Dear Mr. Porteous:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, dated August 25, 2017, please be advised of the following:
• The Property is zoned Highway Commercial (HC). (See attached map) The property is
subject to the Steep Slopes Overlay Districts.
• The HC zoning of the Property permits the current use of the Property, for new and used
motor vehicle sales and service, by right.
• The Property is not subject to an approved rezoning, special exception, special use
permit or variance application, nor are there any of the noted applications pending
review/action by the County.
• However, there is currently an open zoning violation on the Property (ZV1O201600059),
which includes the need for a zoning map amendment to the "Preserved Slopes Overlay"
and the need for an approved site plan amendment. The Property remains in violation
until both of these are approved and any required improvements are made.
• If approved improvements on the Property are damaged or destroyed, the improvements
may be rebuilt in their present form.
• Copies of any approved site plans and certificates of occupancy or other documents may
be obtained from this office with a request through the department's Records Manager,
Paul Bjornsen, at pbiornsen(aD-albemarle.org.
