this project right means taking a step back and looking at all viable implications and options without proceeding hastily, Residents that share our concerns are urged to make their views known to the Supervisors before and on November 9. You can do that in two ways. First,write directly to Supervisors; emails sent to bos(cialbemarle.org will be distributed to each member of the Board. Second, be present and, if possible, speak at the November 9 hearing. While you can register to speak at the hearing, it is preferable to sign up before the meeting. You can do so by going to the County website (www.albemarle.org). Then, go to the Board of Supervisors Home page. At the bottom of the page is a blue line that reads Click here to sign up to speak at public hearing: You will then be directed to specify "BOS" under meeting type and 11/9/2016 6:00 under date. You can always decline to speak when your name is called. Sign up for speakers opens 24 hours before the scheduled meeting, so you can sign up as of 6 pm on Tuesday, November 8. At the Planning Commission hearing in August the developer loaded the early slots with hired PR persons and consultants as well as builders,jobbers and franchisees who hope to benefit financially from the development. So, it is important that those of us with objections not be shut out of the early discussion. Sign up early! Even if you have no plans to speak, please make an effort to attend the hearing. If we have a chance to interrupt the momentum behind this project, it is essential for the BOS to see that there are sizable concerns. For whatever use it may be, I am attaching the letter that Marge and I emailed to the Supervisors this morning. Whatever you may feel about the despoiling of old growth trees, etc., it will not be useful to this effort to oppose any development of the proposed Brookhill site. Our most effective comments at this stage should focus on the impact of increased traffic on our safety, quality of life and investments in our homes and communities. Regards, Nat Howell 3 fi 2248 Polo Grounds Road 4 A Albemarle County Board of Supervisors, We write this letter to express in the strongest terms our opposition to the dumping of traffic from the proposed Brookhill development onto Polo Grounds Road (PGR) and into established and adjacent neighborhoods. Since we moved to our current rural address in 1993, this community has confronted an almost continuous barrage of developer proposals-a miniature golf concession, a major proportion of the County's soccer fields, a 40,000 sq. ft. indoor arena, and a private school-in the area of PGR we are told was designated a rural buffer between the South Fork and the north side of the road. The consequence is that this rural buffer is now highly commercialized and generating significant additional traffic on an overtaxed roadway that is increasing handling commuter traffic between points on Pantops and Stony Point Road and Seminole Trail. Throughout this challenging period I have, with several veteran colleagues, regularly opposed developments that would make a bad situation worse. In the process, two of those colleagues have passed away and I have developed mobility problems that make it impractical to navigate the auditorium and rostrum where BOS hearings are held. So, while I expect to attend the hearing, I will not attempt to speak on November 9 and will, instead express my views in this letter. What is Polo Grounds Road? A narrow two-lane rural road that was clearly engineered and built to serve the Proffit community and surrounding areas in the era of horse- drawn transportation. It has sharp, sometimes blind, curves and few stretches with enough margin to avoid ditches. When we moved here, it was gravelled and all that has been done to it since, despite an exponential increase in usage, is paving and guard rails after a fatal accident at one of the substantial embankments. Ironically, our rural community is now unsafe for children and elderly pedestrians. It has become a daily "adventure" for aging members of the neighborhood to retrieve their mail from boxes across the road. You can perhaps understand why, when we hear about sidewalks and bicycle trails proposed for Brookhill and other development areas, we cannot share the enthusiasm. Our community has long understood that the area north of PGR is zoned for development and are not surprised to see development there. What we did not anticipate, was that the County would approve the creation of s small town at the corner of PGR and Seminole Trail without any real investment in infrastructure to support it. We use the word"town" advisedly. A development of up to 1500+ units with commercial and office space can be expected to accommodate at least 5,000 residents with all the attendant personal and commercial traffic. By way of scale, the following are populations at the last official census (2010): Scottsville 566; Crozet 5,565; Earlysville 4,833; and Ruckersville 1,141. Needless to say, none of these populations is shoehorned into fewer than 300 acres without dedicated access into and out of the jurisdiction. By all means, if the proposed Brookhill development, with all of the associated "goodies" proffered, is important enough to the County, consider and include the essential infrastructure to support this new town. If it is important enough to approve its outsized populations, it is also important enough to insist on a dedicated intersection on 29N rather than relying on existing roads and neighborhoods. A decision of this magnitude, which cannot be easily undone once it is taken, merits much more serious study of traffic impacts solutions than is reflected in developer, County staff and Planning Commission decisions. During the Planning Commission hearing in August, we asked the Commission members to drive on Polo Grounds Road at night or during inclement weather when it became clear that at least some had never done so. It is essential that those determining the safety and quality of life of our communities eyeball the conditions on the ground rather than relying on lines on a map. If the Brookhill proposal is approved in its current form, we fully expect our travel times, including for emergency vehicles, will be roughly comparable to those in the horse-and-buggy era when PGR was built. The current design for Brookhill shows elaborate tunnels for the migration of salamanders, although many naturalists believe that their habitat would be destroyed by the proposed grading variance in the floodplain. We are asking for at least equal concern for the citizens who have made their homes on and around Polo Grounds Road. Although we don't have an agreement in place, we would certainly sit down with them during the site planning stage to see what opportunities might present themselves. As one of the last applications to be submitted under the previous proffer policy,this seems like one of our community's best remaining opportunities to create affordable housing at scale in a new, mixed-income development using these tools. In looking at the proposed development,we see several elements that would make this a very attractive place for our families to live. In particular,the multiple connections to jobs, shopping and other neighborhoods are vital elements of successful inclusionary housing. Opportunities for neighborhood schools and other amenities are also of substantial benefit. I realize that there may be significant adjacent neighborhood opposition to the development and I appreciate that there may be concerns about traffic. The increasing traffic on Polo Grounds Road has resulted in major mortality in recent years. On a warm spring evening the traffic will kill at least 50 (that is my actual count, probably many more) of these fine animals in a single night. We have worked with V-Dot to try to direct them with a drift fence to an existing culvert, but this effort has been essentially unsuccessful. Due to its intention to meet only neighbourhood low traffic,the Montgomery Ridge road is narrow in width and close to the front or back yards of two thirds(40 out of 61) of the houses. As such, odds of children walking, crossing, biking, and playing on the Montgomery Ridge road is much higher than other places. The Montgomery Ridge community is a natural-friendly low density residential neighborhood area. We enjoy our safe and peaceful environment within the Montgomery Ridge community, so do our kids. Our division is kids safe, and a large proportion of our households has children of pre-school or school ages.Due to its intention to meet only neighbourhood low traffic,the Montgomery Ridge road is narrow in width and close to the front or back yards of two thirds (40 out of 61)of the houses.As such, odds of children walking, crossing,biking, and playing on the Montgomery Ridge road is much higher than other places. I did not see any provision for that connection or statement that the area is reserved for dedication as a right-of-way. The area adjacent to the cul-de-sac is owned by the Forest Lakes Community Association. Absent a statement on a plat that an area is reserved for dedication or the County making a decision to exercise eminent domain to acquire the strip, the Community Association would not be obligated to sell property at the end of the cul- de-sac. I have worked in Albemarle County for 18 years and never seen the County exercise eminent domain for something like this. It would surprise me to know that the Community Association would sell a strip of land to make the connection to the adjoining property. I hope this helps to answer your question. Needless to say, neither I nor anyone I know is anxious to add yet another large development to the landscape of Albemarle County. This would not only add a tremendous amount of traffic to our roads but would cause additional overcrowding in our schools and a drain on all our resources. It is a huge development. That said, I understand that the land is in the county's growth area so no one should be surprised that Riverbend is proposing to develop the property. In looking at the preliminary drawings and hearing the discussion last night, it appears to me that it would be better to have two roads connecting Brookhill to Forest Lakes rather than one. Many of the Forest Lakes residents who attended the meeting seemed concerned about the connection at Ashwood Boulevard and the backups which might occur there. If there were two connections to Forest Lakes, this would not be as big a problem. Obviously, this would be very unpopular with Forest Lakes residents, but I do think it would work better. I hate the idea of yet another traffic light on 29. Is there any way to avoid this?The traffic issues that would come with a development of this size seem to be everyone's biggest concern. The other big fear is overcrowding of schools. I hope the Board of Supervisors will take its time and study the Brookhill development proposal with great care, making sure to exact enough in the way of proffers to cover all the additional expenses to the county, including the need for additional police officers and fire fighters, as well as improvements to Polo Grounds Road to accommodate the additional traffic.
