Subject: ZMA 2017-00007 Hogwaller Farm - initial zoning comments
Please consider the following comments:
1. Narrative
a. Allowing agriculture also allows certain events and activities at agricultural operations.
i. Is there intention to hold activities and or events listed in 5.1.58(d)? Further
information regarding products and sourcing will be needed to confirm a "Farm
Sales" use.
b. "...a small market stall to sell produce/crops"
i. The Context Map states "structures are not proposed with this rezoning
request" and shows "Farm Sheds (City of Charlottesville Requested Zoning)"
within the City of Charlottesville. Applicant should confirm that this use will be
occurring within the City.
ii. Pending above, structures accessory to a permitted agricultural use may be
allowed in the floodway fringe pursuant to the provisions of 30.3.11. No
habitable structures are allowed in the Flood Hazard Area.
This parcel does not have any building sites per 4.2.1.a (ii); no theoretical development
rights may be used.
2. Conceptual Plan
a. Please label the Context Map a Conceptual Plan
b. See Comment lb regarding the location of market stalls.
c. Any proposed structures must be accessory to the permitted agricultural use; said
structures shall not have habitable space, and may only be located within the floodway
fringe. That said a clearer demarcation of the floodway fringe must be shown on the
conceptual plan to assure any future location of accessory structures complies with the
floodplain regulations. See Comment 1 b ii.
d. Will there be any areas within the parcel for parking of vehicles related to proposed
agriculture use? Please clarify if all parking will be located within the City of
Charlottesville portion of the site. Any parking area may only be accessory to a use
allowed by right or special use permit on the same parcel as the primary use and shall
not be a permanent parking lot for motor vehicles.
e. If the parking will be located off -site (on the City parcels), an instrument would normally
be required during the site plan or zoning clearance processes per 4.12.8.e. However,
if the agricultural operation use is by -right, these processes will not come into play.
f. Sufficient parking would be required for the vehicles of all employees plus all those
who may be expected to visit the same at any one time, per 4.12.7.a.
g. If a zoning clearance is required for the Farm Sales use mentioned above, additional
parking requirements will be addressed during the application process.
The parcel is not accessible from any streets, however two access points labelled
"Farm Entrances" are shown on the Context Map. The applicant should clarify how
continued access to the site will be secured.
The 100' steam buffer must be identified on the plan, and it must be stated that it the
buffer is regulated by the Water Protection Ordinance.
