sidewalk shown on the road plans for Timberwood Boulevard that extend the sidewalk down from this
intersection along the stormwater facility to Route 29. The Application Plan shows three trees in this
planting strip.
• The Application Plan shows sidewalks fully surrounding the adjacent stormwater facility. The
road plans for Timberwood Boulevard show sidewalk adjacent to the stormwater facility. The
proposal shows sidewalks ending along Route 29 in conjunction with the site’s northern property line.
As a result, there is an approximately 220 foot gap of sidewalk between the intersection of Route
29/Timberwood Boulevard and the Bojangles’ site. How and when will the sidewalk be completed as
shown on the Application Plan?
3. [Section 4.12.8(e) and 4.12.10] – A shared parking agreement according to this section must
be approved prior to final site plan approval.
4. [Proffers for ZMA200100020] – Please include the improvements shown in the exhibit dated
7-18-16 and titled “Pond Viewing Area” on the revised final site plan.

Parcel 41D3 will need to be responsible for completing the sidewalk connection.
I provided the following comments to Justin Shimp:
1. [Section 4.12.8(e) and 4.12.10] – A shared parking agreement according to this section must
be approved prior to final site plan approval.
After review, it’s not clear that a shared parking agreement can satisfy the parking requirement. None
of the other shared parking spots have been constructed. Beyond the interpretation of 4.12.8(e), the
instrument recorded in D.B. 3667 refers to the language of the instrument in D.B. 3085, which says
the parking will be shared after construction is complete (see Article VI, Section 6.06 on page 13 of
the instrument in D.B. 3085).
2. [Proffers for ZMA200100020] – Please include the improvements shown in the exhibit dated
7-18-16 and titled “Pond Viewing Area” on the revised final site plan.
Because this improvement will be located on an adjacent property, the County Attorney’s office has
requested a note be added to Sheet 1 of the site plan. The note needs to document that this
improvement is provided in lieu of an on-site deck as shown on the Application Plan. The note should
read: “The improvements labeled as “Pond Viewing Area” on Sheet C4 and shown in the exhibit titled
“Pond Viewing Area” (dated 7-18-16) are provided in lieu of the deck shown on the Application Plan
referenced by the proffers for ZMA200100020.”

scale landscape plans in the site plan set. This will avoid problems for future reviewers and
inspectors.
2. The boundaries of the easements in the landscape area on Sheet C7 have been clarified.
However, only some of the off-site plants shown on Sheet C8 are included within a landscape
easement. The 3’ landscape easement that is shown includes some, but not all, of the shrubs at the
bottom of the lower retaining wall, and the easement line stops between groups of shrubs. The
shrubs between the walls are not in an easement, nor are the trees along the extended travelway.
The Development Agreement and Declaration seems to address landscaping previously shown as
Exhibit A, which does not include the landscaping on current Sheet C8. Please clarify.

Yes, it was covered under both easements.
The parcel numbers have changed over time, which makes the parcels a little difficult to track. Current TMP
32-41D3, 32-41D4, 32-41 D5 and 32-41 D6 were part of a larger tract owned by Post Office Land Trust referred
to as the "Post Office Property" in the first instrument I referenced in my email below. That tract had been
subdivided when the second instrument I referenced below was recorded, and all 4 parcels were "Parcels" as
used in that instrument.
Probably more info than you needed. Give me a call if you have any questions.

I enjoyed catching up with you yesterday and appreciate you taking the time to go over the bonding for the
Bojangles site plan. I have prepared a letter confirming the authorized signers of the bond-related documents,
and am having Will, Andrew and Andrew's counsel review it before sending it over to you.
In the meantime, I've attached the two documents that establish easements for access to the Bojangles site
(TMP 32-41D4). Here's what each one does:
DB 2678 p 425: This Cross Access Easement and Construction Agreement was one of several agreements
between the original developers of Hollymead Town Center granting access and utility easements for the
whole center. This one obligates the developers to build a road behind Target connecting Rt. 29 up to Connor
Dr. and grant easements for constructing and maintaining the driveway. These sections are highlighted for
your reference, and I circled the corresponding easements on the exhibit at the back. The entrance from Rt.
29 along the Bojangles site was built, but the rest of the road has not yet been built.
DB 3085 p 361: This Declaration creates additional easements and maintenance obligations for Hollymead
Area C, which includes the Bojangles parcel as well as the other parcels between Target and Timberwood
Blvd. Section 2.01 (highlighted on p. 6) establishes access and parking easements over all existing and future
driveways constructed on the property. This establishes easements over the driveways and parking areas that
will be built under the site plan currently under review for the Bojangles.

and revised the plan per the most recent comments dated August 19, 2016.See below for detailed responses to
each of your comments.
Planning:
1. The Initial Plan notification fee was paid with this resubmittal.
2. A planting strip has been added for the portion of sidewalk that extends from the intersection with
Timberwood Blvd to the portion of off-site travelway that turns down to the Bojangles. The proposed
street trees have been moved into this planting strip. The gap in sidewalk along Route 29 on the adjacent
parcel in the responsibility of that parcel owner;the applicant is unclear on when the sidewalk will be
completed.
3. The three parcels within Block Cl of Hollymead Town Center have a Development Agreement and
Declaration that establish cross access and parking easements. A copy of these documents has been
included in the submittal package.
4. The improvements shown on the Exhibit dated 7-18-16 and title "Pond Viewing Area" have been included
on the revised Final Site Plan.
Engineering(Matt Wentland):
1. As discussed, profile information has been provided for the off-site travelway that serves this proposed
restaurant. The travelway is not a proposed road as each existing parcel has frontage on an existing road,
and should therefore not require bonding or acceptance into the system.
2. An easement plat for the proposed waterline easement will be submitted on the next submittal date.
Easements for landscaping and access are in process, recorded copies will be provided prior to Final Site
Plan approval.Temporary construction and access easements are covered under the existing
Development Agreement between the three parcel owners in Block Cl Hollymead Town Center.
3. VSMP plans are under review(WPO201600046).
4. Gutters have been provided where necessary. Roof drains have been designed and coordinated with the
architect to collect and convey roof runoff appropriately.
5. The missing structure and pipe information is now shown on the plan. Labeling has been moved for
clarity.

1. A sample of the retaining wall block has been provided directly from the supplier.
2. The lighting plan has been revised to indicate the wall packs will have a bronze finish.
3. The planting size of the Inkberry holly and Prague viburnum has been revised to 24" minimum.
4. Revisions have been made to provide better identification of the easements that allow planting on the
adjacent parcels. Additionally,the three parcels with HTC Block Cl have a Development Agreement and
Declaration that establishes the rights of each property owner to install and maintain improvements on
the various parcels; a copy of these documents has been included in the submittal package.
5. Additional shrubs and grasses have been provided between and below the retaining walls to break up the
length and soften the appearance.

JT, We are getting down to the final details on the Boj angles site plan on 29 north and wanted to make sure we
have all of the questions answered for the county. We are under the gun from Bojangles corporate to open this
store before the new year and really need to wrap this up. Most notably is the sidewalk and seating area that
could be potentially required due to past proffers for Block A. Can we set a meeting time with you this week for
30min to an hour to make sure we are all on the same page and when we can expect to wrap this up and set
bond amounts. Anything you can do would be greatly appreciated!

a. ARB-2016-71: Bojangle's Restaurant at Hollymead Town Center—Final Site Development Plan(TM/Parcel
032000000041 D4)
Proposal: To construct a 3,808 sf Bojangle's fast food restaurant with a drive-thru window and associated site
improvements.
Location: On the west side of Rt. 29,just north of the Target store in the Hollymead Town Center
Motion: Mr. Lebo moved for approval of the Certificate of Appropriateness for ARB-2016-71: Bojangle's Restaurant at
Hollymead Town Center Final Site Development Plan with the conditions listed in the staff report, modified as follows:
1. Provide a sample of the retaining wall block for review.
2. Indicate on the lighting plan that the wall packs will have a bronze finish
3. Revise the planting size of the Inkberry holly and Prague viburnum to 24" minimum.
4. Without reducing legibility of the plan, include notes on the plan to identify the easements that allow planting on
the adjacent parcels.
5. Provide plants between the retaining walls and at the bottom of the lower wall to soften the appearance and break
up the length. Provide natural groupings of plants rather than a continuous row. Plants species should be
appropriate to transition from the pond to the more structured planting along the building. Consider use of shrubs
and ornamental grasses to help soften the appearance of the wall.
Mr. Binsted seconded the motion.
The motion carried by a vote of 4:0.

reviewed and revised the plan per your most recent comments dated May 5, 2016. See below for detailed

cfr 1. Per our prior correspondence the requirement for the deck has been waived by the County.
Sidewalks per the approved application plan has been added.
The proposed use text on sheet Cl has been revised as requested.

4. Additional text has been added to the water shed note on sheet Cl.
5. A compliant landscaping plan is shown on sheets C7 and C8.
