High St., Suite 103 Akron, OH 44308 RE: LZC2017-38 1 Parcel ID — 06000-00-00-024EO I Owner— University of Virginia Foundation Dear Ms. Hays: In response to your request for a Letter of Zoning Compliance for the above referenced parcel (the "Property"), please be advised of the following: The Property is currently zoned PRD, Planned Residential Development ("PRD") per ZMA-1988-00009. The Property is also subject to the Entrance Corridor Overlay District as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). 2. The Property's current use, described in the request letter as "Independent Living & Retirement Home", is permitted in the PRD zoning district. This use may be more particularly described as "semi -attached and attached single-family dwellings" or "multiple -family dwellings" (the cottage and apartment -style independent living units) permitted per Section 19.3.1 of the Zoning Ordinance, and an "assisted living facility, skilled nursing facility, children's residential facility, or similar institution" (the nursing/assisted living facility) permitted per Section 19.3.2 and included in the original PRD rezoning petition. 3. The surrounding properties' zoning district designations are R1 Residential ("R1") to the west; R15 Residential ("R15") and RA, Rural Areas ("RA") to the north across Barracks Road; R2 Residential ("R2") and Neighborhood Model District ("NMD") to the east; and R4 Residential ("R4") and R1 to the south. 4. The following are building permits with Certificates of Occupancy issued for the Property: B199201348NC, B199300294O, B199401870AI, B199700961 S, B199801555AC, B200506234AI, B200601814AI, B201201161AI. 5. The absence or expiration of a Certificate of Occupancy would not be considered a violation. 6. There is no requirement to transfer or re -issue a Certificate of Occupancy upon change of ownership. However, upon change of ownership, a new Zoning Clearance will be required per Section 31.5 of the Zoning Ordinance. 7. This office has no record of an open zoning or building code violation for the Current Use or the Property. 8. Similar to #6, there is no need to transfer or re -issue special permitting to a buyer upon change of ownership. A Zoning Clearance will be required per Section 31.5 of the Zoning Ordinance.
