VA 22940 RE: SP-99-20 Free Union Country School Tax ~Iap 29, Parcel15D Dear Ms. :vbclay: The Albemarle County Board of Supervisors. at its meeting on July 14. 1999. unanimously approved the above-noted request to amend an existing special use permit to increase enrollment at a private school in accord with Section 10.2.2.5 of the Zoning Ordinance which allows for private schools in the RA District. Please note that this approval is subject to the following conditions: 1. If licensure is not required b;. the State Department of Welfare. this approval shall constitute a vvai vcr of Section 5 .1.6( a) 0 f the Zoni ng Ordinance. set forth below: a. No such use shall operate without any required licensure by the Virginia Department of Welfare as a childcare center. It shall be the responsibility of the O\VIKr/operator to transmit to the zoning administrator a copy of the original license and all renewals thereafter and to notify the zoning administrator of any license expiration. suspension. or revocation within three (3) days of such event. Failure to do so shall be deemed willful noncompliance \vith the provisions of this ordinance: b. Periodic inspection of the premises shall be made by the Albemarle County tire official at his discretion. Failure to promptly admit the tire ortìcial for such inspection shall be deemed willful noncompliance with the provisions of this ordinance: and Page 2 July 22. 1999 c. These provision are supplementary and nothing stated herein shall be deemed to preclude application of the requirements of the Virginia Department of Welfare, Virginia Department of Health. Virginia State Fire Marshal. or any other local. state or federal agency. J Construction of additional improvements at the site shall require amendment of the approved site plan: ^I j. Maximum number of students and statf shall not exceed ninety (90) persons or such lesser number as may be approved by the State Department of Health and/or the Thomas Jefferson Health District. or as necessary in order to comply with the requirements of Section 32.0 of the Zoning Ordinance: 4. Within six (6) months of any increase in its present authorized number of students and statf of sixty (60) persons. the applicant shall install the turn and taper lane required by VDOT on Free Union Road: 5. Prior to any increase in its present authorized number of students and statf of sixty (60) persons. the applicant shall meet all parking requirements set forth in Section 4.12.6.6.2 of the Zoning Ordinancc: and 6. Upon an increase in the number of students and statf to more than sixty (60) persons. this special use permit shall be considered to have been exercised. Under approval of this special use permit. construction of any additional structures and/or improvements at Free Union Country School shall be commenced within with a period of five (5) years from the date of approval of this permit by the Board of Supervisors. In the event that the use. structure or activity for which this special use permit is issued shall not be commenced as noted. the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. Before beginning this use. you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance. you must comply with the conditions in this letter.
