The Albemarle County Board of Supervisors, at its meeting on
May 1, 1985, voted to approve your above requested petition
to rezone 0.3374 acres from C-l to PD-SC. This action was
approved by a vote of 6-0.

Dear Mr. Keeler:
In response to your staff recarrnendation contained on pages 12 and 13
of your June 7, 1983 Staff Report on Riverbend Limited Partnership's
rezoning request, this letter is to indicate my willingness to cooperate
with the County in the develoµnent of this area of Pantops.
Specifically, I agree to request a Planned Development - Shopping
Center (PD-SC) classification for those areas you referred to as A, B and
C on your plan entitled "Planning Staff Proposed lbdification ZMA-83-2."
Subject to retaining the ability to use dirt fram the site to balance cut
and fills which will have the effect of increasing slightly the amount of
land that can be developed in this area, I have no problem designating
those areas which cannot be reasonably developed without significant
encroachment into the "flood plain" as "open space". Those areas that are
in the "flood way" can also be designated as "open space".
Compliance with the new ordinance for rezoning requests of this nature
requires that extensive, costly and time consuming traffic, engineerL.'ìg
and topographical studies be tmdertaken. In order to begin such studies
it is necessary to have a general idea about the proposed use of the
property. At this tirœ, I have no definite plans for the developnent of
this area and I feel that it is only fair for this rezoning request to be
submitted at the time I first determine a use for the property.

Location:
Property, described as TM 78, parcel I7D(I), is a portion
of the First Virginia Bank property at the intersection of
Rte. 250E and Riverbend Drive.
STAFF COMMENT:
Riverbend Limited Partnership has purchased this property from First Virginia Bank
and is requesting this rezoning to bring the property into conformance with the
shopping center. Due to the small acreage involved, staff has not submitted this
petition to exhaustive review. Staff recommends that this would be a logical addition to
the PD-SC zone.
However, certain agreements of the original PD-SC petition have not been executed to
date. Rezoning actions outlined in A.I., A.2., A.3., and A.4. of the Board's action
on ZMA-83-2 have not been undertaken. Storrnwater management facilities for
Phase I construction have not been completed (B.3.c.). Many of these items were
included by agreement rather than action at the time 'of approval due to the applicant's
construction schedule. At this time, there appears to be no reason for further delay
in executing these agreements. Staff recommends deferral of this petition until the
agreements of original approval have been executed.
