MERRILL and JENNIE HOWE MERRILL, his wife, parties of the second part; WITNESSETH : In consideration of $28, 000. 00, cash, $7, 000. 00 to each of the grantors, they grant, bargain, sell and convey with GENERAL WARRANTY AND ENGLISH COVENANTS OF TITLE to Robert E. Merrill and Jennie Howe Merrill, their undivided 4/7ths interest, 1/2 to Robert E. Merrill and 1/2 to Jennie Howe Merrill in 510. 2 acres in Albemarle County, Virginia, in Samuel Miller District and composed of two pieces. First: 162. 5 acres in the vicinity of Batesville, of record in Deed Book 98, page 65, Tax Map 84-53. Second: 347. 7 acres adjoining the above property on the north side of Secondary State Route 635 and shown on plat in Deed Book 318, page 443, Tax Map 84-44.and 51. The above property was conveyed to Robert E. Merrill and Jennie Howe Merrill as trustees for their six children, 1/7 interest for themselves and 6/7 interest in trust; 1/7 interest for each child, the trust f r each child to expire when the child becomes 21 years of age, by deed from Beatrice Weissenberger Neill, December 18, 1963, of record in Deed Book 394, page 17. B. 318, p . 443, and is the same property in all respects conveyed to Beatrice Weissenberger Neill by William Stuart Sorg , Jr. , and wife by deed dated July 7 1959, and recorded in said Clerk ' s Office in D. B. 350, p . 461 . Parcel (2) above is subject to the following easements : A. The power line right of way granted Virginia Public Service Company by C . N. Alexander and wife by deed dated Oc- tober 16 , 1930, and recorded in said Clerk' s Office in D. B. 212 p . 306 ; B. The telephone line easement and the rights of the public in State Route 635 and State Route 691 as shown on said plat of T . W. Saunders dated August , 1955, and recorded in said Clerk ' s Office in D. B . 318, p . 443 ; and C . The power line easement condemned by Central Virginia Electric Cooperative as more particularly set forth in Order of record in said Clerk ' s Office in D. B . 369, p. 133-4 . Parcels (1 ) and (2 ) above described are subject to such easements as appear upon the ground although not of record in said Clerk ' s Office . The six-sevenths undivided interest hereby conveyed to Robert E . Merrill and Jennie Howe Merrill , as Trustees , is con- veyed upon the following trusts : ( 1 ) The said Robert E . Merrill and Jennie Howe Merrill , Trustees , shall hold the six-sevenths undivided interest as follows : one-sixth for each of their six infant children, to- wit : Margaret C . Merrill , Mary Lee Merrill , Elizabeth H. Merrill , Robert H . Merrill , William G. K. Merrill , and Susanne C . In the event of sale, the Trustees shall have full authority to reinvest the proceeds of the sale as they see fit and use the income and principal of each child 's share for the benefit of that child as they, in their discretion, deem for the best interest of said child. In the event that either Trustee fails to act, by reason of death or other cause, the other Trustee shall act as if he or she alone were named as Trustee in this instrument. Subject to the aforesaid easements , the party of the first part covenants that she has a right to convey said land to grantees ; that the grantees shall have quiet possession of said land, free from all encumbrances ; that she has done no act to encumber said land and that she will execute such further assurances of said land as may be requisite .
