Citip,A!,. , 14?hlif Cover Sheet Page#2 of 2 Book: 3561 Page: 468 FileNumber: 2008-00002808 Seq: 2 Page 3 of 8 Document Prepared by and after recording return to: Weather Hill Development LLC 703 East Jefferson St. Charlottesville VA 22902 TMP 090F0-00-00-000A1 TMP 090F0-00-00-000A2 TMP 09000-00-00-03100 THIS DEED OF BOUNDARY AGREEMENT is made this 5 day of -Feiniffey 2008 by and between CHURCH HILL DEVELOPMENT COMPANY LLC, a Virginia limited liability company hereinafter"Grantor", and WEATHER HILL DEVELOPMENT LLC,a Virginia corporation,hereinafter"Grantee," WITNESSETH: WHEREAS,Church Hill Development Company LLC is the owner of certain property(the "Church Hill Property")by deed recorded in the Clerk's Office for the Circuit Court of Albemarle County in Deed Book 3510 Page 245, and further shown on a Plat recorded in Deed Book 3510 Page 245,and as designated on current Albemarle County Tax Maps as TMP 090F0-00-00-000A1 and TMP 090F0-00-00-000A2;and WHEREAS,Weather Hill Development LLC is the owner of an adjacent parcel of real property(the"Weather Hill Property")by deed recorded in the aforesaid Clerk's Office in Deed Book 3497,page 725,and as designated on current Albemarle County Tax Maps as TMP 09000-00-00-03100 and WHEREAS, a recent survey of the Weather Hill property shows a physical gap exists among the legal descriptions in various deeds in the chain of title to the properties and in the monuments found in the field; and WHEREAS,the parties desire to clarify the boundary between their properties and have agreed that the boundary line shown on the attached plat by Thomas B. Lincoln, Land Surveyor, Inc. dated January 25,2008, captioned ""Boundary Adjustment Plat Showing Parcel"X"Being a Portion of Property Belonging to Church Hill Book: 3561 Page: 468 FileNumber: 2008-00002808 Seq: 3 Page 4 of 8 ✓ saw Development Company, LLC Hereby Added to and Becoming a Portion of Tax Map 90 Parcel 31 Located on Avon Street,Scottsville District,Albemarle County, Virginia" annexed hereto, (the"Plat") shall be the true and agreed boundary between the Church Hill Property and the Weather Hill Property henceforth. NOW THEREFORE, in consideration of the premises and of the sum of$10.00,cash in hand paid, the receipt and sufficiency of which is hereby acknowledged by the Grantor it is agreed by both parties as follows: 1. The recitals are made a part of this agreement. 2. The boundary line(the"Agreed Boundary Line")shown on the Plat as a line designated S58°48'07"E' is hereby agreed to be the true property division line between the Church Hill Property and the Weather Hill Property. 3. To the extent necessary to give effect to the Agreed Boundary Line,Church Hill Development Company, LLC hereby GIVES,GRANTS, and QUITCLAIMS unto Weather HillDevelopment LLC as part of the Weather Hill Property any and all interest it may have in the property described as"Parcel X" consisting of 0.083 acres. 4. It is agreed that to the extent this Deed of Boundary Agreement adds any land to the Weather Hill Property that such additions are done by way of boundary line agreement and not by subdivision. Each party declares that no subdivision rights are intended to be used by this Boundary Agreement.
