McKee Queen Charlotte Square 256 East High Street Charlottesville, VA 22901 (, RE: SP-89-28 Richard & Geraldine Muller Dear Mr. McKee: The Albemarle County Board of Supervisors, at its meeting on September 20, 1989, unanimously approved the above noted request to allow five additional development rights on an adjacent parcel while restricting development of the property known as the Riggory (Parcel 16A). The parcel proposed for additional division (Parcel 16) will also cluster two, 21-acre rights for a total of 12 small lot development rights. Property, located on the east side of Rt. 20 North about one-half mile north of intersection with Rt. 610. Tax Map 47, Parcel 16 and 16A. Rivanna Magisterial District. Please note that this approval is subject to the following conditions: 1. Development to be served by a public road aligned to intersect Route 20 across from Route 649; 2. Prior to Planning commission review of the final plat, County Attorney approval of documents to effectuate perpetual historic preservation of The Riggory and significant outbuildings, conservation easements, and appropriate buffer strips; 3. Prior to Planning Commission review, agent approval of screening measures; ~ . . -- Robert McKee Page 2 October 4, 1989 4. The number of dwelling units on the entire estate, including subdivided lots and The Riggory house, shall not exceed thirteen (13). Before final plat approval, determination shall be made by the Zoning Administrator of the number of dwelling units currently existing at that time; 5. Existing trees along Route 20 shall remain as an undisturbed buffer; 6. The preliminary plat approved by the Board is to be identified by the initials of the Director of Planning and Community Development and dated September 20, 1989; 7. Trees and vegetation as outlined on the initialed plat shall be maintained and replaced if they should die.
