Entrance Corridor SUP - LL Bean Display
Dear Planning Commission Members:
Because I will not be able to attend your meeting tomorrow night, I wanted to provide the following brief comments on
behalf of the Southern Environmental Law Center on the special use permit request to allow the outdoor display of
kayaks in front of LL Bean along the Route 29 entrance corridor at Stonefield.
We agree with the Architectural Review Board's findings that the proposed display would not meet the Entrance
Corridor Design Guidelines, and we share staff s concerns about the precedential effect that approving this application
could have in encouraging similar merchandise displays for various other types of business (some of which could have
much greater visual impacts than the kayaks at issue here).
The ARB's recommendation to simply shift this display from Route 29 to west of the store's entrance on Bond Street is a
reasonable compromise, and we support this approach.

I believe you may have misunderstood the tangible milestone of "2/17." The 171" is the deadline for which Margaret
must receive the revised drawings related for the SUP. There is no tangible date associated with the ARB/Margaret's
approval releasing us to submit for building permit submittal. Rather, it up to Margaret to review asap (based on her
response below).

I don't have a Feb. 17 meeting on my calendar, so I'm not sure what you are referring to. An ARB approval letter for the
non -kayak related ARB items will be issued after I've determined that the revised drawings address all conditions of ARB
approval. I have not completed that review yet. It is on my to-do list for this week, but the staff report for the Planning
Commission meeting is also due this week. The staff report - and two others - have priority.

Bill, Tony and Rick,
I'd like to simplify the drawing set that we provide to the Planning Commission and board of Supervisors for the LL Bean
application. The attachment is a compilation of drawings from your previous submittals that I think will be most useful. I
just cut -and -pasted without making it pretty, so a few tweaks are needed.
1. The color renderings are good to go with changes to the titles so that board members can more easily identify
the building elevations. (See notes on the drawings.)
2. Can we limit the drawing size forthe line drawings (elevations and site plan) and cover sheet to 11 x 17?
3. For the elevation drawings, I think we only need the Rt. 29 and Bond Street elevations (with titles adjusted as
noted in the attachment) and the kayak detail.
4. Can the site plan be revised to emphasize the location of the kayak display? The shading of the parking spaces
could be eliminated. The PC and BOS are only considering the proposed display, so some of the other info on
this drawing may not be needed.
5. The cover sheet may not need all of the information you've provided for PC/BOS review. Can some of the notes
be eliminated based on this reduced package?
Let me know if you think a reduced package like this will work for you or if you have other ideas. Remember, you can
always use other/additional images in your presentation at the meeting.
We will need 13 hard copies of the drawing set by Feb. 17. 1 suggest that we review emailed pdfs before printing and
mailing the hard copies.

To be paid after staff review for public notice:
Most applications for a Special Use Permit require at least one public hearing by the Planning Commission and one public
hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees
for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications
reviewed by the Board of Zoning Appeals, however, only require one public hearing and therefore require just one fee for
public notice.
The total fee for public notice will he provided to the applicant after the final cost is determined and must be paid before
the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner
notification to be between S400 and $450 per hearing. This estimate reflects the average cost of public notice fees for
Special Use Permit applications, but the cost of certain applications may be higher.

ADDITIONAL FEES REQUIRED BUT NOT DUE AT TH)S TIME.
Please note that there will be at least one public hearing by the Planning Commission and one public nearing by the
Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing a legal
advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for
public notice are required before a Special Use Permit may be heard by the Board of Supervisors.
The total fee for public notice will be provided to you after the final cost is determined and must be paid before the

1. The ARB's action was conditional approval. i will need revised drawings addressing each of the numbered
items before I can issue a Certificate of Appropriateness (which is ARB language for final approval).
2. Since my sign -off is also required on the building permit application you will be making, all of the ARB revisions
will need to be addressed in the drawings submitted with that application. To avoid resubmittals, I recommend
getting the final ARB approval, then submitting the building permit application.
3. You can eliminate the kayaks from the revised ARB drawings (and the subsequent building permit drawings) and
follow-up later with an additional building permit (or amended permit, depending on timing) after the SUP
process is complete.
4. The SUP fee was received on January 9. That puts the SUP on the January 17 review schedule. You will need to
go to the Planning Commission and the Board of Supervisors. Next week I will look into the possibility of getting
an earlier PC date than what is published -- no promises, but I'll see what the options are.
Let's also talk next week about the drawings we'd like the PC and BOS to receive. I'd like to condense and
simplify.
6. What progress has been made on the signatures from the new Stonefield owners? I'll double-check next week,
but I think we allow 2 weeks from the submittal deadline, so we need to get this resolved.

establish outdoor display in the Entrance Corridor.
Location: On the south side of Rt. 250, approximately 450' west of Hansen Road
Regarding the Special Use Permit request:
Motion: Mr. Lebo moved to forward the following recommendation to the Planning Commission:
The ARB cannot support the request for the Special Use Permit for outdoor display as illustrated because it does
not meet the Entrance Corridor Design Guidelines, in particular #5, 9, 10, and 12. The ARB can support the outdoor
display if relocated to the Bond Street elevation, west of the store entrance.
Mr. Wardell seconded the motion.
The motion carried by a vote of 5:0.
Regarding the proposed building renovations:
Motion: Mr. Lebo moved for approval of a Certificate of Appropriateness with the conditions listed in the staff report,
amended as follows:
1. Move the outdoor display to the Bond Street elevation, just west of the store entrance.
2. Add the standard lighting note to the plans. Each outdoor luminaire equipped with a lamp that emits 3, 000 or
more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from
adjoining residential districts and away from adjacent roads. The spillover of lightingfrom luminaires onto
public roads andproperty in residential or rural areas zoning districts shall not exceed one half footcandle.
3. Revise the lighting design to not exceed 20 fc at the ground.
4. Add the standard mechanical equipment note to the plans: Visibility of all mechanical equipmentfrom the
Entrance Corridor shall be eliminated.
5. Confirm that no changes to accessory structures or equipment are proposed.
6. Revise the design to allow the window on the Rt. 29 facing elevation to remain transparent glass.
7. Eliminate or reduce the green metal siding from the stone wall on the Rt. 29 facing elevation, so that the majority
of the stone remains visible.
8. Note that a separate sign application will be needed.
9. Replace the existing trellises on the east elevation with cedar trellises.

He will begin working next week (he's out of town right now) to get the new signatures needed

I received an email from Ryan Lorey last week indicating that the special use permit review could move forward. I am
working on the review of the ARB application for the special use request now, but there are a few things needed for the
SP application to move forward. They are:
1. The special use permit application fee - $2,150. Please see the email copied below for additional information
regarding this fee.
2. Documents authorizing your signature on behalf of LL Bean. Erika Castillo in our County Attorney's office stated
that she asked you for this information but she has not received anything. She needs a letter or other
documents from LL Bean authorizing you to sign the application and other documents on their behalf. Despite
the earlier email indicating that your application was complete, this information is required for the application
to be considered complete.
The ARB drawings were updated after the original submittal, so the SP documents are no longer completely up-to-date.
We'll want to update the SP drawings so everything is coordinated. I recommend waiting on this just a bit, t hough. I'd
like to get further through my ARB review and then discuss with you how we can best present this information to the
Planning Commission and Board of Supervisors.

The Special Use Permit application received in the Department of Community Development on 12/05/2016 has been
deemed complete by County staff. The applicant must now pay the required fee for this application to be further
processed for review.
The fee required for SP-2016-00026 is $2150.00
Please provide a check to the front office staff in the Department of Community Development for the amount noted
above, payable to the "County of Albemarle", by no later than Tuesday December 201h, 2016
If this fee is received after Tuesday December 201" then your application will be processed with the next round of
application submittals. Submittal Schedule
Also, please provide a copy of this email along with your check as verification that your fee can be accepted.
ADDITIONAL FEES REQUIRED BUT NOT DUE AT THIS TIME.
Please note that there will be at least one public hearing by the Planning Commission and one public hearing by the
Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing a legal
advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for
public notice are required before a Special Use Permit may be heard by the Board of Supervisors.
The total fee for public notice will be provided to you after the final cost is determined and must be paid before the
application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner
notification to be between $400 and $450 per hearing. This estimate reflects the average cost of public notice fees for
Special Use Permit applications, but the cost of certain applications may be higher.
If applicable any fees for waiver/special exceptions will be required at the time the additional fees noted above are
calculated. The current fee for a special exception is $457

coming Monday. The applicant is LL Bean and they want to locate in the space that was occupied by Blue
Ridge Mountain Sports. LL Bean typically mounts some kayaks/canoes on their exterior walls and they'd
like to install a version of that display here. (I've copied a random LL bean image below for reference.)
Because the site is in the Entrance Corridor, a Special Use Permit is required. As you know, we typically
hold community meetings for SPs. In this case, it doesn't seem like one is really necessary because of the
consistent commercial nature of the surroundings. Do you agree? I am sending the applicant
=information on the SP requirements this afternoon, and I'd like to include the community meeting
information in that package, if necessary.
