Dear Mr. Starke:
The Albemarle County Board of Supervisors, at its meeting on November 11, 1998,
unanimously approved the above-noted request to allow for the conversion of a video store to
a restaurant as commercial use in an industrial zone in accordance with Section 27.2.2.14 of
the Zoning Ordinance. Please note that this approval is subject to the following conditions:
1. A modified sketch plan drawn to scale and field verified shall be submitted to show:
a. existing and proposed conditions of the site. Any improvements that have
been removed should also be removed from the sketch plan;
b. parking which meets the requirements of the Zoning Ordinance. Parking
spaces located in the existing entrances must be removed or the entrances may
be decreased and shifted to eliminate the conflict. If the entrances are
decreased, a minimum VDOT width must be maintained;
c. lighting, if used, which meets the requirements of the Zoning Ordinance; and
d. a date, existing zoning, the use, and setbacks of the district.
2. Approval by the Building Inspector and Service Authority for compliance with state
and local requirements.
In the event that the use, structure or activity for which this special use permit is issued shall
not be commenced within eighteen (18) months after the issuance of such permit, the same
shall be deemed abandoned and the authority granted thereunder shall thereupon terminate.
For purposes of this section, the term "commenced" shall be construed to include the
commencement of construction of any structure necessary to the use of such permit within
two (2) years from the date of the issuance thereof which is thereafter completed within one
(1) year.
