HomeMy WebLinkAboutSP199700037 Action Letter · e COUNTY OF ALBEMARLE Dept. of Planning & Community Development 401 McintIre Hoad Charlottesville, Virginia 22902-4596 (804) 2965823 June 3, 1998 David Hirschman Engineering & Public Works 401 McIntire Road Charlottesville, VA 22902-4596 RE: SP-97-37 Moore's Creek Steam Restoration at Azalea Park Tax Map 76, Parcel 55E Dear Mr. Hirschman: The Albemarle County Board of Supervisors, at its meeting on May 20, 1998, approved the above-noted request for stream restoration in Azalea Park on Moore's Creek. Please note that this approval is subject to the following conditions: 1. Approval of an erosion and sediment control plan by Albemarle County and the City of Charlottesville OR the Virginia Soil and Water Conservation Board, in accordance with Section 10.1 -563(A) of the Virginia Erosion & Sediment Control Act and Section 19.3- 11 of Albemarle's Water Protection Ordinance (pertaining to projects that involve more than one jurisdiction); 2. Engineering Department receipt of proof of compliance with Federal and State permits for stream channels and wetlands; 3. Engineering Department approval of hydrologic and hydraulic computations to demonstrate compliance with Sections 30.3.2.2 and 30.3.3 of the Zoning Ordinance for impacts to flood plain elevations. This includes Engineering Department approval of the design of the low-water stream crossing on the intermittent stream to provide maintenance access to the restoration project, and approval of the location of a soil stockpile for excess material; 4. Engineering Department receipt of as-built cross-sections of the post-restoration stream channel for purposes of the Moores Creek stormwater model; and . . Page 2 June 3, 1998 5. Engineering Department approval ofa mitigation plan in accordance with Sections 19.3- 45 and 19.3-46 of the Water Protection Ordinance. In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within eighteen (18) months after the issuance of such permit, the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2) years from the date of the issuance thereof which is thereafter completed within one (1) year. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance, you must comply with the conditions in this letter.
