SUB201700197 - Road Plans for Drillers Lane
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-303(D)] Acreage of Lots. As proposed the new consolidated TMP 31-21A is bisected by the proposed public
right-of-way dedication; however, this is not approvable. Rather the small portion of land below the right-of-way
dedication needs to become its own parcel. To accomplish this a subdivision application needs to be submitted;
rather than merely a Boundary Line Adjustment application.
The type of subdivision you need to apply for depends on the intended use of the lot. If you are seeking for it to be
a buildable lot, then you will need 30,000 SF of RA zoned property, complete with a primary and reserve
drainfield on the lot approved by VDH, an approved entrance to the lot by VDOT, and maintain adequate road
frontage.
If the above is not your intent and the use of this new lot qualifies under the definition of a "special lot'", you need
to submit a Special Lot application. Special lots are not buildable lots.
In your recent email, you stated that you would like to add the "Future Lots 1 and 2" to the plat for division. If this
is your intent, a subdivision application is required regardless of the above. The plat will be required to go to Site
Review Committee (SRC), which has a 60-day time for action. If you would like to forgo Future Lots 1 and 2 at
this time, then remove any reference to "Future Lot 1 and Future Lot 2 ".
2. [14-409] Coordination and Extension of Streets. The public road shall be extended through TMP 31-21C to the
property line of TMP 31-21D. Additionally, the public road shall be extended to the adjacent property TMP 31-
21B. [See Diagram A for visual representation]
[14-304] Critical Slopes. The County GIS depicts more critical slopes than depicted on the road plans. If these
slopes were previously approved to be disturbed, provide the action date of the critical slope waiver and the site
plan number associated with the approval. If these slopes were not previously approved, in order to be disturbed
them please provide a critical slopes waiver request and update the road plans to accurately depict all critical
slopes. Board of Supervisor action is required prior to disturbance of these slopes. [See Diagram B for visual
representation]
4. [14-303(L)] Public Utility, Drainage and Sight Distance Easements. Depict the location and dimensions of each
public utility, drainage and sight distance easement outside of a street right-of-way; for each existing easement,
include a note stating the deed book and page number. Ensure all easements are labeled "public" or "private" and
label easement holder.
1 Special lot. The term "special lot" means a lot created to be used exclusively for public or private streets, railroad right-of-way and railroad lines, public
utilities, publicly owned or operated public facilities, publicly owned or operated parks, publicly or privately owned sites for personal wireless service
facilities, central water supplies and central sewerage systems as those terns are defined in chapter 16, stormwater management facilities, cemeteries
existing on June 8, 2011, conservation areas, preservation areas, open space, and greenways.

5. [14-302(B)8] Yards. Provide the setbacks for the RA and LI zoning districts. Also, provide distances from all
structures to nearest proposed property lines & right-of-way lines.
6. [14-302(A)9] Building Site. Either depict the location, area and dimensions of a building site on each proposed lot
complying with the requirements of section 18-4.2. or provide the following note on the plat: "Parcel [letter or
number] and the residue of Tax Map/Parcel [numbers] each contain a building site that complies with section
4.2.1 of the Albemarle County Zoning Ordinance. "
7. [14-302(A)10] Right of further division ofproposed lots. Many of these lots are zoned RA. The plat shall track the
development rights associated with the parcels. Provide the following note: "Parcel [letter or number] is assigned
[number] development rights and may/may not be further divided and when further divided these rights shall not
comprise more than [number] acres. The residue of Tax Map/Parcel [numbers] is retaining [number]
development rights and when further divided it shall not consist of more than [number] acres. " Development
rights need not be assigned to a special lot (which is the public right-of-way).
8. [14-302(A)111 Instrument creating property proposed for subdivision. Provide the deed book and page number of
the instrument whereby the property was created, as recorded in the office of the clerk of the circuit court of the
county.
9. [14-303(A)] Statement of Consent to Division. Revise the statement to read: "The platting or dedication of the
following described land [insert correct description of the land subdivided] is with free consent and in accordance
with the desire of the undersigned owners, proprietors and trustees, if any. " Revise.
If the applicant would like to continue utilizing the previous ordinance language: "Any reference to future
potential development is to be deemed as theoretical. All statements affixed to this plat are true and correct to the
best of my knowledge. " Please utilize it as a separate note on the plat. Revise.
10. [14-302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the
plat.

may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this
