Dear Mr. Dezio:
The Board of Supervisors approved your rezoning application on January 11, 2006. Your rezoning of
.545 acres from the R-2 (Residential) Zoning District to the R-4 (Residential) Zoning District was
approved in accordance with the attached proffers dated January 11, 2006. Please refer to this document
for any future applications and requests on this property.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the property as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
· compliance with applicable PROFFERS; and
· approval of a ZONING COMPLIANCE CLEARANCE.

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or its duly authoriied agent, hereby voluntarily proffers the
conditions listed below which shall be applied to the property, ifrezoned. These conditions are proffered as a part of the requested rezoning
and it is agreed that: (1) the rezoning itself gives rise to the need for the conditions; and (2) such conditions have a reasonable relation to the
rezoning request.
Vehicular ingress and egress to and from the prope11y shall be only from TUl1le Creek
Road, and such access from Hydraulic Road shall thereafter be prohibited, if either: (1)
the primary structure on the property ceases to be used as a single family residence; or (2)
the accessory cottage is occupied as a dwelling unit.

If you intend to proffer to limit the uses of your property to some of the uses permitted within the property's proposed zoning district, the
County suggests that your proffer contain the standardized introductory language set forth below.
For Proffers that will restrict the uses of the property to certain specified permitted uses and/or those uses authorized by a special use permit
the following language is suggested:
Permitted uses ofthe property, and/or uses authorized by special use permit, shall include only the following section(s) of the
Albemarle County Zoning Ordinance in effect on (insert date of proffer), a copy of the section(s) being attached hereto;

For proffers that will allow most of the uses permitted in the zoning district, but will exclude some, the following language is suggested:

The date ofthe proffer should be the date that your application will be considered by the Albemarle County Board of Supervisors.
By including the use associate with a section number the County will be able to verify what is being proffered so that there is no dispute (e.g.,
as a result of a-typographical error) whether the proffered use was intended to be included_oLexcluded.
