I have reviewed the existing entrance that will serve the existing parcel 103-57 and a new Lot 1 as a private use
entrance.The existing entrance does not require any upgrades and meets current VDOT minimum private entrance
standards and sight distance requirements for continued use as is. Please let me know if you have any questions or

The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
Please note that these comments are an update version of first round comments.
Planning Comments (Pate Saternve):
[14-232 (B), 14-234,14-235, 14-410, & 14-412 (A)(1)] Submit a private street
maintenance agreement for review. A "private street" is required for Lot 1's
access through the residue of TMP 103-57. Rev_. #1: The updated version of the
street maintenance agreement was received on 6121116 and has been forwarded
to the County Attorney's office. Approval by the Attorney's office and receipt of
the signed and notarized version of the final document, is necessary before
approval of the subdivision. Rev. 92: The Attorney's office requested two
changes be made on the private street maintenance agreement.
a. The first than a is in the third paraaraph, where the information on
the Plat is elven. The date of the plat should read "April 22, _2,016.
last revised June 9.2016.".
b. The second change is at the bottom of the first Pane in the last
sentence where it is describina the two lots. "New Acrea e" is not
the name for the parcel. I would suggest a description of "the
residue of TMP 103-57". If there is a different wording our attorne
would prefer to use please contact me before moving forward.
c. After the two chancres listed above are made to the private
maintenance agreement then submit a signed and notarized version
of the document.
d. Once we have received the signed and notarized document then the
County will be able to approve and slan the plat. Please note that
the documents will need to be delivered to or dropped off at the
Community Development front desk. I will call you after the last
checks have taken place, the Plats sinned, and the si ned Plats have
beenplaced down at the front desk for pickup.
2. [14-302 (13)(1)] General Information. Provide the sheet # (Sheet 2 of 2) on the
second page of the plat. Rev. #1: Comment Addressed.
3. (14-302 (A)(3)] Existing or platted streets. Update your street route number to
specify 795. Although part of Rolling Road is Route 620 this parcel is on the
portion which is Route 795. This portion of Rolling Road (Route 795) is
designated as a Major Rural Street by Albemarle's County Code. Rev. #1:
Comment Addressed.
4. [14-302 (A)(4), 14-302 (A)(6) & 14-303 (E)] Private easements; Alleys and
shared driveways; Dimension standards and information on all lots, streets,
alleys, easements, and shared driveways. Provide the location, dimension,
owner and deed book and page number for any private easements that exist on
the property. This would include, among other things, any existing access or
driveway easements. The driveway for TMP 103-58A is shown as veering onto
TMP 103-57 property on the County's online GIS. Rev. #1: Comment
Addressed. Prima contact states that the driveway for TMP 103-58A does not
veer into TMP 103-57.
5. [14-302 (A)(9)] Building Sites on proposed lots. Provide a 30,000 square foot
rectangle for the building site in TMP 103-57 that meets the requirements of
section 4.2.1 of the Albemarle County Zoning Ordinance. Also, the notation
omits the word "County". Modify the note on the cover sheet to include it. Rev.
#1: Comment not fully addressed. Add the word "County" to the coversheet dote
on building sites as specified. Rev. #2: Comment Addressed.
6. [14-302 (A)(10)] Right of further division of proposed lots. Provide the required
development rights note on the coversheet. if you are uncertain of the
development rights for the parcel you can request an official Letter of
Determination of Development Rights. Please refer to the Citizen's Guide to
Development. The last page has information on how to request a determination.

8. [14-302 (B)(8)] Yards. Add a note on the cover sheet specifying the required
yards for the RA zone. Rev. #1: Comment Addressed.
9. [14-302 (13)(10)] Stream buffers. Provide 100' stream buffer on both sides of the
creek. Also add the word "County" to the stream buffer note (ex. "...the Albemarle
County Water Protection Ordinance." Rev. #1: Comment Addressed.
10. [14-303 (D)] Acreage of lots. Update the new acreage for TMP 103-65. The 0.74
acres was accidentally subtracted instead of added to the new acreage total.

13. [14-303 (L)] Public utility, drainage and sight distance easements. See
Comments #3 above. In addition to that comment provide any drainage or site

14. [14-303 (0) 14-303 (P)] Signature Panels; Notary Panels. Make sure all owners
have notarized signatures before submission of signature copies. Rev. #1:

15. [14308.1 ] Groundwater Assessment. A Tier 2 groundwater assessment is
required for a parcel of this size. Submit an application and the fee for a Tier 2
groundwater assessment. Rev. #1: Comment Addressed.
16. [14-309; 14-310] Soils evaluation; Health Director Approval. Soils work was
submitted to Health Department on May 4, 2016. Approval of the soil evaluation
by the Health Department is required before approval the subdivision will be final.

17 [14-316] Approval of entrance onto public streets. Provide verification from
VDOT that there is adequate location for an entrance along the adjacent public
roads for the shared private street access for the two lots. Rev. #1: Comment

received.
18. [14-404] Lot location to allow access from lot onto street or shared driveway. The
proposed 30' access easement will be a single point of access for both lots. This
portion of Rolling Road (Route 795) is designated as a Major Rural Street by
Albemarle County's Subdivision Ordinance. Since this section or Roiling Road is
a major rural street, and TMP 103-57's road frontage is less than 500', Section
14-404 of the subdivision ordinance specifying a single point of access applies.
This stipulates a single point of access to the public road, for the two parcels
created with this subdivision, is required unless a waiver is granted. Rev. #1:
Comment Addressed. This comment was to inform rima contact and owners
of the parcel that a sin le point of access applies for these two lots unless the

of TMP 103-5961 may have been created with Deed Book 925 Page 31 and the
current configuration of TMP 103-65 is at least shown on Deed Book 1577 Page
611. Provide a note next to, or above, each of the deed book and page numbers
to specify which property they are the instrument for.
9. [14-302 (A)(15)] Identification of all owners and certain interest holders. The
County's online GIS data shows both Fred Wayne & Rebecca G. Shifflett as
owners for TMP 103-57. Please provide official documentation that specifies
when, and that, only Fred Wayne became the owner of that parcel.
10. [14-302 (13)(4)] Places of burial. If there are any burial sites show them on the
plat.
1. [14-302 (B)(8)] Yards. Add a note on the cover sheet specifying the required
yards for the RA zone.
12. [14-302 (13)(9)] Flood plain. Include a note on the coversheet specifying whether
or not a portion of the site is within a flood plain and including the FEMA FIRM map
number, effective date. Also, if there is flood plain within the parcel show the 100
year flood plain in the graphics of the plat.
13.[14-302 (B)(10)] Stream buffers. Provide 100' stream buffer on both sides of the
creek. Also add the word "County" to the stream buffer note (ex. "...the Albemarle
County Water Protection Ordinance."
14. [14-303 (C)] Boundary. Move the 65.64' distance measurement in the upper right
corner of the plat (southeast corner) to the other side of the line so that it is more
obvious that the 565.28' is measuring the distance all of the way to the P.F. label.
15. [14-303 (D)] Acreage of lots. Update the new acreage for TMP 103-65. The 0.74
acres was accidentally subtracted instead of added to the new acreage total.
16. [14-303 (E)] Dimension standards and information on all lots, streets, alleys,
easements, and shared driveways. Label the" New 30' Access Easement" as
"New 30' Private Street Access Easement". Also, see comments numbers 3 and
4 above for additional comments on dimension standards and easement.
17 [14-303 (H)] Monuments. Clarify why the existing southern property corner along
State Route 795 (Rolling Road) is labeled as I.S. instead of being found". The
plat included in deed book 4645 page 213 dated 6/5/2015 showed the pin as
being set. Also, the property corner near the middle of the road frontage does
not seem to have a label. Specify if this monument was "found" or "set".
18. [14-303 (L)] Public utility, drainage and sight distance easements. See
Comments #3 & #4 above. In addition to those comments provide any drainage
or site distance easements that exist or will be required.
19. [14-303 (0)] Signature Panels. If additional owners are added, as requested in
Comment #9 above, add an owner's signature panel for that owner.
20. [14-303 (P)] Notary Panels. Provide a notary panel for each owner who is listed.
Ensure that there is an area in the notary panel which specifies which owner's
signature they are witnessing.
21. [14-308.1] Groundwater Assessment. A Tier 2 groundwater assessment is
required for a parcel of this size. Submit an application and the fee for a Tier 2
groundwater assessment.
22. [14-309; 14-310] Soils evaluation; Health Director Approval. Soils work was
submitted to Health Department on May 4, 2016. Approval of the soil evaluation
by the Health Department is required before approval the subdivision will be final.
23. [14-316] Approval of entrance onto public streets. Provide verification from
VDOT that there is adequate location for an entrance along the adjacent public
roads for the shared private street access for the two lots.
24. [14-404] Lot location to allow access from lot onto street or shared driveway. The
proposed 30' access easement will be a single point of access for both lots. This
portion of Rolling Road (Route 795) is designated as a Major Rural Street by
Albemarle County's Subdivision Ordinance. Since this section or Rolling Road is
a major rural street, and TMP 103-57's road frontage is less than 500', Section
14-404 of the subdivision ordinance specifying a single point of access applies.
This stipulates a single point of access to the public road, for the two parcels
created with this subdivision, is required unless a waiver is granted.
25. [Comment] A "private street" is required for Lot 1's access through the residue of
TMP 103-57. A private street may be approved by a County agent, and does not
require approval of the Board of Supervisors, in a 2 -Lot subdivision if all
regulations, standards and procedures are followed. See Article Il, Division 5 of
the Subdivision Ordinance on Procedures for the approval of a private street,
shared driveways and alleys (in its entirety but also specifically 14-232 (B), 14-
234 (A) (B) (C) & (E), & 14-235) as well as 14-410, 14412 (A) (1) and any
Subdivision Ordinance or Zoning Ordinance items referenced within them.
26. [Comment] Public water and sewer is not available to this parcel. Change the
note on the cover sheet that states that it will be available to the property.
Engineering Comments (Max Greene
1. [Comment] The acreage does not add up for parcel 103-65. Should be 6.43
instead of 4.21 as shown.
2. [Comment] Need topography to review in accordance with 14-412.A.1
requirements.
3. [Comment] Plat appears to need note from 14-412.A.4 added.
