Thank you for your'conditional approval' letter dated March 29,2016 on the above-referenced project. The
plans were tweaked to address your conditional items described below:
A. Stormwater Pollution Prevention Plan
1. Erosion and sediment control plan sheets 8 and 10-13 were updated to include the note in the vicinity of the
SWM facilities that reads, "proposed juniper plantings required for slopes greater than 3:1." Please note,
County Engineering provided follow-up comments on March 29,2016.To address this follow-up
correspondence a note was added to the cover sheet reading, "1,600LF of 10'wide paved path will be shown
on(future)amended road plans for Wintergreen Farm Subdivision."Another note was added to sheets 1 and
5 stating, "no canopy or understory trees shall be planted within ten(10)feet of the back of the top of the
retaining wall."As a result,sheets 1 and 5 have also been updated in the SWPPP.
B. Stormwater Management Plan
1. A professionally sealed retaining wall design has been submitted with the plans. Please note,sheet 5 was
updated per the response above to the follow-up SWPPP comment requesting the tree separation from
the wall at SWM facility A.
C. Erosion Control Plan
1. Sheets 8 and 10-13 were revised in the vicinity of the SWM facilities to read, "proposed juniper plantings
required for slopes greater than 3:1."Also note, per the response to the SWPPP comment Al,sheets 1 and 5
were also updated to include the two notes described above.

been addressed (Sec. A, B, C, D).
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1)
a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Update ESC Plan sheets 8, 10, 12: Show landscaping vegetation hardier than grass; ref. ROAD Plan sheet 6
—show/label juniper plantings required for slopes steeper than 3:1, SWM Area `A'. Also: ESC Plan, Sec. C.
2. Revise/update. Submit (2) print copies; one will be distributed to contractor at pre -construction.
B. VSMP: SWPPP: Stormwater Management Plan (WP0201500098)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is
conditionally approved.
1. Retaining Wall /SWM Area "A": Since this wall is integral to SWM facility design, we require PE -sealed
geotechnical RW design prior to WPO Approval [J. Anderson email: Mar -11, 2016, 12:40 PM]. Applicant
response [FGM E-mail, March 11, 2016 3:18 PM]: "A structural retaining wall design ... will have to
follow." Acknowledged.
2. If 8.71 Ac. of forest/protected open space are protected from future development via the plat, please be

C. VSMP: SWPPP: Erosion Control Plan (WP0201500098)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is approved
pending single revision. The erosion control plan content requirements can be found in County Code section 17-402.
1. Sheets 8, 10, 12: Show landscaping vegetation hardier than grass. Ref. ROAD Plan sheet 6 —show/label
juniper plantings required for slopes steeper than 3:1, SWM Area W. Also: Update SWPPP.
D. Mitigation Plan (WP0201500098)
The mitigation plan content requirements can be found in County Code section 17-406. Addressed.
Engineering review staff are available 2-4 PM on Thursdays, should wish to discuss project, comments, or design. Plan review
staff is available at 434.296-5832 -x3069, should you have questions.
Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request
form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash,
certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The
County's Management Analyst or other staff will prepare the forms and check for ownership and signature
information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ database
for state application processing. DEQ will review the application information based on local VSMP authority
approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest
processing, this is done electronically with the emails provided on the application. DEQ should notify applicants
with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter.
This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants
will need to request a pre -construction conference by completing a form, and pay the remainder of the application
fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be
checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County
inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading
permit will be issued by the County so that work may begin.

Thanks for your e-mail. I believe Adam has already sent you the other sheets addressing your comments, however if I am mistaken
we can provide you with these. The mitigation sheet was not included in Adam's Friday e-mail, but this will be forthcoming.
Also, in efforts to address your comments from Saturday I have attached two revised PDF sheets. One is an updated cover sheet
adding back the retaining wall note and a bold boxed note stating the requested utility contractor information. The other PDF sheet
is sheet 5. This sheet revised basin A's MWSE and now labels the floor elevations on the profiles.
If you need anything else (besides a retaining wall design & the mitigation sheet) for a WPO approval please let us know. Adam will
be happy to resend the other PDF sheets and the SWPPP.

We spoke a few minutes ago. Thanks for accepting request for landscape planting details/plant schedule (species/count)
to guide Mitigation Plan bond, installation, inspection —Sheet 16.
Also: I left voicemail re. Retaining Wall /SWM Area "A" (RW). Since this wall is integral to SWM facility design, we
require PE -sealed geotechnical RW design prior to WPO approval.
RW will be bonded with WPO since BMP cannot be built without it.
WP0201500098 sheet 4: Please add label: RETAINfNG WALL.
Sheet 5: Please provide additional TW/BW Elevations /overall RW Length.
I failed to mention requests relating to wall when we spoke, and apologize.

County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.

3. Please complete sections 8, 9, and 10.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. No comment.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Piping drainage across the WPO buffer to SWM B is not approvable. This facility should be
located on side of the stream that the drainage originates. Please adjust.
2. This plan attempts to show compliance using the new development VRRM spreadsheet; however,
the site has largely been cleared, contains at least one residence, multiple building structures,
roads, and a tennis court. "Prior developed lands" means land that has been previously utilized for
residential, commercial, industrial, institutional recreation, transportation or utility facilities or
structures, and that will have the impervious areas associated with those uses altered during a land -
disturbing activity (9VAC25-870-10). Please reanalyze and demonstrate compliance using the

redevelopment VRRM spreadsheet.
3. Please correct facility labels to correspond to the BMPs used in the VRRM spreadsheet. All 3
facilities are labeled as level II.
4. The proposed level I extended detention pond does not meet the minimum length to width ratio of
2:1, please adjust.
5. Sediment forebays cannot be included in facility capacities. Forebays fill with sediment, negating
the capacity. Please adjust.
6. Please clearly show all forest/open space areas used in your VRRM (8.71 acres). DEQ requires
that all areas that will be considered forest/open space for stormwater purposes must have
documentation that prescribes that the area will remain in a natural, vegetated state. Also, it
appears that some of your forest/open space is within the 120' VEPCO easement, which, as you
state, has been cleared and is to remain cleared. These areas cannot be used as forest/open space
in the VRRM spreadsheet as they are not in a natural vegetated state.
7. Please show and quantify limits of disturbance on plans.
8. Please change plan set and sheet titles to VSMP Plan, not WPO.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Please make the window layout of the E&SC plans a little more reader friendly for the reviewers
and contractors. This layout is very difficult to follow, particularly when dealing with 3 phases.
2. Placing sediment basin 2 within the WPO buffer does not appear to be necessary, please adjust to
outside of the buffer.
3. Please move sediment basin 3 to the east side of the stream. The WPO does not allow for piping
sediment through and across the WPO buffer to an E&SC facility on the other side of the stream.
See also SWM comment 1. This will also eliminate the need for the proposed access road winding
through the WPO buffer.
4. Please clarify what's being proposed at sediment trap 5 in Phase III. Is it realistic expect that only
half of the cul-de-sac will be completed, then removing the trap to finish?
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.

The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
