(the "Owner")
Rezone the Property, containing approximately 3.6 accts, from R-6 Residential (R6) to (•iighway
Commercial (FIC).
Pursuant to Sections 33.4 and 33.7 of'the Albemarle County Zoning Ordinance, the Owner
hereby voluntarily proffers the conditions listed Herein below which shall be applied to the
Property if the Zoning Map ,!amendment (hereinafter the `7TY A") is approved by tate County of
Albemarle (the County" 'These conditions are proffered as a part of the requested ZW and it
is agreed that: (1) the Z11AA itself gives rise to the need for the conditions, and (2) such
conditions have a reasonable relation to the rezoning requested.
1. Development shall be in general accord with the following plans prepared by Collins
Engineering entitled "CMA Properties 1-Iighway Commercial Concept Plan and Grading
Exhibit,", dated October 20, 2014, last revised April 15, 2015, and "CtYIA Properties --
Phase I Conctlit Ilan Carradine Exhibit°', dated February 23,201-5 (collectively, and
hereinafter, the "Layout Plan€f'), as determined by the Director of Planning and the Zoning
Administrator- To be in general accord with the Layout Pian._ development shall reflect
the following major elements as shown on the Layout Plan:
a. The Wilding envelope.
b. Parking; envelopes.
c_ Access and circulation throughout the .Property,
d. Landscaping and screening envelopes.
e. Area shown as "20'.Reserved Area for Future 14V Dedication, Pedestrian
Improvements, and Proposed Street Trees Ucng Berkmar Drive."
2. While the Property is used for stand-alone parking, screening for any stand-alone parking
shown on the Layout Pian shall be established, enhanced, and/or maintained as necessary
to reasonably and adequately screen the stand alone parking shown on the Layout Plan
from Berkmar Drive,
1 Sidewalk along Berkmar Drive,
a. Upon demand by the. County when sidewalks are installed on properties adjacent
to the north or south of the Property (or are installed within the public right-of-
way fronting on properties adjacent to the north or south of"the Property), the
Owner shall construct a sidewalk and install street trees within the area shown on
the Layout Plass as "20' Reserved Area for Future F/W Dedication, Pedesiriann
Improvements, and Proposed Street Trees Along Berkmar Drive," Such sidewalk:

notice from the County.
b. If at the time of approval of final site plan for a use rather than stand-alone

Such sidewalk and street trees shalt be constructed and completed in conjunction
with the improvements shown on such final site plana, or as otherwise stated on
such approved final site plan.

The sidewalk shall be designed and constructed in compliance with all applicable
Virginia Departtrient of Transportation and County standards pursttant'to Section
317.23 of the Leming Ordinance, and the street trees shall meet all applicable
County standards pursuant to Section 32.7.9.5 of the Zoning ordinance,

General Construction Notes
1. Prior to any construction within any existing public right—of—way, including connection to any existing
road, a permit shall be obtained from the Virginia Department of Transportation (VDOT). This plan as
drawn may not accurately reflect the requirements of the permit. Where any discrepancies occur the
requirements of the permit shall govern.
2. 2. All materials and construction methods shall conform to current specifications and standards of
VDOT unless otherwise noted.
3. 3. Erosion and siltation control measures shall be provided in accordance with the approved erosion
control plan and shall be installed prior to any clearing, grading or other construction.
4. 4. All slopes and disturbed areas are to be fertilized, seeded and mulched.
5. 5. The maximum allowable slope is 2:1 (horizontal: vertical). Where reasonably obtainable, lesser slopes
of 3:1 or better are to be achieved.
