To be paid after staff review for public notice:
Most applications for a Zoning Map Amendment require at least one public hearing by the Planning Commission and one
public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by
publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two
fees for public notice are required before a Zoning Map Amendment may be heard by the Board of Supervisors.
The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before
the application is heard by a public body.

The following are County staff comments regarding the above noted pre-application meeting. This
meeting satisfies the requirement for a pre-application meeting prior to submittal of your zoning map
amendment application ("rezoning"). The purpose of for the meeting is summarized below:
The purposes for a pre-application meeting are to: (i)provide the applicant and the county a
common understanding of the proposed project; (ii)inform the applicant about the proposed
project's consistency with the comprehensive plan, other relevant policies, and county
regulations; (iii)broadly identify the planning, zoning and other issues raised by the application
that need to be addressed by the applicant; (iv)inform the applicant about the applicable
procedure;and(v)allow the director to identify the information the applicant must submit with the
application, including the supplemental information delineated in subsection(c). Receiving the
relevant supplemental information will allow the application to be comprehensively and efficiently
reviewed.
The following are staff comments:
(ii) Consistency with the Comprehensive Plan:
• The proposed changes to the Code of Development and the Proffers are consistent with the
Crozet Master Plan.
(iii)broadly identify the planning, zoning and other issues raised by the application that need to be
addressed by the applicant
• See attached memo from Rebecca Ragsdale concerning zoning issues/recommendations
• A closer review of the Green mall concept will need to be done when the rezoning application
comes in, as there may be issues with E911 and engineering with this design.
(iv)applicable procedures
• Community Meeting—the applicant is required by ordinance to undertake a community meeting
process as part of the review of the rezoning request. This meeting should be held, if possible,
within 30 days from the date the rezoning application is submitted, and can be held prior to the
submittal of the rezoning application. This meeting could be handled as an Open House type
meeting, where people could informally look at the changes and speak to the developer and

County staff. Adjacent property owners and neighborhoods (and the Coordinating
Reviewer/planner)should receive advance notification of this meeting (date/time/location).
• Requires submittal of ZMA
• May require ARB review
(v) Identify the information the applicant must submit with the application, including the supplemental

• Revise all relevant pages of the Code of Development for the proposed changes.
• Include revised proffers

Old Trail Village-September 16, 2013 meeting
In general, staff supports and encourages a rezoning to address updates and clarifications to
the code of development and proffers as outlined in the summary provided from the September
16, 2013 meeting. There may also be some Application Plan updates needed as a result of the
requested changes.
It is recommended that the code and proffers be updated for the entire Old Trail development,
including both existing (built-out) and future sections for ease of administration. Section 33.2.b.
addresses what signatures will be required for a rezoning:
1.Required signatures on owner-initiated application.Each owner-initiated application for a zoning map
amendment shall be signed by the owner of each parcel that is the subject of the proposed zoning map
amendment,provided that:
a.Amendments to existing proffers.An owner whose parcel is subject to proffers may apply to amend the
proffers applicable solely to the owner's parcel,provided that written notice of the application is provided
to the owners of other parcels subject to the same proffers under Virginia Code§§ 15.2-2204(H)and 15.2-
2302.However,the signatures of the owners of the other parcels subject to the same proffers shall not be
required.
b. Amendments to planned developments. An owner within an existing
planned development may apply for a zoning map amendment, and the
signatures of any other owners within the planned development is
required only if the amendment could result in or require: (i) a change
in use, density or intensity on that parcel; (ii) a change to any
regulation in a code of development that would apply to that parcel;
(iii) a change to an owner's express obligation under a regulation in a
code of development; or (iv) a change to the application plan that
would apply to that parcel.
In addition to the updates listed by the applicant, Zoning recommends these additional updates:
• Pages 3-13 can be eliminated and are not regulatory.
• Page 13-14 Illustrative only and can also be eliminated and duplicate an application plan
sheet.

• Pages 15-16 are illustrative and are not in the section of the document identified as the
code of development in the table of contents. With the update, any concepts illustrated
should be added as regulations/requirements to regulatory tables in the code.
• With proposed changes to the code of development to clarify standards for grass malls,
the standards should be moved to the regulatory section of the code of development.
Revisions to the code should address whether road frontage as it is defined in the
ordinance applies or doesn't apply in Old Trail. If the units face a grass mall/greenspace,
they should still be served by a public/private street at the rear of a lot. An "alley" is not
a private street as defined in the ordinance. The rezoning should address whether the
vehicular access meets private street standards or is a lesser standard, than alley. If a
new street standard is proposed, then the new standard should be added to Table 3 of
the Code of Development. The application plan Sheet 4 may also need to be updated.
Also, notes should be added to Table 7 as to how Sections 4.6.1, 4.6.2, and 4.6.4. of the
ordinance apply/not apply for lots in Old Trail.
• Page 17-With the update of the code, the references to the"General Development Plan"
(term no longer in ordinance) should be changed to "Application Plan".
o Application plan: The graphic depiction of a proposed development containing the
information required by section 8.5.1(e) and, within the neighborhood model district,
section 20A.4.A plan designated and approved as a general development plan for a
neighborhood model district between March 19, 2003 and October 14, 2009 is an
application plan for the purposes of this chapter. (Added 3-19-03;Amended 10-14-09)
• Unless also revised during the rezoning process, development must comply with the
Application Plan, including the plan set dated June 24, 2005, last revised September 12,
2005, or seek variations under Section 8. Sheet 2 of the Application Plan set titled
"Conceptual General Development Plan" is the only plan sheet considered "illustrative."
The note on Sheet 2 and in the code (Page 17) allows flexibility for individual lot layouts
and parking areas within blocks. Also, I believe that flexibility in location of
biofliters/stormwater management facilities is permitted without a variation
• Page 22-Are there any updates needed to clarify what pedestrian access will be
provided to the schools?
• Does Page 21 need to be updated with proposed changes to the code of development?
• Consider whether pages 35-37 of the code need to be updated.
• Application Plan-Cover Sheet 1-remove the Minimum Setbacks and Density/Floor Area
Range tables as they will be varied with the proposed changes to the Code of
Development on Pages 26 and 31.
• With updates to the storm water strategies section of the code of development, consider
whether Sheets 3 and 7 of the Application Plan also need to be updated.
