SUB-2017-131 Faircloth Property —Subdivision
The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
[ 1 4-302(A)(4), (6) & 14-303(E)] Private easements; Alleys and shared driveways;
Dimension standards and information on all lots, streets, alleys, easements, and
shared driveways. Revise the plat to show a new private street easement and
provide the documents required for the creation of a private street. Address the
following:
a. Revise the note to read "New 30' Private Street Easement".
b. Provide a filled out version of the "Review of Private Improvement
Maintenance Instrument" checklist that is attached. Ensure that all items
specified in the checklist are provided in the document mentioned below.
c. Provide a draft version of the legal declaration that specifies how the new
private street will be maintained. See the template attached and the
supporting sections of the County Code. The draft maintenance
document will be reviewed by the County Attorney's office. The final plat
will not be approved until approval from the County Attorney's office has
been received and a signed and notarized copy of the approved
document is received by the plan reviewer.
d. Highlight the portions of the draft legal declaration, and put numbers next
to the highlights, that address the items listed in the "Review of Private
Improvement Maintenance Instrument" checklist.
2. [14-302(A)(4), (6) & 14-303(E)] Private easements; Alleys and shared driveways;
Dimension standards and information on all lots, streets, alleys, easements, and
shared driveways. Revise the private street easement such that the road
frontage provided for the two proposed lots meets the minimum 150'
requirement. The dimension for the 150' road frontage must be from the edge of
the prescriptive easement and not from the property line which is in the middle of
the road.
3. [14-302(A)(5) & 14-303(L)] Public easements, Public utility, drainage and sight
distance easements. Address the following:
a. Revise the plat to include the Deed Book and Page number for the
electrical easement.
b. See VDOT's comment attached.
4. [14-302(A)(9)] Building sites on proposed lots. Revise the plat to accurately show
the critical slopes on the property. Those shown do not appear to match the
County's GIS. Some areas do not appear to be shown and others do not appear
to be accurately located. Also, show the critical slopes even where they are
intersecting with the flood plain.
5. [1 4-302(A)(1 0)] Right of further division of proposed lots. Revise the development
rights note such that Lot A is assigned a development right. That portion of the
note should read "Lot A is assigned 1 development right and may not be further
divided." It appears from the plat at Deed Book 4381 Page 220 that there is one
development right assigned to the current TM 20 (1) 2 that can be utilized in this
way. Any lot less than 21 acres in size must have a development right assigned
to it in order to be created.
6. [14-302(B)(8)] Yards. Revise the setbacks shown on the plat so that they are
shown along all portions of the subject parcels shown on the plat. The setback
should continue beyond the edge of the floodplain.
7. [14-302(B)(9)] Flood plain. Revise the floodplain line to more accurately
represent the location of the floodplain. The line shown does not appear to
match that shown on the County's GIS.
8. [14-303(H)] Monuments. Revise the plat to include a monument set at the
proposed corner of the property along the road or a specified distance from the
proposed corner of the property because of the existing road.
9. [14-309 & 14-3101 Soils evaluations; Health Director Approval. Provide three
copies of the soil evaluation and drainfield location (primary and reserve)
documents required for Health Department (HD) approval for both parcels. Once
submitted to the County they will be forwarded them to the HD for their review. If
a HD approval exists for both a primary and reserve drainfield locations on the
existing lot then forward copies of the approvals and graphics associated with
that approval showing the location of the drainfields. The final plat will not be
approve until approval is received from the HD for both parcels.
10. [Comment] Remove from the cover sheet and the plat the paragraphs and
signature area for the Health Department's approval. See the comment above in
reference to the Health Department's approval process.
11. [Comment] See attached VDOT comment.
