Dear Ms. Mattiali:
The Albemarle Caunty Baard af Supervisars, at its meeting an February 10, 1999,
unanimously approved the above-nated request to allaw expansian af existing day care an
1.775 acres from 37 children to. 44 in accardance with Section 15.2.2.7 afthe Zaning
Ordinance. Please nate that this appraval is subject to. the follawing canditions:
1. Enrallment shall be limited to. farty-faur (44) children;
2. Approval fram the Health Department af septic system adequate to. serve this
expanded use;
3. Nat fewer than two. (2) emplayees shall be present at all times during aperatian of day
care center;
4. Fire Office approval to include campliance with all requirements and
recammendatians listed in the December 22, 1989 letter to. Michele Mattiali from Jay
Schlathauer (Attachment E);
5. Campliance with Virginia Department afTranspartation camments afFebruary 20,
1990 (Attachment F) and YOOI's camments dated December 16, 1998 (Attachment
D);
6. Staff approval and recardatian af plat shawing required sight easements within ninety
(90) days from approval from the Baard af Supervisors. Removal af existing
vegetation to. the west to imprave sight line;
7. Campliance with Sectian 5.1.6 afthe Zaning Ordinance which states:
a. No. such use shall aperate withaut licensure by the Virginia Department af
Welfare as a child care center. It shall be the responsibility afthe
awner/o.peratar to. transmit to. the Zaning Administratar a capy afthe

ariginallicense and all renewals thereafter and to. natify the Zoning Administrator
af any license expiratian, suspension, ar revacaÙon within three (3) days of such
event. Failure to do so shall be deemed willful non-compliance afthis ordinance;
b. Periodic inspectian of the premises shall be made by the Albemarle County Fire
Official at his discretion. Failure to promptly admit the fire official for such
inspection shall be deemed willful non-compliance with the provisions of this
ardinance;
c. These pravisions are supplementary and nothing stated herein shall be deemed to
preclude application of the requirements of the Virginia Department of Welfare,
Virginia Department of Health, Virginia State Fire Marshall, or any other local,
state, or federal agency.
8. The A-frame is limited to. single-family, residential use.
In the event that the use, structure or activity for which this special use permit is issued shall not
be commenced within eighteen (18) months after the issuance of such permit, the same shall be
deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes
of this section, the term 'cammenced' shall be construed to. include the commencement of
construction of any structure necessary to the use af such permit within two (2) years from the
date of the issuance thereof which is thereafter campleted within one (1) year.
Before beginning this use, you must obtain a zaning clearance from the Zoning Department.
Befare the Zoning Department will issue a clearance, you must comply with the canditions in
