Myers 2809 Burnt Mill Road Charlottesville, VA 22911 RE: SP 97-12 Myers Family Division Tax Map 47, Prcel32C Dear Mr. Myers: The Albemarle County Board of Supervisors, at its meeting on July 9, 1997, approved the above-noted request for additional development rights on 31.83 acres. Please note that this approval is subject to the following conditions: I The parcel authorized to be created as a result of this special use permit must qualify as a family division. 2. The parcel authorized to be created as a result of this special use permit shall not encroach into the floodplain of the North Fork Rivanna River. ,. 3. No building permit for an additional dwelling shall be issued until the plat has been recorded. In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within eighteen (18) months after the issuance of such permit, the same shall be deemed ab~_r!doned and the authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2) years from the date of the issuance thereof which is thereafter completed within one (I) year. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance, you must comply with the conditions in this letter.
