Home occupations are only permitted as an accessory use to a dwelling for members of the family residing on the parcel. Since the home has not been constructed and no one resides on the property, the home occupation cannot be approved. The home must be constructed, have a CO, and a detailed floor plan of the space to be used for the home occupation provided. Zoning conducts an inspection and verifies square footage before approving home occupations. In this case, the application indicates that the home and accessory structure have not been designed or built at this time. Hopefully that clarifies the requirements. The notice will identify the proposed home occupation, its size, its location, and whether there is a request for a waiver or modification. The notice shall invite the recipient to submit any comments before the zoning clearance is acted upon. The notice shall be mailed at least five (5) days prior to the action on the zoning clearance as provided in section 32.4.2.5. In addition, a public notice sign will posted on the property for the duration of the review. [Section 5.2A (n)] ® SIGNAGE One sign that does not exceed four (4) square feet in sign area and only states the name of the person occupying the dwelling and identifies the product or service offered by the home occupation is permitted. No additional permit is required for this sign, however, it must not exceed 6 ft. in height and must be setback at least 5 ft. from the public road right-of-way. [Section 4.15.2 (25) and 4.15.8] ® ADDITIONAL IMPROVEMENTS AND REVIEWS FROM OTHER AGENCIES A zoning clearance shall not be issued if, after review of any site, additional improvements are necessary to protect public health or safety. In granting a waiver or modification of the area requirement, the commission shall make the following fi idings in addition to those findings in section 5.1: (1) the nature of the home occupation requires storage or additional s ace within the dwelling unit to conduct the home occupation; (2) the primary use of the dwelling unit as a residence is main ined; and (3) the waiver or modification would not change the character of the neighboring agricultural area or the resid ntial neighborhood. Laura and Mitchell Fleisher, recently purchased revised TMP 06900-00-00-050C1 (see attached "Plat Showing Boundary Line Adjustment between TMP-69-50-C and 69-50C1") containing 55,514 acres. Their proposed residence will be located near the rear of the parcel 50C1 and the medical office will be located in a proposed accessory structure on a ridge approximately 300 feet from Critzers Shop Road. While the medical office will be limited to 1500 square feet, the accessory structure that contains the medical office may be of greater size, containing additional by -right accessory uses. Both the medical office and the proposed residence will be accessed from the existing driveway with 50' access easement serving TMP 06900-00-00-05000 (8899 Critzers Shop Road). The Applicants have read and understand all of the requirements established in Section 5.2A of the Albemarle County Zoning Ordinance. They plan to provide two or three parking spaces for the medical offices and a letter from the Applicants is attached with additional information regarding their proposed business and anticipated numbers of client visits. There are no existing structures on the site and the Applicant does not have any architectural sketches or designs for their proposed home or medical office at this time. The major home application specifies a requirement (Section 2) for a "floor plan sketch" of the dwelling and area calculations for the dwelling.
