SUB-2017-173 Belvedere Boundary Line Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
1. [14-302(A)(1)] Name of Subdivision. Revise the title of the plat to include
Belvedere".
Rev. 1: Comment Addressed.
2. [14-302(A)(2)] Vicinity map. Revise the vicinity map to be the correct scale, not
include a +/-, and show the site in the correct location.
Rev. 1: Comment Addressed.
3. [14-302(A)(4), (15) & 14-303(E)] Private easements; Identification of all owner
and certain interest holders; Dimension standards and information on all lots,
streets, alleys, easements, and shared driveways. Revise the plat to show the
location of the existing access easement for TMP62-2A that crosses TMP 62A3-
1 and TMP 62-2A1, the deed book and page number, any other required
information, for the access easement and specify the holder of that easement.
Rev. 1: Comment addressed. However, it is IMPORTANT to note that this
access easement does not provide street access for TMP 62-213. This is an
existing condition and the lot is non -confirming to the current ordinances
because of its lack street access, as well as street frontage. Access to TMP
62-213 could be problematic in the future if the adjoining parcels where
access is feasible are under different ownership.
4. [14-302(A)(5)&(15), 14-303(E)&(L)] Public easements; Identification of all owner
and certain interest holders; Dimension standards and information on all lots,
streets, alleys, easements, and shared driveways; Public utility, drainage and
sight distance easements. Revise the plat to either list in the notes the names
and addressed of holders of all of the easements affecting the property, including
the deed book and page numbers, the type of easement and the TMP(s) on
which they reside or show the easements on the plat with the required
information provided in labels for all the existing easements including but not
limited to the drainage, sanitary sewer and public utility easements.

5. [1 4-302(A)(5)&(1 5), 14-303(E)&(L)] Public easements; Identification of all owner
and certain interest holders; Dimension standards and information on all lots,
streets, alleys, easements, and shared driveways; Public utility, drainage and
sight distance easements. Revise note 3 so that is does not state that there are
no easements or encroachment except as shown. Contact the plan reviewer to
discuss the wording of this note and how it may impact, or be impacted by, other
notes such as note 1.
Rev. 1: Comment addressed. Existinq easements are now shown and
therefore the note is now correct.
6. [1 4-302(A)(1 4) & 14-314] Land to be dedicated in fee or reserved; Identification
of all interests of the County in property. Show the line work and a label on the
plat for the "dedication upon demand" of the "One hundred (100) foot wide right-
of-way to public use" specified in Proffer 4.1.
Rev. 1: Comment addressed.
7. [14-302(B)(9)] Flood Plain. Revise the floodplain note to, in addition to the
information already provided, specify that a portion of the property (a portion of
TMP62A3-1) is within the 100' year flood plain.
Rev. 1: Comment addressed.
8. [14-303(A)] Statement of consent to division. Revise the statement of consent to
division for TMP 61-160 and TMP 62-2A1 to specify those parcels and not TMP
62-2C.
Rev. 1: Comment Addressed.
9. [14-303(C)] Boundary Lines. Specify where curve C18 is located on the plat. It
does not appear to be utilized, however it is shown in the curve table.

10. [14-303(D)] Acreage of lots. Address the following:
• Revise the "Area Summary" on Sheet No. V1 so that TMP 62A3-1 is shown
as "TMP 62A3-1" and not "63A3-1". There seems to be at least seven
instances of the typographical error within the two sets of calculations.
Rev. 1: Comment Addressed
• The acreage for TMP 62A3-1 differs by over 5 acres, and the acreage of TMP
61-160 differs slightly, from the County's GIS and a previously approved
preliminary subdivision plat (Phase IIB). Provide recorded plats, or other
supporting documentation, to support the acreages shown on the proposed
plat or revise this plat accordingly.
Rev. 1: Comment not fully addressed. The Deed specified in the added
notes on Sheet V2 does not include a plat. The description of the parcel
at that time, in 1999, was 81.443 acres and not the 95.801 acres shown
in the proposed plat. The plat, not specified vet on this proposed plat, in
DB 4299 PG 336 shows TMP 62A3-1 as 90.609 acres as of 2/4/2013.
Neither of these values match the 95.801 acres specified for TMP 62A3-1
on this proposed plat. Provide recorded plats, or other supporting
documentation, to support the acreages shown on the proposed plat or
revise this plat accordingly.
11. [14-3o3(H)] Monuments. Snow the existing (tound), and the proposed (set),
locations for permanent reference monuments for the parcels.
Rev. 1: Comment Addressed.
12. [Comment] Remove or revise the setbacks specified on Sheet No. V1.
Setbacks/yards (14-302 (B)(8)) are not required to be shown on a Boundary Line
Adjustment plat. Also, the setbacks provided are not all correct. Either remove
the setbacks from the plat or contact the plan review about the portions of the
setbacks that are incorrect.
Rev. 1: Comment Addressed.
13. MEW Commentl Please note that although the boundary between C10 and
C11 may match previously recorded plat it does not match the proposed
boundary that is shown in the approved Preliminary Subdivision Plat
(SUB201600119). Determining if this boundary should be realigned with
this BLA might be important to note prior to finalizing this plat.
14. MEW Commentl Revise the plat to add or modify following adjoining parcel
labels:
• TMP 62-16D is incorrectly labeled as TMP 61-160.
• TMP 62G-09-196 is not labeled. Add a label.
• TMP 62G-07-160 is not labeled. Add a label.
