BK12911'60345 THIS DEED, RIGHT OF FIRST REFUSAL AND RESTRICTIVE COVENANT is made as of March 23, 1993 by and between Christopher P. CAMP and Carlin S. CAMP, husband and wife, hereinafter referred to as the Grantors, and Anne Montgomery NOVAR, hereinafter referred to as the Grantee, and whose address is Route 3, Box 60, Earlysville, Virginia, 22936. WITNESSETH That for and in consideration of the sum of Three Hundred Ninety-Five Thousand and no/100ths Dollars ($395,000.00), cash in hand paid, the receipt of which is hereby acknowledged, the Grantors hereby GRANT, BARGAIN, SELL and CONVEY with GENERAL WARRANTY AND ENGLISH COVENANTS OF TITLE unto Anne Montgomery Novak, all that certain lot or parcel of land together with the improvements thereon and the appurtenances thereto, situated on State Route 743 in the White Hall Magisterial District of Albemarle County, Virginia, containing in the aggregate 16.95 acres, more or less and comprised of TRACT I containing 12.10 it acres, more or less as shown on plat of Wm. S. Roudabush, Inc. dated July 14, 1980 and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 696, Page 604, TOGETHER WITH AND ADDED TO, PARCEL X containing 4.85 acres as shown on plat of Roger W. Ray, C.L.S., dated March 10, ,i it 1993, entitled, "Plat Showing Survey of Parcel X, A Portion of 1 I + BK 12971'60346 Tax Map 20 Parcel 13 Being Added To and Cosbined with Tax Map 29 Parcel 13A, Located on State Route 743, At Advance Mills, White Hall District, Albemarle County, Virginia", which plat is attached hereto and made a part hereof, AND BEING all of TRACT I and a portion of TRACT II conveyed to Grantors herein by deed of Allen F. Poole and Teresa R. Pool, husband and wife, dated April 4, 1988 and recorded in the aforesaid Clerk's Office in Deed Book 988, Page 36. RIGHT OF FIRST REFUSAL: Grantors hereby grant unto the Grantee the right of first refusal when and if Grantors should decide to sell the residue of TRACT II not conveyed herein, and described as Tax Map 20-13 on the attached plat, containing 18.83 acres, more or less. Upon receipt by Grantors of a bona fide signed offer to purchase the residue, Grantors shall furnish a copy and give written notice to Grantee who, after receipt, shall have fourteen (14) days in which to exercise Grantee's right to purchase on the same terms and conditions as described in Grantors' bona fide signed offer. Grantee must exercise this right to purchase within the herein described i . fourteen (14) day period by giving written notice to Grantors at II such address as Grantors identify in Grantors' notice to Grantee. Notices given pursuant hereto shall be via certified U. S. mail and shall be deemed given when mailed. If Grantee does not exercise the right to purchase by written notice to Grantors received within the aforesaid fourteen (14) day period, this right of first refusal shall be 2 .erc.104 . BKI297PG0347 deemed waived and Grantee shall execute such documents as may be required to evidence said waiver. However, if sale for which notice is given is not consummated, the right of first refusal shall continue. • This right of first refusal is personal to Grantee and shall not be deemed to run with the land. RESTRICTIVE COVENANT: Grantors convey that portion of the property herein described as Parcel X subject to the following restriction: Grantee hereby covenants and agrees 1 that no structures shall be constructed, erected or otherwise maintained on that portion of the property herein described as Parcel X, except that fencing and one "run-in shed" not to exceed 600 square feet shall be permitted. The "run-in shed" herein described shall be constructed in a manner in harmony with the rural nature of the area. This restriction is imposed only for the benefit of Grantors residue, described on the attached plat as Tax Map 20 Parcel 13, and shall run with the land. This restriction shall run with and bind the land for a term of - twenty-five (25) years from the date of recordation of this Deed, and thereafter shall be renewed automatically for successive periods of ten (10) years each. This conveyance is made further subject to any and all easements, reservations, restrictions and conditions contained in duly recorded deeds, plats and other instruments 1 constituting constructive notice in the chain of title to the property hereby conveyed which have not expired by a limitation 3 BK 1297 PG 0348 of time contained therein or have not otherwise become ineffective.
