Location
Property is located south of and adjoins the City
of Charlottesville with frontage on Franklin Street.
Zoning
Property abutts A-1 zoning to the south with M-1
zoning beyond; M-1 zoning to the north. A-1 zoning to
the south and M-1 industrial and R-2 residential in the City.
Land Use
Property is presently being utilized as a Stock Market.
A mixture of commercial, residential, light manufacturing
use5are located across Franklin Street in the City to the
west; vacant land and a Contractors facility is located
to the south, vacant land to the north and Moore's Creek
and vacant wooded land to the east.
Staff Comment
This rezoning request is unusual in that it is a
request for a change from an intense zone to a much less
intense zone, many zone steps down from the existing zone.
The potential of the property is certainly not
agricultural. Because of the lands characteristics and its
location, economics and trends of development will dictate
a use more intense than the A-1 zone,
The ordinance defines a Livestock Market as a commercial
establishment and under the definition of Agricultural
under the A-1 zoning, it can be interpreted that the existing
facility is an Agricultural commercial activity.
The staff is of the opinion that the question arising
in this request is whether the timing was correct in
placing the M-1 zoning district on the parcel and adjoining
parcels, taking in full account the existing development
in the immediate area and the condition and location of
the land. The staff cannot question the validity of the
M-1 zone on this parcel. The only question that might arise
is whether or not the timing was correct.
