VA 22901 RE: SP-99-33 NGIC Access Road Tax Map 32, Parcel 5Ct Dear Mr. Muncaster: The Albemarle County Board of Supervisors. at its meeting on August 18. 1999. unanimously approved the above-noted request to permit to allow for fill in the 100 year flood plain of Herring Branch. which is a tributary to the North Fork Rivanna River. Please note that this approval is subject to the following conditions: 1. Engineering Department and VDOT approval of tìnal grading plans and culvert and road plans and computations. (This will include testing and veritìcation of the structural adequacy of the existing culvert.). Engineering Department receipt of copies of required permits from state and federal agencies for activities in the stream and floodplain. Floodplain computations and plans demonstrating no increase in the lOO year flood levels as required by Section 30.3 of the Zoning Ordinance. Engineering Department approval of mitigation plans for disturbance of the stream buffer. Engineering Department approval of an Erosion and Sediment Control Plan: Water quality measures and mitigation methods shall be provided subject to the approval of the Water Resources Manager. Vegetative mitigation methods shall be provided subject to approval by the Architectural Review Board. ') " J. 4. 5. 6. 7. Page 2 August 26, 1999 In the event that the use. structure or activity for which this special use permit is issued shall not be commenced within eighteen (18) months after the issuance of such permit. the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section. the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2) years from the date of the issuance thereof which is thereafter completed within one (1) year. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance. you must comply with the conditions in this letter.
