County Code section 17 -410 and Virginia Code §62.1- 44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17 -401.
A. Stormwater Pollution Prevention Plan ( SWPPP)
The SWPPP content requirements can be found in County Code section 17 -405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.

B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17 -404.
1. PPP Needs to be submitted for review.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25- 870 -108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17 -403.
1. Can be approved upon receipt of recordation of drainage easement across adjacent parcel 61M -124C.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1- 44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17 -402.

The VSMP permit application and all plans may be approved upon the recordation of the stormwater
drainage easement plat.
Engineering plan review staff are available from 2 -4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2 -4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre - construction conference.
Applicants will need to complete the request for a pre - construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre - construction
conference will be scheduled with the County inspector. At the pre - construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.

The Third erosion and sediment control plan and stormwater management plan (WPO201300029)
submitted 20 February 2014 has received Engineering Review and does not appear to meet
Albemarle County minimum checklist items for approval. Please adequately address the
remaining comments for final approval:
A. Application Information
1) After plan approval but prior to grading permit issuance, a stormwater management maintenance
agreement will be required.

review.
B. Existing Conditions Information
1) Please visually confirm the topographic survey conditions shown on sheet 2 and note as
such on the plans. Topography over one year old must be field verified by designer.

verified in 2013.
C. Plan View Information
1) Please number all existing and proposed drainage structures and pipes proposed for this project
including 15" HDPE pipe proposed to cross under sidewalk at SE corner of property.

sheet 6 for Stormwater Management.
2) Please provide with for proposed easements for two pipes proposed at SE corner of property. A
20' drainage easement is required for conveyance of drainage off -site. The pipe must be within

1) Please include within plan or narrative the proposed limits of disturbance area for this project.
(REV2) All proposed disturbances have not been included within the proposed limits of
disturbance.
2) Please remove references to the early grading plan (WPO2013- 00019, aka the clearing and
grubbing plan) from the narrative and plan per withdrawal of the application. Suggest a phased
ESC plan based on how work appears to be proposed in this plan set (i.e. erosion control
protection for multiple phases of proposed construction).

3) Please provide an adequate channel analysis for runoff from proposed construction. Analysis could
be proven given:
a) adherence to VESCH MS -19 requirements (see 4VAC50- 30 -40, MS -19 sec. b (1)): The
applicant shall demonstrate that total drainage area to the point of analysis within the channel
is one hundred times greater than the contributing drainage areas of the project in question. A
report or plan depiction with analysis to this point could prove channel adequacy. Point of
analysis could be just west of US -29.
b) adherence to VA code 10.1- 603.4(7): essentially, the required condition for an on -site
solution without looking downstream for a 24 hour 1.5, 2, and 10 -year intensity event -
(post - development) Peak flow rate <= Pf *VfNp
Where Pf = peak flow rate in a forested condition
Vf = runoff volume in a forested condition
Vp = runoff volume proposed
Please note this analysis is necessary for all phases of proposed construction, including the
phase proposed on sheet 3. Recommend re- routing runoff from phase proposed on sheet 3 to
drain to the west channel to simplify the adequate channel analysis.
(REV2) Channel analysis is from outlet of site downstream to 1% of drainage area or
agreeable alternative. An analysis to the culvert boxes under State Route 29 will be
sufficient for this project.
4) Albemarle County requires paved construction entrances to be shown on development
plans [Albemarle County Engineering Review Reference Details Page 3 of 6] to mitigate
erosion. Please include this detail with the plans. It appears this detail could substitute for
"Stone Construction Entrance" shown on sheet 5.

Basin Page 9" and "Hydrograph for Pond 2P: Bio- Basin" Page 8 for 2 and 10 year storms
respectively. Detention volumes should begin at elevation 466.50 for bioretention basin proposed.
Note: Albemarle County encourages the use of Internal Water Storage (IWS) with bioretention
basins. However, high clay content soils are common in the area. County engineering would
require soil borings to indicate percolation capacity for subgrade soils, in order to count this
volume with detention calculations. It does not appear that the IWS was considered in detention
calculations included with this submittal.

appear to meet Albemarle County minimum checklist items for approval. Please adequately
address the following comments for final approval:
A. Application Information
1) After plan approval but prior to grading permit issuance, a stormwater management maintenance
agreement will be required.

1) Please visually confirm the topographic survey conditions shown on sheet 2 and note as
such on the plans. Topography over one year old must be field verified by designer.

1) Please include within plan or narrative the proposed limits of disturbance area for this project.
2) Please remove references to the early grading plan (WPO2013- 00019, aka the clearing and
grubbing plan) from the narrative and plan per withdrawal of the application. Suggest a phased
ESC plan based on how work appears to be proposed in this plan set (i.e. erosion control
protection for multiple phases of proposed construction).
3) Please provide an adequate channel analysis for runoff from proposed construction. Analysis could
be proven given:
a) adherence to VESCH MS -19 requirements (see 4VAC50- 30 -40, MS -19 sec. b (1)): The
applicant shall demonstrate that total drainage area to the point of analysis within the channel
is one hundred times greater than the contributing drainage areas of the project in question. A
report or plan depiction with analysis to this point could prove channel adequacy. Point of
analysis could be just west of US -29.
b) adherence to VA code 10.1- 603.4(7): essentially, the required condition for an on -site
solution without looking downstream for a 24 hour 1.5, 2, and 10 -year intensity event -
(post - development) Peak flow rate <= Pf *VfNp
Where Pf = peak flow rate in a forested condition
Vf = runoff volume in a forested condition
Vp = runoff volume proposed
Please note this analysis is necessary for all phases of proposed construction, including the
phase proposed on sheet 3. Recommend re- routing runoff from phase proposed on sheet 3 to
drain to the west channel to simplify the adequate channel analysis.
4) Albemarle County requires paved construction entrances to be shown on development
plans [Albemarle County Engineering Review Reference Details Page 3 of 6] to mitigate
erosion. Please include this detail with the plans. It appears this detail could substitute for
"Stone Construction Entrance" shown on sheet 5.
5) Please include dust control for this project on sheet 3.
6) Please include temporary seeding for this project on sheets 3 and 4
7) Please label apparent soil type boundaries on sheet 3.
8) Please label existing drainage divides on sheet 3.
9) Please provide calculations for sediment basin propoosed on sheet 4 (for prior to its conversion to
a bioretention basin).
10) Please indicate safety fencing around proposed sediment basin proposed on sheet 4.

across the construction entrance as shown on sheet 3. Please introduce a R/W diversion to ensure
this runoff flows to the sediment trap.
12) It appears that existing topography creates a low point at the SW corner of the property as shown
on sheet 3. Please indicate proposed grading or a note that the proposed diversion dike shall be
graded to ensure that sediment laden runoff flows to the sediment trap.
13) Please indicate proposed staging and contractor parking areas or comment if these are included
within the limits of disturbance proposed.
14) Please extend limits of disturbance to include grading proposed to tie in critical slope area at the
southeast corner of the site.
15) Please include silt fence to protect proposed grading to tie in critical slope area at the southeast

5) Two and ten year storm detention calculations appear to begin showing storage at bioretention
floor elevation of 465.50. Please update detention calculations for "Hydrograph for Pond 2P: Bio-
Basin Page 9" and "Hydrograph for Pond 2P: Bio- Basin" Page 8 for 2 and 10 year storms
respectively. Detention volumes should begin at elevation 466.50 for bioretention basin proposed.
Note: Albemarle County encourages the use of Internal Water Storage (IWS) with bioretention
basins. However, high clay content soils are common in the area. County engineering would
require soil borings to indicate percolation capacity for subgrade soils, in order to count this
volume with detention calculations. It does not appear that the IWS was considered in detention
calculations included with this submittal.

system.The majority of the outfall is now directed west to the channel.
3. The Stage One E&S concept has changed such that runoff will be collected and treated on the west
side of the site and shall outfall to the large manmade channel. Analysis of the large channel has
been completed and results are provided on Sheet 8.
